D e- c i d e d 1. - Hiring of inland and marine fishery domain is difined as follow: 1- Hiring of fishing lots must be complimented though auction. 2- Hiring of the fishery domain protect~d for middle scale fishing musht be implemented the formulation of fee by kind and size of fishing gear. 3- Hiring of the marine fishery domain for the fishing operation of the allowed fishing gear must be implimented by fomulating kind and size of fishin gear or by horse power of the fishing vessel, Hiring of the fis~ery domain mentioned in the above points 2 and 3 is not appyed for small scale-family fishing. ticle 2. - The feel of inland and marine fishery domain rented must be included exploitation tax mentioned 1n the Fiat- Law No.23 KROR,CHOR. dated on 14/6/85. Fisherv Department and provincial- Urban offices and provincial- urban taM offices or branch must cooperate togethe~ to collect the fee of fishery domain and all kind of ta~es from the fisherman by the requirement of the government except the small scale-family fisherman. The Dire~tor of the D~partment of Fisheries or d~puty has a right to reject the attendance for bidding of person who; has been bidden but did not respec.t to the <HJr-eemen t. has been qreatlv violated or was untopped wrong doer. The 2 latest case must be considered only in the duration of 2 fi5hing seasons back from the date of auction session. ~t(cle 7. - Each auction of t1shing lot is defined for 2 consecutive fishinQ seasons for e~ploitation.The fix•d fee of fishing lat for bidding up and the bids of the bidders during bidding are the fishing lat fee and exploitation tax for one fishing season ( first fishino qp,As□n ), while the 1ee□ 1 the second fishino season is still the same as the first season. Person who offer$ the fee hiaher then the provisonal f~e fixed formally, is allowed to bid at the 2nd time Second time Auction is conducted by burning a candle which could be burned up in the duration of 3 to 5 minute. During th!;!' candle is burning, "\hr bi,.ct(lers. must bid U? orally, one word at least 5,000 Riels from the highest fee of the first time, a- first candle: Bidder who has offered the fee before the 1st candle flame go out , in allowed to bid at the 2nd candle. For bidde~ who hasn,t offered the fee at the first candle , must not allow to bid at the 2nd candle b second candle: Bidder who has offered the highest fee at the 1st candle is allowed to bid at the 3rd candle while bidder hasn,t offered the fee at the 2nd candle, must not allow to bid at the 3~d candle, c~ third candle ~ Bidder whD ha5 offered the highest fee b~fore the 1st- 2nd- 3rd candle flame go out, the committee must proclaim that thi~ bidder is provisionally bidden. Per!:'.ou/1 who wc,,nted lo bid must be applyed at least 2 days before auction session. ,rt1~le 12- The provisional bond is legitimately confiscated in the case that after bidding the success bidder repul&e to sign on the minute of the a~ctian and the burden nook of r1sn1ng lat or ooesn,t pay ta complete tne definite bond during 15 day~ after auction session. The definite bond is also legitimately confiscated in the case of as mentioned at the point 4 of articl~ 11 or d1C not respect tne contract. Art1cle 13. The provisional $ucces£ bidder of one fishing lot 1s not allowed to b1d for the other t1sh1ng lots. For the person who wnsucceeded in .auction of one or any fishing lot, is allowed to bid for the other fishing lots in the case that this person has been payed the provision~l bond higher or equal to the amount of 1/3 of the fishing lot fee fi~ed for bidding up. Tne state fishing enterprises aue to the d~clsio,, of the Ministry of Agriculture have got the fishing lots for exploiting and researching must pay the fee to the Government by the requirement of the Ministry □ 1 Agriculture and Finance. ;tel~ 17. - The success bidder after getting the definite aec1~1on or tne Ministry of ~griculture, can re-nire to other per~on 1 a part of fishing lot which the yield is not higher than 50% of the yi~ld o1 the whole lot. He expected that he has no possibility to man~ge,by compromis1ng the tee through a contract. The above re~hiring there is not allowed to do through auction eventhough any auction procedure. The sub~equent renter can be e~ploited on the contingency that the above LOntract is attested by the provincial-urban fishery o11ices and the Department of Fisheries. In the case as me~tioned above, the success bidder is still responsible on hi~ contract too. Article 18, - State fishing enterprise or person who holding a fishing license ot the fishing lot has a right to arrest provisionally the evident thing and the d~linquent of an poaching act or chopping the flooding forest in their re&pectiva fishinq lot. Later on, they must send the delinquent and the evident thing , immediateiy to the competent fishery officers or staffs nearby for ekamining and making a r~port. lf any evident thing is must be qiven b~ck to the of the f1st1ing lot. the fishery prcduct,it enterprise or person owner In the case as m~ntioned above, there is not allowed to touch the small scale-family 1ishinQ made by the vlllagers in the fishing lot during closeq season. Article 19. If the fishing lots are lots day (bag net for collecting th•? Art1cl~ 21. Fishery ctcmain fpe mentioned in the point 2 of article 23 ia divided as tallow 1- 40% for provincial-urban budget, but in this 5% is sharing to the fishery office for maintaining ,protecting and improving the fishery domain in it reapectLve province. 2- 60% for national budget, but in this the Ministry of Planning and Finance re=oerved 10%. for T~1e Department of Fisheries to be able maintain, protect and improve the fishery domain. This latest p~rt of income 60/. l must pay to the Department of Fishery •ccount and then immediately transfer to the national budget. Article 25. - The fine and the money from sale of proof confiscated are divided as follow: 1- 40½ for provincial-urban budget. 2- 60~ fo~ national budget. This late6t part (60%) must pay to the Department □ f F1shery and th~n immediately transfer to the r,.3.t10,1a.l budq~t. ·t1cl• 26. - Per~on who make• master piece in suppre=osion uf the fishery law violation must be re~arded, lne Ministry of Finance must reserve budget,for rewarding tc tne suppressive person and the informator, about 10 cf fine from violation. Article 27. Order acts opposing to this Sub-Law is uJns1dered as. no value. Articl~ 28.
