Interim Regulation on State Inspection on Plant Quarantine

Asanov April 5, 1992 INTERIM REGULATIONS On State Inspectorship on Plants Quarantine in the Kyrgyz Republic of the Ministry of Agriculture ofthe Kyrgyz Republic 1. GENERAL PROVISIONS 1.1 The State Inspectorship on Plants Quarantine, hereinafter referred to as "Kyrgyzgosquarantine", shall be a part of the Ministry of Agriculture of the Kyrgyz Republic and shall be an independent structural division of this Ministry, shall enjoy rights of a legal entity, shall have a heraldic stamp with its name, shall own budgetary and settlement accounts in the Operations Department at the Board of the Kyrgyz Joint-Stock Bank APB (Bishkek) and shall execute direct management of the production, economic and financial activities, shall provide financial and logistical supply of the subordinate structural divisions. 1.2 Kyrgyzgosquarantine shall consist of groups of external and internal quarantine. 1.3 The following bodies shall be under the direct supervision of Kyrgyzgosquarantine: State Inspectorships on Plants Quarantine; Quarantine Laboratory; Interregional and Regional Stations on Plants Quarantine; Blocking Stations on Plants Quarantine; Fumigation Group on Disinfection ofSubquarantine Materials. 1.4 Kyrgyzgosquarantine and its structural divisions shall execute its activities in compliance with the legislation in force, Decrees of the President of the Kyrgyz Republic, Resolutions and Instructions of the Cabinet of Ministers of the Kyrgyz Republic, Orders of the Ministry of Agriculture of the Kyrgyz Republic, Charter on Plants Quarantine in the Kyrgyz Republic, other legislative documents and these Regulations. 2. BASIC OBJECTIVES OF KYRGYZGOSQUARANTINE 2.1 Execution of the system of state measures on external and internal plants quarantine, targeted at the protection of the territory of the Kyrgyz republic from import of quarantine and other dangerous pests, diseases and weeds (hereinafter referred to as "Quarantine objects") from foreign countries and the CIS and also aiming the prevention of its spreading within the territory of the Republic. 2.2 Organization of works and control of the activities of the state service on plants quarantine in the Kyrgyz Republic. Determination of strategic trends of the development ofexternal and internal quarantine, considering ecological relations. 2.3 Organization of the state supervision on observance of the determined rules and activities on plants quarantine by the ministries, departments, institutions, enterprises, organizations and individuals at the production, purveyance, transportation, storage, processing, sale and usage of agricultural and other vegetative production (under control production). 3. BASIC FUNCTIONS OF KYRGYZGOSQUARANTINE 3.1 Kyrgyzgosquarantine shall develop, consider, approve and inform its structural divisions on the state programs and systems on prevention of import, localization and liquidation of hotbeds of quarantine objects and especially dangerous and harmful organisms from foreign countries in the Republic. 3.2 Kyrgyzgosquarantine shall consider and approve the annual plans of the work of the structural divisions ofKyrgyzgosquarantine. 3.3 Kyrgyzgosquarantine shall develop and approve Instructions, Rules, Decrees and legislative documents on plants quarantine. It shall submit proposals on issues concerning plants quarantine for consideration to the Ministry of Agriculture; Cabinet of Ministers cfthe Kyrgyz Republic and other superior state bodies. 3.4 Kyrgyzgosquarantine shall enforce state supervision on execution of the Charter's requirements on plants quarantine, legislation in force on plants quarantine, rules. instructions and other documents on plants quarantine on the territory of the Republic. 3.5 Kyrgyzgosquarantine shall execute state quarantine supervision through interregional (regional) and frontier stations on plants quarantine and at the co operation with the interested ministries, departments and organizations at the import, export, transit and interrepublican transportation of seeds, fruits, plants, raw materials, vegetative products and other subquarantine freight (tares, packing material and other). 3.6 Kyrgyzgosquarantine shall create special brigades (groups) from the number of subdepartmental organizations and institutions for rendering urgent assistance in maintaining of not planned activities on examination and arrangement of struggle with quarantine objects in special conditions and extreme situations, shall coordinate the work of the divisions indicated and shall enforce control on the maintenance of the necessary activities. 3.7 Kyrgyzgosquarantine shall carry out communications with scientific institutions in the Kyrgyz Republic and other states with the purpose of improvement of the quarantine business in the Republic, considering the changes taking place and production and economic relations. It shall implement and apply in quarantine practice advanced scientific achievements. It shall consider the plans of studying literature on plants quarantine issues and contents of periodical editions concerning this issue. 3.8 Kyrgyzgosquarantine shall study visual composition and bioecology of lacking and narrowly spread pests, plants and weeds diseases on the territory of the Republic, and on these grounds shall develop the project of the list of quarantine objects with regards to which the state measures on plants quarantine shall be determined and enforced. It shall issue the spreading overviews in the Republic. 3.9 Kyrgyzgosquarantine shall conduct controlling research of agricultural and other lands, places of storage and processing of the vegetative production with the purpose of timely revelation of quarantine objects, localization and its liquidation and imposition of quarantine on the infected territory. 3.10 Kyrgyzgosquarantine shall supervise the activities of the quarantine nursery gardens, sorting plots and greenhouses, maintaining the examination of quarantine status of seeds and plants, importing in Kyrgyzstan from other countries and also shall supervise sowings and plantings in nursery gardens, scientific-research institutions, seed-growing and flower-designing enterprises with the purpose of seed and planting material provision. free from quarantine objects. 3. 11 Kyrgyzgosquarantine shall organize and conduct disinfection of vegetative production, tares, packing material, places of storage, transportation means and other subquarantine production imported from other states and also from subquarantine zones of the Republic. 3.12 Kyrgyzgosquarantine shall bring in proposals on the questions on international collaboration in the field of plants quarantine to the authority of the Ministry of agriculture, to the Cabinet of Ministers of the Kyrgyz Republic; shall be represented in the international organizations, at the Congresses, conferences, meetings, negotiations and other activities covering the terms of reference of the State Inspectorship on plants quarantine of the Kyrgyz Republic. Kyrgyzgosquarantine shall cooperate with other international organizations on plants quarantine according to the procedures determined and within the frames of European and Mediterranean Organization on Plants Protection (EOPP), International Organization on Biological Struggle with Vermins, Plant Diseases and Weeds (lOBS), FAO and with all countries of the world on the bilateral and multilateral basis in the field of plants quarantine. Kyrgyzgosquarantine shall implement the following: 3. 13 shall control on activities arising as a consequences of the international conventions and agreements in the field of plants quarantine, signed by the Kyrgyz Republic with foreign countries. 3.14. according to the procedures determined shall approve the List of biological objects which are not subjects to the import and export. 3.1 5 shall issue importing quarantine permissions for seeds, plants and vegetative production imported into the Kyrgyz Republic from the foreign countries and the CIS and the permission on freight under control shipped in transit via the Kyrgyz Republic, shall define the terms of its import and use. 3. 16 shall organize the development of quarantine inspection methods, laboratory survey of the concealed infection of seeds, plants and vegetative production and the technology of their disinfection. Shall examine, probe and apply new technological methods and diagnostic, prognosis, spreading prevention remedy, localization and struggle with quarantine and other dangerous objects in the quarantine practice. 3. 17 shall pro,"ide quarantine inspection and laboratory survey of seeds, plants and vegetative production imported into the Republic and exported and into regions of the Republic not infected with the quarantine objects. 3.18 shall determine personnel policy in the field of plants quarantine. Shall keep recording and analyses of the quantity and personnel of the Kyrgyzgosquarantine specialists. 3.19. shall select and appoint personnel in directly subordinate inspections, laboratories, fumigation groups, frontier stations and at blocking stations on plants quarantine. Shall select specialists for their further study in the foreign countries and CIS republics of quarantine situation in these countries and quarantine inspection system on imported into the Republic subquarantine production. 3.20 shall bring in proposals on forms of statistical recording and reporting on pLants quarantine in accordance with the requirements of the State statistical reporting system of the Republic, shall conduct analyses on quarantine and other dangerous pests, plants diseases and weeds spreading for the timely development of the complex of activities. 4. KYRGYZGOSQUARANTINE' RIGHTS 4.1 Kyrgyzgosquarantine shall give obligatory for the execution instructions, orders and etc. to the ministries, institutions, organizations, enterprises and individuals on questions regarding plants quarantine followed from the Charter on Plants Quarantine in the Republic, quarantine legislation and other normative acts as well as Decree of the President of the Kyrgyz Republic, Enactment and Instructions of the Cabinet of Ministers and of the Ministry of agriculture and foodstuffs of the Kyrgyz Republic. 4.2 shall allow and prohibit the subsupervising department on plants quarantine to import in Kyrgyzstan, to export and to transport seeds, fruit, plants, raw material and other vegetative production inside the republic, and shall make decisions on temporary restrictions or abolition of export-import and home transportation in cases, specified by the legislation on plantsquarantine. 4.3 shall bring in proposals to the Ministry of agriculture and foodstuffs of the Kyrgyz Republic, to the other superior bodies and local authorities on conducting security-quarantine, arrangement-economic, special and other activities on the quarantine territory and shall control the procedure determined on conducting restrictive and preventionmeasuresupon quarantine objects revelation. 4.4 shall render void the instructions and directions ofthe heads of subordinate inspections issued in violation with the Legislation and according to the procedures determined shall impose a disciplinary sanctions on employees of organizations and institutions under the jurisdictionof the Kyrgyzgosquarantine. 5. INTERRELATION, LINKS 5.1 For the purpose of implementing its tasks and functions Kyrgyzgosquarantine within the limits of its rights shall make a decision independently or conjointly with the organizations under the Ministry of agriculture and foodstuffs of the Kyrgyz Republic, shall cooperate with other ministers, Committees and departments of the KyrgyzRepublic. 6. KYRGYZGOSQUARANINE MANAGEMENT 6.1 Kyrgyzgosquarantine shall be managed by a Head who shall be at the same time Senior State Inspector on plants quarantine of the Kyrgyz Republic in compliance with the Charter on plants quarantine in the Kyrgyz Republic. The head shall be appointed and dismissed by the order of the Ministry of agriculture and foodstuffs of the KyrgyzRepublic. \: by the Minister). 6.2 The Head of the Kyrgyzgosquarantine shall have a Deputy who shall be simultaneously a Deputy of the Senior State inspector on plants quarantine of the Kyrgyz Republic. 6.3 Heads of the State inspectorship in regions, frontier stations, fumigation group, Deputy of the Head of Kyrgyzgosquarantine, senior agronomist, chief accountant and others shall be appointed and dismissed by the management of the Kyrgyzgosquarantine. They shall be specially prepared for plants quarantine and protection (including the Head of the Kyrgyzgosquarantine). 6.4 The Head of the Kyrgyzgosquarantine, Senior State Inspector on plants quarantine of the Kyrgyz Republic within the limits of his competency shall: 6.4.1 supervise the activity of the Kyrgyzgosquarantine, conjointly with the deputy and heads of the subordinate organizations the Kyrgyzgosquarantine shall be responsible for the proper execution of tasks and functions commissioned, shall distribute responsibilities in the system of quarantine service, shall manage their work. 6.4.2 shall ensure consideration of proposals, claims and individuals' complaints according to the procedures determined. 6.4.3 according to the procedures determined shall submit to the Ministry of agriculture and foodstuffs of the Kyrgyz republic proposals on appointment and dismissal of Kyrgyzgosquarantine employees on the basis of the confirmed list of staff awards for the outstanding achievements while performing duties, shall form a human resources reserve for their further promotion and shall manage a work with them, shall appoint heads of structural subdivisions of the Kyrgyzgosquarantine at places on the basis of the proposals of the local authorities. 6.4.4 shall develop and execute activities on improvement of the organization, style and methodology of Kyrgyzgosquarantine work, on strengthening performing discipline and on its employees' business qualificationincrease. 6.4.5 shall provide accurate and correct office work according to the acting instructions. 6.4.6 shall issue the orders obligatory for execution and give the instructions to the subordinate organizations and institutions on special questions as well as to the organizations and institutions of the other ministries. 6.4.7 according to the procedures determined shall approve the structure, staff' and expenses estimate of the Kyrgyzgosquarantineand its structural subdivisions. 6.4.8 shall represent Kyrgyzgosquarantine on questions within the terms of reference in all state, public and other institutions, enterprises and organizations, court and arbitration bodies without any power of attorney for that, shall give a power of attorney (i.e. with a right of power of attorney transfer) and shall conclude economic agreements on behalf of the Kyrgyzgosquarantine. 6.4.9 The Head of the Kyrgyzgosquarantine and his/her Deputy shall have a right to sign documents addressing to the ministries, departments, organizations, institutions and enterprises, excluding documents being under the authority of the Ministry of agriculture and foodstuffs of the Kyrgyz republic and other superior bodies. 7.
