CAP. 372 Water IRev. 1972 LN. 254/1959. L.N.741/1963. THE WATER (WATER APPORTIONMENT BOARD) RULES 1. These Rules may be cited as the Water (Water Apportionment Board) Rules. 2. In these Rules, "Board" means the Water Apportionment Board. 3. The dlairman of the Board shall be such person as the Minister shall appoint. and shall preside at all meetings of the Board at which he Es present. 4. (1) In the absence of the chairman from a meeting. the members of me Board present may. by a majority vote. elect anyone of its members to preside at that meeting. (2) Six members of the Board shall form a quorum. 5. (0 Of the unofficial members of the Board. two shall retire each year. (2) The members to retire each year shall be those two members who have been longest in office since their last appointment, but as between perseus who were appointed to be members on the same day the member or members to retire shall. unless otherwise agreed among thecn.s=ves, be determined by lot. (3) All n::tiring members shall be eligible for reappointment. 6. In the event of a vacancy occurring through resignation. death or removal U1Dder rule 8 of these Rules, the member appointed to the vacancy shaD be appointed for the unexpired residue of the term of office of the member so replaced. 7. A member of the Board may at any time resign his office by notice in writing addressed to the chairman, who shall forthwith cause it to be forwarded to the Minister, and from the date when the chairmaa received the notice such member shaD cease to be a member of the Board. and a new member shall be appointed in accordance lII'ith paragraph (c) of subsection (2) of section 25 of the Act. 8. The ailice of the chairman or a member of the Board shall be vacated if (a) he bI:lcomes bankrupt or suspends payments to or compounds witb his creditors; (b) he is absent either from Kenya for more tbaa three months, or from three consecutive meetings of the Board, without the ~ission of the Minister in the case at the chairman. and of the chairman in the case of the other members; or Rev. 1972] Water CAP. 372 (c) in the opmion of the Minister he becomes physically or mentally incapable of performing his duties as a member. 9. The Minister may appoint a person to act temporarily in the place of a member of the Board in case of his absence or inability to act: Provided that any person acting in the place of a member selected from a panel of names submitted by Catchment Boards shall be selected in the same manner. 10. The appointment. temporary appointment. retirement or resignation or vacation of office of any member of the Board shall be notified in the Gazette. [Subsidiary)
