T he status and condi tions o f a c at c h m ent determines the reliability, quantity and quality of i ts water yields. A catchment area acts like a water storage facility where during the rains, the vegetation cover allows the water ample t i m e to percolate deep down and move as a sub-surface f low to recharge the rivers, springs and ground water storage in both sh al l o w and deep aquifers. This sub-surface flow is slow resulting i n r i v er s from a well-maintained catchment having higher base f l o w s ev en during the dry season as well as good water yield from b o r eh o les in the vicinity. In poorly maintained and degraded catchment , the rainfall results in the rapid surface run-off which i s ch an n eled i n to the river courses, resulting in flashfloods and high v o l u m es o f suspended solids. Since there is little storage in such a catchment , the rivers originating from such catchment wil l not be ab le to sustain their base flows during the dry season. Catchment areas are thus a vital component in water r e s o u r c e management, and they should be formal ly del ineated, dec l ar ed as protected areas by being gazetted as such, protected f r o m encroachment and pollution and managed sustainably t o m ai n t ai n their ecological integrity. 1.6 M w angea H i l l s catchment area i s located w i thin K il if i County in the coastal region. It is within the j urisdictions of M wangea Ji lore and Wachivu; covering Makongeni , Mwahera, Makobeni , Lango Baya, Jilore/Ziani and Rare/Dida sub locations and Chak am a, Mwahera and Lango Baya locations, within Magarini , G an ze an d Malindi sub-counties of Kilifi County. The catchment covers an area of 24,684 ha and is within t he 3LA and 3HD1 hydrological sub basins of Athi Basin A r ea . 1.7 The M wangea Hi l ls l ies within the Galana and Goshi su b catchment which are part of the A thi Basin Area. Mwangea Hills Water Tower is one of the coastal ecosystems and l ies w i thi n the G alana and Goshi sub-catchments w hich are part of the A thi B asin . A l l the r ivers and stream s are seasonal , draining into two major rivers: Sabaki and Vitengeni . 2.2 The climate around Mwangea Hills area is tropical with signif icant warm annual temperatures that ranges between 30°C and 34 ° C . Kilifi County experiences relatively low wind speeds ranging between 4 .8 km/ hr and 12 km/hr . 2.3 The Mwangea Hills experience signif icant amount o f r ai n f al l during the year, the average annual rainfall for Mwangea H i l l s being 300mm. 2.4 Mwangea Hills Catchment falls under sub basin 3HD1 an d 3L A which is drained by the earlier stated rivers that supports the social-economic and environmental ecosystems. 2.5 Mwangea Hills is an important water catchment area t h at i s a source of several r i vers and source of w ater f or the c o m m u n i t i es . The hill is not protected and due to its rich soils with readily available water resources, it has attracted human activities t h at include cultivation, harvesting of trees for charcoal/wood f ue l as wel l as human settlement . This unsustainable approach to t he water resources abstraction and catchment management i s threatening the survival of the rivers emanating from t he h i l l s . 2.6 Section 20 of the Act requires the Authority to prescribe the criteria for classifying water resources for the purposes o f determining water resources quality objectives for eac h c l ass o f w a t e r r e s o u r c e . The Resource Quality Obj ectives represent the desired statu s o f th e resource, covering all aspects of quantity, quality, timing and aquatic biota. The RQO’s are different for different c l asses o f water resource. The obj ectives general ly relate to t he ex ten t t o which the water body is allowed to be adversely impacted by water use with respect to its natural state. Conceptually the RQO’s provide a “ target” condition of the resources. Management deci sions should be made such that the condi tion of t he reso u r c e i s progressively trending towards the RQO. The status o f t he resource is a measure of how f ar the condi tion of the r eso ur ce i s from the RQO. RQOs shall be determined at the nodes w h er e th e Reserve f lows are being determined. 2.7 Sustainable regional water resources management o f th ese u n i t s would require cooperation collaboration and synergy w i th t he Kenya Forest Service, WRUA, the Kenya Wildlife Service, counties, user communities and other stakeholders. STRATEGIC aquifers; aquifers used to supply significant amounts/proportions of water to an area where there a r e no al ternatives, or w here al ternati ves w ould take time and money to develop MAJOR aquifers: high-yielding aquifers with good quality water MINOR aquifers: moderate-yielding aquifers with variable water quali ty POOR aquifers: low-yielding aquifers with poor to reasonable quality water SPECIAL aquifers: aquifers or parts of aquifers designated ‘special aquifers' by the WRA 2.9 Each is further defi ned in terms of its status, i .e .: 2 .8 .2 2 .8 .3 2 .8 .4 2 .8 .5 Satisfactory: no immediate stress, pressure or threat Alert; stress, pressure or threat identified or anticipated Alarm: water levels declining, water quality declining (stress, pressure or threat identified). 2.10 The Mwangea Hills catchment can be classified as “ A l er t ’ the available water is at not of adequate quality and quanti ty to meet the demand. The Mwangea Hills catchment area is at t he risk of pol lution due encroachment of the catchment ar ea f o r anthropogenic activities. The area around Mwangea Hills is predominantly rural settlement with the main land use being cultivation and rearing of livestock. The potential impacts on the water resources a s a resu l t o f h u m an ac t s i n c l u des: (a) Encroachment: People have encroached on water catchment and riparian reserves areas in the upper and middle parts of the catchment , (b) Overexploitation of available resources; The population i n the area has been rapidly growing over the years. This leads to excessive pressure on available natural resources that includes water resources leading to potential w a t e r u se co n f l i c t s . 2 .9 .1 2 .9 .2 2 .9 .3 a s 2 .1 1 L and uses and their potential impact on the w a t e r r e so u r c e s . (C) Soil Erosion: Following uncontrolled farming and other human activities, soil erosion leads to siltation and l o ss o f top soil cover . Deforestation: The forest cover around the hill , the immediate catchment areas as wel l as the wider catchment has been depleted due human activi ties. Forests have been cleared to give way for farmlands, settlements as wel l a s charcoal burning and timber . Water Pollution: Due to excessive economic activities around the hill , the water has been polluted. The farms i n (d) (e) 54 9Kenya Subsidiary Legislation, 2023 the surrounding area use agro-chemicals which eventually find their \vay into the rivers and leading to pollution. Other pollutants include solid waste that is washed i n to the rivers by runoff water during rains. 2.12 Exotic species of plants: There exist numerous exotic species of trees which are unsuitable in a water catchment area, especially wetland, which include the eucalyptus trees. 3.1 The activities to be undertaken within the protected area are those with zero impact on its ecological status and integrity. ' The following activities are hereby specifically prohibited i n t he protected area: Tillage or cultivation. Clearing of indigenous trees or vegetation, (iii) Building of permanent structures (especially boreholes and houses) , (iv) Disposal of any form of waste.
