Lari Swamp Catchment Protected A rea. 5 6 1Kenya Subsidiary Legislation, 2023 Obj ecti ves.1.4 The objectives of this Plan are to— (i) enhance implementation of existing regulations t o protect the rights of all users; (ii) promote water, use efficiency that is hydrologically an d economically benef icial to domestic, agricultural , an d industrial water users and the environment ; and (iii) identify funding sources to implement water conservation programs that help to enhance water resources. 1.5 A catchment area is def ined as the land from which w a t e r naturally flows into a water course. The status and c o nd i t i o n s o f a catchment determines the reliability, quantity and quality of its water yields. A catchment area acts like a water storage facil ity where during the rains, the vegetation cover allows t he w ater ample time to percolate deep down and move as a sub-surface f low to recharge the rivers, springs and ground water storage in both shallow and deep aquifers. This sub-surface flow i s sl o w resulting in rivers from a well-maintained catchment having higher base flows even during the dry season as well as good water yield from boreholes in the vicinity. In poorly m ai n t ai ned and degraded catchment, the rainfall results in the rapid surf ace run-of f w hich i s channeled i nto the ri ver courses, resulting in f lashfloods and high volumes of suspended solids. Since t h er e i s little storage in such a catchment, the rivers originating f r o m su c h catchment wi ll not be able to sustain their base f lows during the dry season. Catchment areas are thus a vital component in water r e s o u r c e management, and they should be formally delineated, dec l ar ed as protected areas by being gazetted as such, protected f r o m encroachment and pollution and managed sustainably to m ai n t ai n their ecological integrity. 1.6 The Lari Swamp (here after referred to as the “swamp”) t r a v e r se s three locations namely Lari , Kirenga and Gituamba of L ar i Su b county in Kiambu County. The swamp is can be seen off Nairobi- Nakuru Highway, a distance of 2.0 kilometres f r o m Nyambari Town to the right and is accessible from Nyambari Town immediately past the police station, which is a d i stanc e o f 2 kilometres from the highway . 1.7 The swamp derived area is 2.447 Km̂ or 244.66 hectare a s delineated from 1976 Map Sheet 148/1 for Limuru. The swamp is the source of Ruiru River. 2.2 The climate of Lari Swamp is generally sub-humid, with average annual precipitation ranging from 800 to 1200 mil l imetres. T he wettest months are typically April and M ay while the d r i est months are July through September . Temperatures are m i l d throughout the year , with average highs ranging from 24 to 2 8 degree Celsius and average lows ranging 14 to 17 degrees C e l si u s . 2.3 Continental Rains from July to September when the I T C Z i s located north of the equator pulling winds from the t h an the Eastern part during this season. Short rains from October t o November. Besides the seasonal changes brought about by the ITCZ, the local topography causes large variations i n t h e c l i m ate . T he A nnual Rainf al l table i s contained under A nnexure 2 o f th e Seco nd Sc hed u l e . 2.4 There is both indigenous and exotic vegetation cover in thi s area, however vegetation in Lari Swamp is largely influenced by human activities. Most farmers practice mixed farming, the m o st dominant vegetation i s food crops for both animal and h u m an consumption, and woodlots. The most popular woodlot t r e e s a r e the blue gums present in large quantities. 2.5 There is intense agricultural practise and settlements th at h as l ed to degradation of Lari Swamp Its riparian and catchment h as b een affected by cultivation, livestock grazing, harvesting o f indigenous plants and the planting of exotic tree species t h at h as resulted into reduced recharge into the ground, lowering o f t h e water table and a decrease in the discharge of the R u i ru r i v er t h at f lows downstream out of the Lari Swamp. 2.6 Lari Sub-county has witnessed increase in population, dec l i ne i n soil fertility this has made most farmers to move upland an d encroach the swamp. Lari swamp areas is sub-divided into plots. Part of the swamp has been backfilled and proscribed act i v i t i es are being carried out including building of permanent st r u c tu res , dumping of soil , cultivating, planting of exotic trees. R u i r u R i v er h as b een c an al i zed . 2.7 Section 20 of the Act requires the Authority to preseribe the criteria for classifying water resources for the purposes o f determining water resources quality objectives for eac h c l ass o f w a t e r r e s o u r c e . The Resource Quality Objectives represent the desired statu s o f the resource, covering all aspects of quantity, quality, timing and aquatic biota. The RQO’s are dif ferent for dif ferent c l asses o f water resource. The obj ectives general ly relate to t h e ex ten t to which the water body is allowed to be adversely impacted by water use with respect to its natural state. Conceptually t h e RQO’s provide a “ target” condition of the resources. C l im ate . R ainf al l . V egetation. V ulnerabil i ty of the w ater r e s o u r e e . Kenya Subsidiary Legislation, 2023 5 6 3 M anagement decisions should be made such that the condition o f the resource is progressively trending towards the RQO. The status of the resource i s a measure of how f ar the c o n d i t i o n o f t he resource is from the RQO. Initially, RQOs shall be determ i ned at the nodes where the Reserve flows are being determined. 2.8 RQOs shal l be determined at the nodes where the reser v e f lo w s are being determined. The focus for water resources management is the protection o f the natural ecological characteristics for ecological , r ecr eat i o na l and development of tourism with economic importance. Key w ater r esou r ces i ssues i nc l ud e : (a) W ater scarcity , (b) Catchment degradation, (c) Erosion , (d) Legal settlement in riparian areas and swamp and t he l and tenure around the swamp, (e) Human activities in Lari Swamp affecting the role of swamp, (f) I l legal and over abstraction 2.9 Sustainable regional water resources management o f t hese u n i t s would require cooperation collaboration and synergy w i t h t he Kenya Forest Service, WRUA, the Kenya Wildlife Service, count ies, user comm uni ties and other stakeholders. 2.10 The present aquifer classif ication system in Kenya is partly demand-oriented and partly geo-political and entails f i v e c l asses : 2.10.1 STRATEGIC aquifers: Aquifers used to supply significant amounts/proportions of water to an area w her e there are no alternatives, or where alternatives would t ak e time and money to develop. 2.10.2 MAJOR aquifers: High-yielding aquifers with good qual ity water . 2.10.3 MINOR aquifers: Moderate-yielding aquifers with variable water quality . 2.10.4 POOR aquifers: Low-yielding aquifers with poor t o reasonable qual ity water . 2.10.5 SPECIAL aquifers: Aquifers or parts of aquifers designated ‘special aquifers’ by the WRA . 2.11 Each is further defi ned in terms of its status, i .e .: 2.11.1 Satisfactory: No immediate stress, pressure o r t h r eat . 2.11.2 A lert : Stress, pressure or threat identif ied or anticipated. 2.11.3 Alarm: Water levels declining, water quality decl ining (stress, pressure or threat identif ied) . T he cl ass of the w at e r r e so u r c e . Kenya Subsidiary Legislation, 2023564 2.12 The Upper Athi sub-catchment which Lari Swamp f al l s u nd er can be classi f ied as “ A lert” as the avai l able water i s at t im es no t of adequate quantity and quality to meet the demand. T he w ater availability is relatively good in terms of quantity and quali ty in the upper parts of the river but deteriorates as the r i v er f l o w s downstream due to pol lution. 2.13 The land uses impacts on water resources in Lari i n c l u des w ater pollution due to agricultural chemicals and fertilisers u sed i n farming, deforestation and soil erosion and changes i n precipitation patterns due to cl imate change. 2.14 The swamp is continuously being degraded through l and reclamation for subsistence agriculture, human settlement and set up of investments of varying scope and character agricultural act i v i t ies an d set t lem en t . 2.15 The high demand for productive land across and the increasing population in Kenya is evident in Lari Sub-county.
