\\192.168.0.1\Typesetters\2024\ No. 191 THE TRADE ACT THE TRADE (PLASTIC PACKAGING MATERIALS PROHIBITION) (AMENDMENT) ORDER, 2024 In exercise of the power conferred upon the Minister by section 8(1)(a), (b) and (c) of the Trade Act, and of every other power hereunto enabling, the following Order is hereby made:— 1. This Order may be cited as the Trade (Plastic Packaging Materials Prohibition) (Amendment) Order, 2024, and shall be read and construed as one with the Trade (Plastic Packaging Materials Prohibition) Order, 2018 (hereinafter referred to as the principal Order), and all amendments thereto. 2. The principal Order is amended by deleting paragraph 2 and substituting therefor the following paragraph— “ 2.—(1) In this Order— “microplastics” means pieces of plastic less than 5 mm in length; THE JAMAICA GAZETTE PROCLAMATIONS, RULES AND REGULATIONS Vol. CXLVII THURSDAY, JULY 11, 2024 No. 145 SUPPLEMENT 951 “persons with disabilities” has the meaning assigned to it by the Disabilities Act, 2014; “plastic food container” means a food container, manufactured for single use, made in whole or in part of polyethylene, polypropylene or polylactic acid and does not include any lid associated with that container; “single use plastic” means— (a) single use plastic bags; (b) packaging made in whole or in part of expanded polystyrene foam; (c) drinking straws made in whole or in part of polyethylene or polypropylene, manufactured for single use; (d) plastic food containers; or (e) cosmetic care or personal care products to which plastic microbeads or microplastics have been intentionally added; “single use plastic bag” means any bag— (a) made in whole or in part of polyethylene or polypropylene; and (b) with dimensions not exceeding 610 mm x 610 mm and 0.06 mm thickness. (2) For the purposes of this Order, a quantity shall be taken to be commercial if the quantity is such that it is reasonable to conclude that it is directed toward sale by wholesale or retail for the purpose of obtaining economic benefit, whether in cash or kind. 3. Paragraph 3 of the principal Order is amended by deleting the words “With effect from the 1st day of January, 2019, and subject to paragraph 4,” and substituting therefor the words “Subject to paragraph 4,”. 4. Paragraph 4 of the principal Order is amended— (a) in sub-paragraph (e), by deleting the words “; and” and substituting therefor a semi-colon; (b) in sub-paragraph (f), by deleting the full stop and substituting therefor a semi- colon; and (c) by inserting, next after sub-paragraph (f), the following sub-paragraphs— “(g) until the 11 th day of July, 2024, to the importation of plastic food containers; (h) until the 9th day of January, 2025, to the distribution of plastic food containers; 952 PROCLAMATIONS, RULES AND REGULATIONS [JULY 11, 2024 PRINTED BY JAMAICA PRINTING SERVICES (1992) LTD., (GOVERNMENT PRINTERS), DUKE STREET, KINGSTON, JAMAICA (i) until the 1st day of July, 2025, to cosmetic care or personal care products to which plastic microbeads or microplastics have been intentionally added; and (j) to cosmetic care or personal care products— (i) to which plastic microbeads or microplastics have been intentionally added; and (ii) that were imported before the 1st day of July, 2025.”.
