PROCLAMATIONS,RULES AND REGUlATIONS PART I-General, contd "Inspector of Marks" means (a) an Inspector; and (b) any other person designated lo carry out the functions nf InspectOT of Marks under Schedule 2, "length" and "overall length" have the some meaning as m­ (a) the Tonnage Convention: and (b) any applicoble regulations made under the Act with respect to ascertaimng the tonnage of ships, "owner" m relation to a ship includes a demise or bareboat charterer and a managing owner, "regi,ter" or "appropriate reg1'tcr'" ,n relal!on to a ship means the appropriate register under section 24A of the Act; "sh,p" has the same meanmg as Ln secnon 2 of the Act, but doe, not include a bareboat chartered ,hip except, for the purposes of Parts N and V of these Regulations, and whenever the context te~mrc,, includes a ship under construcllon, "ship 1denuficallon number" means the number allocated to the sh,p m accordance with tegulal1on 6 (I) (a) and rncludes the officLOl number, national identlficat,on number and the Jamaican Ship Registry identity number; '"ship under construction" means a ship, the keel of which has been la,d or which is at a sirrulac stage of cotislruclion: "s,milar stage of construction" means the stage at which (a) construction ident,fiable with a specific ship bcgms; and (b) as,embly of that ,hip has cormnenccd comprising at least 50 tonnes or one per cent of the estimated ma,., of all structural material whichever LS less, "Tonnage Convention" means the lnlernallonal Convention, on Tonnage Measurement of Ships 1969, as amended from time to lime as ,n force in telatJon to Jamaica; "transfer of a ship" include,, cxcep1 where the contex1 otherwise requ,res, transfer of a share m a ship. PART JJl Reges/ration 4.- (!) An apphcahon for registration of a ship ,hall be made to the Registrar m the form set out Ln Schedule I. (2) An apphcal!On for registration of a ship wh,ch ha.,, immediately pnor to the apphcanon, been registered ma foreign registry shall, subject to paragraph (3), be accompanied by a certificate of deregistrallon from that register in respect of that ship. (3) The Reg,strar General, may on apphcahon made to him in wrinng grant such longer ~od as he thinks fit for the submiss,on of the certificate. 5. (2) The registrar may, on request by a classification soc,ety or authori.ced surveyor, allocate the slHp tdenHficatLon to a ship before be rccei,e, all other registration documents, (3) Where the number allocal<:d to a ship under paragraph (2) ha, been carved into the beam of the .,hip but the reg1stratrnn of the ,h,p is refused, the number shall, upon not,ficatlon to the applicant of the refusaL be permanently defaced and a cert,ficate to that effect by the clasSLficanon society or authorized surveyor shall be submmed by the applicant to tl,e registrar 7. (2) If the owner fails to comply with the d1rcction of the registrar under paragraph(\), the registrar may {a) if the registration of the ,hip is not completed, refuse to register it until h,s dire<tion has been complied with; or (b) ,f the ship is regrntered, serve notice on the owner or agent appomtcd under section 20A of the Act reqmring him to produce .,,,tlnn thuty days, evidence suffic,ent to sansfy h11n that the particulars of the measumnent and tonnage are, or that the carvmg OT markmg of the sh,p ,., correct. (4) Where the registration of a slup is cancelled under pan.graph (3), the shipowner shall forthwith surrender its Certificate of Registry. (5) Where the registrar serves a noltce under this regulation on the ownCT or agent appointed under section 20A of the Act 1n respect of which a mortgage is registered, he shall send a copy of the notice to each mortgagee at the address recorded in !he register for such mortgagee. (2) Subject to paragraph (3), all documenls which have been produced to the registrar to estahh,h title shall be rctumcd to the applicant after the ship ha, been registered. (3) Prior to thcu return under paragraph (2), the documents shall be stamped by the reg,strar 10 md,cate that they have been used for the registratoon of a ship. 15. An apphcallon for registration on transmiss,on of a registered ship or a share 1n a registered ship under secuon 65 of the Act shall be made tn the form approved by the Director. (2) lbe application shall be in Wnting and shall, subjccl 10 rcgulalion 54, be accompanied by lhc Certificale of Reg,stry and such evidence as to the change as may be required by the Regislrar, (3) Where there is a change in the tonnage of a ,h,p, ii shall be resurveyed and the lonnage ascertamed pursuanl lo section 43 of !he Act and thereafter, the shipowner shall apply in writmg as .soon as pract,cable in a form approved by the Director, for the change to be recorded in the register. (4) The application shall be accompanied hy the relevant Cert,ficalt of Survey and the Certificate of Registry. (S) On recording the change m the regmcred particulars the rcg,strar shall cancel !he •~,sting certificate and ,ssue to the owner a new Cetllficate of Registry. 21.----{l) An application for approval of the change oflhc name ofa ship shall be made in accordance with Schedule 5. (2) If it appears to the Direclor that a proposed change of name complies with Schedule 5, he shall within seven days of submission of the application isoue a corving and marking note lo the owner. 22.---{I) Oa receipt of the carvmg and markmg note the owner ,hall­ (a) cause !he ship lO be marked with the new name, and (b) in the case of a ship other lhan a pleasure craft under 24 metres in length, cause the marking lO be ,nspeeltd in accordance with regulation 8 (2) The Inspector of Mark.s shall, 1f sal,sfied !hat the shop " marked 1n the manner required by Schedule 2, complete the carvtng and rruirkmg note and rclllrn it lO !he registrar 23. PART ]V -Mortgage< 25. A mortgoge produced for registration under section 69 of the Act, a transfer of a reg1Stcred mortgage, and a discharge of a ugistered mortgage, shall be c~ccuted and ,nested ,n the form respectively approved by the Oirector. 2(, -(l) Where any person who is an mlendmg mortgagee under a proposed mongage ol M a reg1>kred ship; or (b) a share ma reg,stered ship, notifies a regi,trar Ln wnt,ng of the mortgagees mtcnded 1nttn:sl under the proposed mortgage, the registrar shall record that 1meresl in the appropriate register m the orde, ,n nme m which they are produced to him for that purpose, (2) For the purpose of paragraph (I) the nonce 10 the Rcg1Strar (rn these Regulations called "• priority nouce") shall con!J1n­ (a) the name and offic,a] number of the ship; (b) the name, address and sigr,ature of the intending mongagm; (c) the nwnber of shares to be mortgaged; and (d) the name and address of the intending mortgagee, (3) Where any person who" an in!endmg mongagec of­ (a) a slup which " not yet registered; or (b) a share m any such ship, notifies the reg,strar in 'wT\tmg of his intended mtcrest unde,- the proposed mortgage, the registrar (,) shall record that mterest m the awropriate registcr; and (ii) if the ,h,p is subsequently registe,ed, shoU ,egister the ship subject to thol interest or, 1f the mortgage has by then been e,ceculed in accordance with regulation 25 and produced to the registrar, ,ubJect to that mortgage.
