Resolution No. 14 of 1992 concerning the plantation in the city of Baghdad

RESOLUTIONS RESOLITTION No. (to Date : 6th- Rajab. 1412 H., '11-1-1992 A.D. In accordance with the provisions of Para. (A) of Article (42) of the Constitution, The Revolutionary Command Council have decided the following : 1- A. The plantation of lands specified thereof the agricultural usages shall be carried out by virtue of the Master Plan of Baghdad City and within its limitations by trees, and that shall not prevent the plantation of these lands with the seasonal crops, provided that the plantation of trees must begin in accordance with the density decided thereof after the passage of one year from the date of the validity of this Resolution. B. The provisions of Para. (A) shall be valid on the lands provided with the water share, but the lands that are not provided with water share, the commencing of their plan tation shall be made after the passage of one year from the date of supplying the water share thereto. 2- The contracts of the valid lease which do not secure the execution of the provisions of Item (1) of this Resolution in accord ance to its provisions shall be amended. The Official Gazette No. (5) 2 29-1-1992 RESOLUTIONS 3- The contravener of the provisions of this Resolution shall be punished by one of the I following punishments and according to the situations : Is. : The revocation of the agricultural contract or the lease contract if it was leased. B : Securing of the agricultural land owners owned an special, pure ownership for the natural and Juristic persons which their owners had not afforested thereof accord ing to the agricultural density decided there to annually double sum equivalent to the double of production of the corps- limited to . their plantation. I C- The land shall be considered as, dissolved and be registered owned to the State and be destituted of the right of disposal if the eon travenor was the one who had the right of disposal therein. 4- The Minister of Agriculture and irrigation and Amin Baghdad, each one according to his speciality in eocordinatlon between I them, shall undertake the issuance of the instructions, to facilitate the execution of the provisions of this Resolution. 5- This Resolution shall be published in the Official Gazette and considered valid from I the date of its issuance.
