L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx II—[k.M 3—mi&[k.M (ii) PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2596] ubZ fnYyh] cg̀Lifrokj] fnlEcj 18] 2014@vxzgk;.k 27] 1936 No. 2596] NEW DELHI, THURSDAY, DECEMBER 18, 2014/AGRAHAYANA 27, 1936 पया�वरणपया�वरणपया�वरणपया�वरण,,,, वन और जलवायु प�रवत�न मं�ालय वन और जलवायु प�रवत�न मं�ालय वन और जलवायु प�रवत�न मं�ालय वन और जलवायु प�रवत�न मं�ालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द� ली, 17 �दस बर, 2014 काकाकाका....आआआआ. . . . 3232323232323232((((अअअअ))))....————भारत अंतररा� �ीय खा� और कृिष के िलए पादप अनुवांिशक" संसाधन संिध (आईटीपीजी- आरएफए), का एक प$कार ह ैऔर उ( त संिध पर भारत ने ह) ता$र कर �दए ह* और 10 जून, 2002 को उसका अनुसमथ.न कर �दया ह;ै और जब�क आईटीपीजीआरएफए के उ3े4 य खा� और कृिष के िलए पादप आनुवांिशक संसाधन5 का संर$ण और भरणीय उपयोग तथा उनके उपयोग से उ8भूत फायद5 का जैिवक िविवधता के संर$ण से सामंज)यपूण. भरणीय कृिष और खा� सुर$ा के िलए सा यापूण. बंटवारा ह;ै और जब�क आईटीपीजीआरएफए का अनु: छेद 12 ब< प$ीय =णाली के अधीन संिवदाकारी प$कार5 >ारा खा� और कृिष के िलए पादप आनुवांिशक संसाधन5 तक प<चं को सुकर बनाने का उपबंध करता ह;ै और जब�क आनुवांिशक संसाधन5 पर प<चं और उनके उपयोग से उ8भूत फायद5 का ऋजु और सा यपूण. िवभाजन करने पर नागोया =ोटोकॉल और जैव िविवधता कB वCशन तारीख 29 अ( तूबर, 2010 जैव िविवधता कB वCशन के फायद5 को बांटने हतुे प<चं के काया.B वयन के िलए एक िलखत ह;ै और जब�क उ( त नागोया =ोटोकॉल का अनु: छेद 4 उपबंध करता ह ै�क =ोटोकॉल कवर �कए गए िविश� ट आनुवांिशक संसाधन5 के संबंध मC िवशेषीकृत िलखत के प$कार या प$कार5 को और िवशेषीकृत िलखत के =योजन के िलए लाग ूनहD होता ह ै; और जब�क जैव िविवधता अिधिनयम, 2002 (2003 का 18) केB Eीय सरकार को उ( त अिधिनयम के उपबंध5 से कितपय जैव संसाधन5 को छूट =दान करने के िलए सश( त करता ह ै। अत:, अब, केB Eीय सरकार, रा� �ीय जैव िविवधता =ािधकरण के परामश. से, जैव िविवधता अिधिनयम, 2002 (िजसे इसमC इसके प4 चात् उ( त अिधिनयम कहा गया ह)ै क" धारा 40 >ारा =दH त शि( तय5 का =योग करते <ए और खा� और कृिष के िलए पादप आनुवांिशक संसाधन5 तक प<चं को सुकर बनाने के िलए आईटीपीजीआरएफए क" भारत सरकार क" 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बाI यता को पूरा करने के िलए, घोिषत करती ह ै�क कृिष और सहकाKरता िवभाग समय-समय पर आईटीपीजीआरएफए के उपाबंध-1 मC सूचीबL फसल5 मC से ऐसी फसल5 को, जो खा� फसलC तथा चारा ह*, जो उसक" ब<प$ीय =णाली के अंतग.त कवर क" गई ह*, िविनNद� ट कर सकेगा जैसा �क वह आव4 यक समझे और तदनुसार उB हC उ( त अिधिनयम क" धारा 3 और 4 से अनुसंधान, =जनन और खा� और कृिष मC =िश$ण मC उपयोग �कए जाने के =योजन के िलए छूट =दान कर सकेगा: परंतु ऐसे =योजन5 मC रासायिनक, भेषजीय और/या अB य गैर खा� या दाना औ�ोिगक उपयोग शािमल नहD ह5गे । 2. कृिष और सहकाKरता िवभाग, रा� �ीय जैव िविवधता =ािधकरण को आईटीपीजीआरएफए के अधीन पूवQ( त =योजन5 क" बाबत खा� और कृिष के िलए पादप आनुवांिशक संसाधन5 तक िविनNद� ट फसल5, जैसी �क समय-समय पर उसके >ारा िविहत क" जाएं, से अवगत रखेगा । [फा. सं. 28-5/2008-CS(NBA)] अिनल संत, संयु( त सिचव MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th December, 2014 S.O. 3232(E).—Whereas, India is a party to the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) having signed and ratified the said treaty on 10 th June, 2002; and Whereas, the objectives of the ITPGRFA are conservation and sustainable use of plant genetic resources for food and agriculture and fair and equitable sharing of the benefits arising out of their use, in harmony with the Convention on Biological Diversity, for sustainable agriculture and food security; and Whereas, article 12 of the ITPGRFA provides for facilitated access to plant genetic resources for food and agriculture under the Multilateral System by the contracting parties; and Whereas, the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits arising from their Utilization to the Convention on Biological Diversity dated the 29 th October, 2010 is the instrument for implementation of access for benefit sharing provisions of the Convention on Biological Diversity; and Whereas, article 4 of the said Nagoya Protocol provides that the protocol does not apply for the party or parties to the specialized instrument in respect of the specific genetic resource covered by and for the purpose of the specialized instrument; and Whereas, Section 40 of the Biological Diversity Act, 2002 (18 of 2003) empowers the Central Government to exempt certain biological resources from the provisions of the said Act. Now, therefore, in exercise of the powers conferred by section 40 of the Biological Diversity Act, 2002 (hereinafter referred to as the said Act), and in fulfilment of the obligations of the Government of India to the ITPGRFA for providing facilitated access to the plant genetic resources for food and agriculture, the Central Government, in consultation with the National Biodiversity Authority, hereby declares that the Department of Agriculture and Cooperation may, from time to time specify such crops as it considers necessary from amongst the crops listed in the Annex I of the ITPGRFA, being food crops and forages covered under the Multilateral System thereof, and accordingly exempts them from Section 3 and 4 of the said Act, for the purpose of utilization and conservation for research, breeding and training for food and agriculture: Provided that such purposes shall not include chemical, pharmaceutical and/or other non-food or feed industrial uses. 2. The Department of Agriculture and Cooperation shall keep the National Biodiversity Authority informed of all crops as may be specified by it from time to time, for providing access to plant genetic resources for food and agriculture under the ITPGRFA for the purposes aforesaid.
