G.S.R. 48(E).-ln exercise of the powers conferred by clause (c) of sub-section (2) of Section }9 re;id with Section 8 of the National Food Security Act, 2013 (20 of 2013), the Central Government, u. er consultation ,vith the State Govenu11ents, hereby 1nakes the following rules, namely: 1. Short title and commencement.- (I) 1'hese 1ulcs may be called the Food Scc1u·ity A!\owa1 cc llulcs, 2015. (2) 'fhey shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) !J.1 these rules, unless the context otherwise requires,­ (a) "Act" 111eans the National Food Security Act, 2013 (20 of 2013); (b) "nodal officer" 1neans an officer designated as such by the State Govenunent under sec1 ·.on 14 of the Act; (c) "entitled person" means a person belonging to eligible households identified as such w lcr the Act by the State Govemn1cnt and in possession of a valid ration card; (2) words and expressions used but not defined in these rules shall have the mean:,1gs rcspccti vely assigned to them in the Act. 3. Thnc lhnits for allocation of foodgrains.-·rhe Central Gove11unent a11d the State Govcriur :nts shall adhere to the tin1e linlits provided in the Public Distribution System (Control) Order, 2001 or any c her orders issued fron1 tin1e to time by Central Gove1nment, for allocation of foodgrains and 1naking r ieu1 available for distribution to the persons entitled under the Act. ' ' 4. Payn1ent of food security allowance in cases of non-supply of foodgrains.-(1) 'fhe r )dal officer shall verify, at the end of every n1onth and at each fair price shop, the status Of supply of foodgrair.s lo · !lie entitled persons covered under each fair price shop, as per their entitlen1ent under the Act (2) The nodal officer shall record in writing, the reasons· for non-supply of entitled quantily or foodgrains to any entitled person. (3) The nodal ofi1ccr shall ensure paytnent of food security allowance to the entitled perscn in every case where entitled quantity of foodgrains has not been supplied due to non-availability of foodgra1 1s al the fair price shop or for any unforeseen reasons. (4) The nodal officer shall register a con1plaint with the District Grievance Rcdressal () ficcr fortlr,vith \Vhcre foodgrait1s have not been supplied due to any \villful lapse of any fair price shop dealer. ! THE GAZE1l"E OF INDIA: EXTRAORDINARY (PART I! SEC. J(i) l ' . 5. . Verification o f status of supply.-The State Government shall use electronic methods, subject to ava1labihty of adequate infrastructure, for canying out and recording the------- · (i) 1nonth-e11d verification of status of distribution of foodgrains; and (ii) reasons for non-distribution, if any, in respect of each fair price shop and place such details in the public domain. 6. Con1putatlon of food security allowance.-The amow1t of food security allowance admissible lo cnt1tled persons shall be computed by· multiplying the difference between the 1.25 times the minimun1 support price of the relcvru1t foodgrains for that 1narkcting season and the prices specified in Schedule I lo the Act, ,vilh the quantity of non-supply. 7. j•criod within ,vhich food security allowance to be paid.-The nodal officer shall ensure the p;iynicnt or rood security allowance by the end of the third week of the month following the 1nonth in which the 1iun-supply occurred. 8. Mode of pay1nent of food security ullowance.-(1) The State Governn1ent shal! ensure the payincnt of fOod security allowance to the entitled persons through bank accounts. (2) If any entitled person has not opened a bank account, the initial payment of food security Prc,vi<lcd ti:iat the nodal officer shall ensure that a bank account is· opened by such person within one 111011th fro1n the date of initial payment of the food security allowance. 9. Food security allowance when not payable.-The Food security allowance shall not be payable to an entitled person who does not visit the fair price shop to clai1n his entitlement during the 1nonth: Provided that the nodal officer may exe1npt a person from visiting the fair price shop and claiming hi~ ent1llcn1enl, for reasons to he recorded in writing: Provided further that the food security allowance shall not be payable to ru1 entitled person wh<. re ruses lo clain1 his entitlen1ent on the ground of quality of foodgrains or on such other grounds. 10. Sun1rnary report by Nodal Officcr.-"fhe nodal officer shall, based on montl1ly verification r:' slat us of supply of foodgrains, specified in rule 4, sub1nit a summary report to the District Magistrate, or an · otlicr officer authorised by the State Govem111c11t for this purpose, by fifleenth day of the month following th:; 1nunth uf distribution, indicating the cases of non-supply of foodgrains to the entitled persons, along wil,1 rcasnns and the re111cdh1l 1neasure taken, wherever necessary. 11. Co1nplaint regarding quality of foodgrains.-Any co1nplaint relating to quality of foodgrait,~ shed! be 111,Hlc by the complainant to the District Grievance R.edrcssal Officer in writing seeking redressal c ( his co1nplainl, which sh8ll be inquired into and decided by the District Grievance Redressal Officer or any other officer authorised by the State Govem1nent within a period not exceeding fifteen days. ' 12. J)istribution of more than one month entitlc1nent.-Where the State Governments follo\\' t!.c practice or supply of 111ore than one ITlonth's entitle111ent at a tilne, appropriate arrangen1ents for verificatic n 0 (' sui 1p\y of such entitlcn1ents to the entitled·persous shall be undertaken·by the concerned St ale Govern1ne,1t so as to ensure distribution of foodgrains as per the entitle1nenls or payn1ent of food security allowance o eligible persons in case of non-supply of entitled quantity of foodgrains. 13. State Gover111nents co1npetent to issue directions,-l'he State Governments, if considcr,.-ci necessary, niay issue such directions for the ilnplen1entation of these rules, as dee1ned fit. · [F.
