158 THE ARUNACHAL PRADESH PANCHAYATRAJ (AMENDMENT) ACT, 2003 (ACT NO. 1 of 2003) AN ACT FUrther to amend the Arunachal Pradesh Panchayat Raj Act, 1997 (Act No. 5 of 2001). WHEREAS, it was expedient to amend the Anmachal Pradesh Panchayat Raj Act. 1997 (Act No. Sof 2001) ; AND WHEREAS it was considered necessary lo immediately amend ihe Arunachal Pradesh Panchayat Raj Act, 1997; AND WHEREAS the Arunachal Pradesh Legislative Assembly was not in session ; AND WHEREAS !he Governor ot An.machal Pradesh was satisfied that circumstances existed which rendeted it necessary for him to make immed!ale action to amend the aforesaid Act. therefore, promulgated the Arunachal Pradesh Panchayat Raj (Amendment} Ordinance No. 3 of 2002 on 30lh December, 2002. AND WHEREAS it Is expedient to replace the said Ordinance by an Act of the State L,egislature ; it is hereby enacted in the Fltty-fourth year of the Republic of India as follows :- Short liUe i. (l) This Acr may be called the Arunachal and com- Pradesh Panchayat Raj (Amendment) mencement Act, 2003. {ii) II shall be deemed to have come into on 30th December, 2002. Amendment of 2. ln Sub-section (2) of SecHon i1 of the Section-1'1 Arunachal Ptadesh Panchayat Raj Act, 1997 (hereinafter, referred to as the Prlncipat Ac!), the words 'on non party basis' shaU be omitted. 159 3, For sub-section (4) of Section 104 of Iha Amendrnentof Principal Act, the ·following sub-sectlon shall be secnon-104 substitute<i, name1y : "The State Election Commissioner shall, in .;onsultatlon with the State Government. appoint an officer of the State Government to be the District Election Officer and Sub·Divisionai Election Officer to. Co-ordinate and Supervise work in the District and Sub-Division in connection wilh the oonduct of election under its superintendence and control". 4. (i) The Arunachal Pradesh Panchayat Raj Repeal and (Amendment} Ordinance No. 3 of 2002 is , hereby Saving, repeaJed. (ii) Not withstanding such repeal, anything done or any action taken under the Principal Act, as amended by the said Ordinance, shall be deemed to have been dooo or taken under the Principal Act , as amended by this Act.
