European Communities (Marketing of Compound Feedingstuffs) (Amendment) Regulations 2001 (S.I. 171 of 2001)

S.I. No. 171 of 2001. European Communities (Marketing of Compound Feedingstuffs) (Amendment) Regulations, 2001 I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purposes of giving effect to Council Directive 2000/16/EC of the 10 April 2000131, and for the purposes of giving further effect to Council Directive No. 79/373 of 2 April 197921 as amended, hereby make the following Regulations: 1. (1) These Regulations may be cited as the European Communities (Marketing of Compound Feedingstuffs) (Amendment) Regulations, 2001. (2) The European Communities (Marketing of Compound Feedingstuffs) Regulations, 1999 to 2000 and these Regulations may be cited collectively as the European Communities (Marketing of Compound Feedingstuffs) Regulations. 1999 to 2001. (3) These Regulations shall come into operation on 1 May, 2001. 2. In these Regulations "the Directive" means Council Directive 79/373/EEC of 2 April, 197931. The European Communities (Marketing of Compound Feedingstuffs) Regulations. 1999, are hereby amended by: (a) the amendment of Regulation 2 (1) as follows: the deletion of the definition "place on the market" and the insertion of the following definition Irish Statute Book 1922-2001. "putting into circulation" or "circulation" m eans the holding of com pound feedingstuffs for the purposes of sale, including offering for sale, or any other form of transfer w hether free or not, to third parties, and the sale and other form s of transfer them selves; (b) the replacem ent of the term "place on the m arket" throughout the R egulation by the term "putting into circulation"; (c) the am endm ent of R egulation 6(1) (k) as follow s: the m inim um storage life to be indicated in accordance w ith A rticle 5d of the D irective of 1979 (inserted by A rticle 1 (5) of C ouncil D irective 90/44/E C of 22 January 1990 3411 and am ended by A rticle 1 (3) of C ouncil D irective 2000/16/E C of 10 A pril 2000 3531); (d) the am endm ent of R egulation 6 (1) (m ) as follow s: w here appropriate, the approval num ber issued by the M inister in respect of the approved establishm ent or interm ediary (w ithin the m eaning of the E uropean C om m unities (A pproval and R egistration of E stablishm ents and Interm ediaries operating in the A nim al Feed Sector) R egulations, 1999 (S.I. N o. 88 of 1999)), concerned, or w here appropriate, the registration num ber allocated to the establishm ent by the M inister in respect of an establishm ent or interm ediary (w ithin the m eaning of the E uropean C om m unities (A pproval and R egistration of E stablishm ents and Interm ediaries operating in the A nim al Feed Sector) R egulations, 1999 (S.I. N o. 88 of 1999)), concerned; (e) the am endm ent of R egulation 8 (1) as follow s: 8(1) A declaration referred to in R egulation 6 (1) (f) or R egulation 7 (1) (g) or a record under R egulation 11 shall specify all the feed m aterials of w hich the com pound feedingstuff concerned consists and shall (a) in the case of a com pound feedingstuff intended for anim als other than pets list those feed m aterials in descending order according to their respective w eights, or (b) in the case of com pound feedingstuff intended for pets (i) specify the w eight of each feed m aterial, or (ii) list those feed m aterials in descending order according to their respective w eight.
