S.I. No. 79 of 1996. ENVIRONMENTAL PROTECTION AGENCY (LICENSING) (AMENDMENT) REGULATIONS, 1996. The Minister for the Environment, in exercise of the powers conferred on him by sections 6 of the Environmental Protection Agency Act, 1992 (No. 7 of 1992), and by section 3 of that Act as amended by the European Communities (Environmental Impact Assessment) (Amendment) Regulations, 1994, hereby makes the following Regulations: Citation. 1. These Regulations may be cited as the Environmental Protection Agency (Licensing) (Amendment) Regulations, 1996. Commencement. 2. These Regulations shall come into operation on the 3rd day of September, 1996. Commencement of further licensing activities. 3. Article 4 of the Environmental Protection Agency (Licensing) Regulations, 1994, as amended by article 3 of the Environmental Protection Agency (Licensing) (Amendment) Regulations, 1995, is hereby amended by the insertion after sub-article (3) thereof of the following: "(4) The 3rd day of September, 1996 shall be the prescribed day for the purposes of section 82 (1) of the Act in respect of the classes of activity specified in paragraphs 6 and 9 of the First Schedule to the Act. (4) The 3rd day of September, 1996 shall be the "relevant day" for the purposes of the definition of "established activity" in section 3 of the Act in respect of the classes of activity specified in paragraphs 6 and 9 of the First Schedule to the Act.". These Regulations amend the Environmental Protection Agency (Licensing) Regulations, 1994, (S.I. No. 85 of 1994), as previously amended by the Environmental Protection Agency (Licensing) (Amendment) Regulations, 1995, (S.I. No. 59 of 1995), for the purpose of prescribing the day on or after which specified classes of activity in the First Schedule to the Environmental Protection Agency Act, 1992 will require an integrated pollution control licence in accordance with section 82 (1) of the Act. The Regulations also specify the "relevant day" for the purposes of "established activity" in section 3 of the 1992 Act in respect of specified classes of activity in the First Schedule to the Act.
