MINISTERIAL REGULATION OF MARINE AFFAIRS AND FISHERIES REPUBLIC OF INDONESIA NUMBER 33/PERMEN-KP/2016 CONCERNING ORGANIZATION AND WORK PROCEDURES OF TECHNICAL EXECUTIVE UNIT OF SUPERVISION OF MARINE AND FISHERIES RESOURCES BY THE GRACE OF THE ALMIGHTY GOD THE MINISTER OF MARINE AFFAIRS AND FISHERIES, Considering : a. that in the context of the optimization of duties and functions of supervision of marine and fisheries resources, it is necessary to arrange the organization and work procedures of technical executive unit of supervision of marine and fisheries resources; b. that based on the consideration as referred in item a, it is necessary to establish The Ministerial Regulation of Marine Affairs and Fisheries concerning Organization and Work Procedures of Technical Executive Unit of Marine and Fisheries Resources; In view of : 1. Ministerial Regulation of Marine Affairs and Fisheries Number 23/PERMEN-KP/2015 concerning Organization and Work Procedures of the Ministry of Marine Affairs and Fisheries (Official Gazette of the Republic of Indonesia Number 2015 Number 1227); 11. Ministerial Regulation of Marine Affairs and Fisheries Number 25/PERMEN-KP/2016 concerning Classification Criteria of Technical Executive Unit in Supervision of Marine and Fisheries Resources (Official Gazette of the Republic of Indonesia Year 206 Number 1165); DECIDE: To stipulate : MINISTERIAL REGULATION OF MARINE AFFAIRS AND FISHERIES CONCERNING ORGANIZATION AND WORK PROCEDURES OF TECHNICAL EXECUTIVE UNIT OF SUPERVISION OF MARINE AND FISHRIES RESOURCES. CHAPTER I POSITIONS, DUTIES, FUNCTIONS, AND CLASSIFICATIONS Article 1 (1) Technical Executive Unit of Supervision of Marine and Fisheries Resources, hereinafter called UPT PSDKP, is the Technical Executive Unit in marine and fisheries sector that under and responsible to the Director General of Supervision of Marine and Fisheries Resources. 4 (2) UPT PSDKP is respectively led by the Head of the Unit. Article 2 UPT PSDKP has the duty to supervise marine and fisheries resources based on the provisions of legislation. Article 3 In implementing the duties as referred in Article 2, UPT PSDKP organizes the following functions: a. arrangement of plans, program and budgeting, monitoring and evaluation, and reporting; b. operational supervision of utilization of marine and fisheries resources; c. guidance to community supervision groups (POKMASWAS); d. logistics preparation and Fishery Patrol Ship maintenance; e. violation handling of utilization of marine and fisheries resources; f. management of supervision infrastructure and facilities; and g. implementation of administrative and household affairs. Article 4 UPT PSDKP as referred in Article 2 are classified into: a. The Base of Supervision of Marine and Fisheries Resources, hereinafter called PSDKP Base; b. The Station of Supervision of Marine and Fisheries Resources, hereinafter called PSDKP Station. 5 Article 5 Classification of UPT PSDKP as referred in Article 4 are based on workload analysis. CHAPTER II ORGANIZATIONAL STRUCTURES Section One PSDKP Base Article 6 (1) PSDKP Base, are consists of: a. Division of Infrastructure and Facilities; b. Division of Operational Supervision and Violation Handling; c. Sub-division of Administration; and d. Association of Functional Positions. (2) Organizational of PSDKP base as specified in Appendix I is an integral part of this Ministerial Regulation. Article 7 (1) Infrastructure and Facilities Division as referred in Article 6 paragraph (1) item a has the duty to implement logistics preparation and Fishery Patrol Ship maintenance as well as the supervision management of infrastructure and facilities. (2) Operational Division of Supervision and Violation Handling as referred in Article 6 paragraph (1) item b has the duty to implement operational supervision, POKMASWAS guidance, as well as violation handling of utilization of marine and fisheries resources. 6 (3) Sub-section of Administration as referred in Article 6 paragraph (1) item c has the duty to prepare materials for program planning, budgeting, documentations, public relations, management of financial administration affairs, state property, staffing, correspondence, archives, equipment, and households. Section Two PSDKP Station Article 8 (1) PSDKP Station, are consists of: a. Subdivision of Infrastructure and Facilities; b. Subdivision Operational Supervision and Violation Handling; c. Administration Affairs; and d. Association of Functional Positions. (2) Organizational Structures of PSDKP Station as specified in Appendix II is an integral part of this Ministerial Regulation. Article 9 (1) Subdivision of Infrastructure and Facilities as referred in Article 8 paragraph (1) item a has the duty to implement logistics preparation, and Fishery Patrol Ship maintenance, as well as the supervision management of infrastructure and facilities. (2) Subdivision of Operational Supervision and Violation Handling as referred in Article 8 paragraph (1) item b has the duty to implement operational supervision, POKMASWAS guidance, as well as the violation handling of utilization of marine and fisheries resources. (3) Administration Affairs as referred in Article 8 paragraph (1) item c has the duty to prepare materials for program planning, budgeting, documentation, public relations, 7 Management of financial administration affairs, state property, staffing, correspondence, archives, equipment, and households. CHAPTER III ASSOCIATION OF FUNCTIONAL POSITIONS Article 10 Association of Functional Positions as referred in Article 6 paragraph (1) item d and Article 8 paragraph (1) item d has the duty to carry out functional activities in accordance with the provisions of legislation. Article 11 (1) Association of Functional Positions as referred in Article 10 are consists of Fisheries Supervisor Functional Positions in the provision arrangement of legislation sector and other functional positions according to the provisions of legislation. (2) the Association of Functional Positions is respectively Coordinated by the functional officer determined by the Chief. (3) Number of functional officers as referred in paragraph (1) determined on the basis of requirements and workload. (4) Types and levels of the Association of Functional Positions as referred in paragraph (1) is regulated in accordance with the provisions of legislation. 8 CHAPTER IV WORK PROCEDURES Article 12 In implementing the duties and functions, UPT PSDKP have to develop a business map process that describes the effective and efficient work relationship between organizational units within the UPT PSDKP. Article 13 The Chief submits the report to the Director General of Supervision of Marine and Fisheries Resources regarding to the implementation results of supervision of marine and fisheries resources regularly or at any time as required. Article 14 UPT PSDKP have to develop position analysis, position map, work descriptions, and workload analysis of all UPT PSDKP positions. Article 15 In implementing the duties, every elements within UPT PSDKP have to apply the principles of coordination, integration, and synchronization either within UPT PSDKP or in relations between government agencies both in central or regional. Article16 Every leader of organizational unit have to apply the control system of internal government within the respective environment in order to realize public accountability mechanisms through the arrangement of planning, implementation, and integrated performance reports. 9 Article 17 Every leader of organizational unit is responsible for leading and coordinating subordinates and providing directions and instructions for the implementation of subordinate duties. Article 18 Every leader of organizational unit have to monitor the implementation of their respective subordinate duties and in the event of deviation, it is necessary to take the required procedures according to the provisions of legislation. Article 19 Every leader of organizational unit have to follow and conform the instructions and also responsible to the respective superiors and to submit the performance reports regularly on time. Article 20 In implementing the duties, every leader of organizational unit have to conduct guidance and supervision against the organization below. CHAPTER V ECHELONIZATION Article 21 (1) Head of PSDKP Base is a structural echelon III.a. or Administrator Position. (2) Head of PSDKP Station, Division Head, and Subdivision Head is the structural echelon IV.a. or Supervisor Position. (3) Head of Affairs and Subdivision Head is the structural echelon V.a. or Executive Position. 10 CHAPTER VI SUPERVISORY UNIT, LOCATION, AND WORKING AREA Article 22 (1) In the environment of UPT PSDKP, Supervisory Unit can be established which is a non-structural organizational unit in supervision sector of marine and fisheries resources in accordance with the requirements and based on workload analysis. (2) Supervisory Unit is led by the Coordinator. Article 23 Locations and Working Area of supervision of marine and fisheries resources is the operational location and working territories of supervision in respective UPT PSDKP. Article 24 Location, Working Area, and Supervisory Unit of UPT PSDKP as referred in Article 22 and Article 23 as specified in Appendix III is an integral part of this Ministerial Regulation. CHAPTER VII MISCELANNEOUS PROVISIONS Article 25 Amendment of organizational structures and work procedures based on the Ministerial regulation is legalized by the Minister of Marine Affairs and Fisheries after obtaining the written approval from the minister who organizes government affairs in state administrative reform sector. 11 CHAPTER VIII TRANSITIONAL PROVISIONS Article 26 In the event of this Ministerial Regulation comes into force, every provisions of the implementation from the Minister of Marine Affairs and Fisheries Number PER.04/MEN/2006 concerning Organization and Work Procedure of Technical Executive Unit in Supervision Sector of Marine and Fisheries Resources, remain valid as it is not contradictory and have not been modified and/or replaced by a new regulation based on this Ministerial Regulation. Article 27 In the event of this Ministerial Regulation comes into force, every positions and current officers within the Technical Executive Unit in Supervision Sector of Marine and Fisheries Resources on the basis of Ministerial Regulation of Marine Affairs and Fisheries Number PER.04/MEN/2006 concerning Organization and Work Procedures of Technical Executive Unit in Supervision Sector of Marine and Fisheries Resources, remain to carry out the duties and functions until the establishment of new positions and the appointment of new officers based on this Ministerial Regulation. CHAPTER IX CLOSING PROVISIONS Article 28 In the event of this Ministerial Regulation comes into force, Ministerial Regulation of Marine Affairs and Fisheries Number PER.04/MEN/2006 concerning Organization and Work Procedures of Technical Executive Unit in Supervision Sector of Marine and Fisheries Resources, revoked and declared invalid. 12 Article 29 This Ministerial Regulation comes into force as from the date of promulgation.
