DECIDES: Tostipulate: REGULATION OFTHE MINISTER OFFORESTRY CDNCERN INGESTABllSHMENTOFFORESTMANAGEMENTREGlONAL UNIT. 0W'fER1 GENERAL PROVISION Part One ArtICle 1 Whatismeant in this Regulation by: 1. Forest shall be ecosystem unit fA spread out of land containing biological natural resources dominated by treesassociated with natureand its environmentwhich is inseparable from eachother. Business News7877/10-30-2009 2. Forest zone shall be CIeI1:ain region which existence is designated and/or determinedby the Govemment to be preserved as permanent forest. 3. River Row Area shaH be any land are which consti tutes a unitof river and its brooks bordering thetopo graphicdivision by the back of a hUi or mountain func tioning to accommodate water originatingfrom rain and other water SOUI'O!S, naturallydepositingand now it to the land or sea. 4. Forest Management Unit hen!inafter referred to as KPH shal be forest management area aa:nrding to the main function and its allocation that may be managed effi dentIy andcontinuously. 5. Preserved Forest Management Unit shall be forest management unit which entire area is dominated by preserved forest zone. 6. Protected Forest Management Unit shaH be forest management unit which entire area is dominated by protected forest zone. 7. Producing Forest Management Unit shall be forest management unit which entire area is dominated by prodUcing forestzone. 8. Plan and develop KPH shall be KPH area plancontain ing result of initial identificationanddelineation ofan area to be established wbe KPH area on the mapand Its description. 9. Director. for KPH reservation shall be mrtificate and direction map for KPH~ that COIl5tiI:utes the result of review of KPH ptanand deYeIopbased onthe stipulated criteria. 10. Any proposed KPH shall be determined based on the result of establishment of KPH by the Gover nor that constitutes the result of review of the plan and develop based on the direction on KPH reser vation. 11, AllY., .•• 11. KPH Model shall be theinitial phenomenond KPH which isdeveloped in phases based on the actuat situation andoondition of KPH Organization at site level. 13. Minister shall be ministerresponsible in Forestry. Part TWO Purposes andObjectives Artide 2 The purposed governing the establishmenteX KPH area is to provide guideline for establishmentd forestman agement unit. ArtJde3 Theobjective ofgovering the establishmentd KPH area is to accomplish forest management unit that can support implementation of efficient andoontinuousforest management. CHAPTERD ESTABUSHMENf OFKPH AREA PartOne General Artide4 (1) KPH shall cover: a. Preserved KPH K(KPHK) b. Protected KPH(KPHl) c. Producing KPH (KPHP) (2) KPH shell be determined in one or more forest main function andinoneadminist:ratNe area orgovernment administrative cross area. (3) If KPH consists of more than one forest main func tions, determination of KPH shall be based onthe main function of the forestwhich area Is dominant. Business News 7877/10-30-2009 12A Part Two Criteria andIndiCator ArtideS (1) Establishment of KPHarea shall takethefollowing into consideration: a. characteristic of the land; b. type afforest; c. Fungsl hutan; d.condition of river flow area; e. socialconditlon, culture, economy of the people; f. local community institution including communit:y of customary law; g. Hmitd governmentadministration; h. geographically the spread of landisoneunit; i. natural border orartificial border is permanent; and j. oontrol of land. (2) Based on the consideration referred to in paragraph (1), criteria of establishment of KPH area shall be as follow: a. assurance on manageable area; b. feasibility ofecology; c. feasibility on forest management institution;and d. feasibilityon developmentof forest utilization. Artide6 (1) Assural'1CE indicator ofare under management referred to in Artide 5 paragraph (2) letter a, shall be asfol lows: a. existing in pennanent forest zone aftershowing or border layout or determination phases of forest zone; b. has clear and relatively pennanentsite, area and border; and c. each unitareafor utili18tion anduse of forest zone must be registered in the KPH area; d. the .. d. the border of KPH~ mustcompty with the bor der made by nature. (2) Indicatorof ecology feasibility referred to in Article 5 paragraph (2) letter b, consists of: a. the position andJocation of theKPH area shaD con sider its justification with the River Flow Area or River Sub-Flow Areaor DAS or SubDAS; b. ronsider the homogeneity, geomorphology and type of forest; and c. the nature of the area is ideal seen from ecological aspect, such asit is morea>mpad: arearatherthan fragmented andround shape ratherthan streching alongthelength; (3) Feasibility indicator of institutional developmentof for est management referredto in Article5 paragraph (2) letter c, consists of: a. thearea of KPH shallbe optimum within the stretch borderundercontrol; b. the area of KPH shall consider the management intensity seen from production aspect; and c. shall consider theentirety of the limit of forestuti lization and useof forest zone, and other existing forestmanagement institution. (4) Feasibility indicatorof forest utilizationdevelopment referred to in Article5 paragraph d, consists of: a. consideration ofany possibility to utilize the poten tial forest resource; b. iscompactareaor low level fragmented area;and c. hassatisfactory levelof accessabnity. (3) In existence of conservation zonewithin the planand develop KPHL and KPHP areas, the DirectorGeneral of Forestry Planology shall asktechnical consideration from the DirectorGeneral of FOrest Protectionand Natural Conservation. {4} In existence of producing forest zone and protected forest within the planand develop KPHK area, the Di rector General of ForestryPlanology shall ask techni calconsideration from the Governor. (5) Compilation of directive for KPH reservation shalluse the criteria referred to in Article 5 paragraph (2). (6) Directivefor KPH reservationthat hasbeen compiled as referred to in paragraph (2) for KPHL and KPHP shallbe submittedto the Governor. (7) The directivefor KPHK reservationshall be submitted to the Ministerasthe basis for determinationof KPHK area. PartThree Proposed Determination Article 12 (1) TheGovernor shallassign the Service OffICe in charge of Forestrymatters in the provinceto review and im provethe planand developKPHL and KPHP based on the directive for reservation referred to in Article 11 paragraph (4). (2) The re-improved planand developof KPHL and KPHP referred to in paragraph (1) shall be made by review with the relevant agency in the Area that obtained Business News 7877/10-30-2009 15A supportingdatal and Int'ormation from the ForestZone Stabilization Publk: Half. (3) Based on the result of improvement referred to in paragraph (1), the Governor shall submit proposal on determinationof KPHL and KPHP areas to the Min ister. (4) Theproposed determinationof KPHL and KPHP by the Governor referred to in paragraph (3) shallbe submit ted to the Ministerwithin six(6) monthsasofthe Issue ofdirectiVe (or KPHL and KPHP reservatlon. Part Four Detennination of KPH Area Article 13 (l) Based on the proposed determination of KPHL and KPHP areas referred to in Article 12 paragraph (3) and the directive for KPHK reservation referred to in Article 11paragraph (5), the Ministershallassign the DirectorGeneral of Forestry PlanoJogy to compile draft of Decision of the Minister and prepare map for de termination of KPH area by review with the relevant Echelon I. (2) The Director General of Forestry Planology shallsub mit the draft to the Ministerfor review from yuridical aspect andfurther submitthe draftdecision to the Min ister for stipulation. (3) If within the time limit referred to in Article 12para graph (4) the Governorfails to propose determination for KPHL and KPHP, the MinistreshalldetermineKPHL and KPHP areasbasedon the directivefor KPHL and KPHPareas. (4) In the preparation far accomplished KPHarea the Minister may determine area for KPH Model that constitutes either part of the KPH area in the Prov ince. CHAPTERlV ..•.• O1APTERIV TRANSTIlONAL. PROVISION Article 14 (1) Any provinre receiving directive for reservatiOn d KPHl andKPHP priorto stipulation of thisRegulation atthe Minister within six (6) months as of its issue the Minis· ter shall submit the proposeddetennination referred to inArticle 12 paragraph 3.
