KHVM Decree on the calculation of the water resource contribution Based on the provisions of Sections 66 and 67 of Act XC of 1998 on the Budget of the Republic of Hungary for 1999 (hereinafter: the Budget Act) and Sections 18 - 21 of Annex 10 to the Budget Act - taking into account the authorization granted in Section 120, Paragraph (7), Points c) and d) of Act LXXXIII of 1992 on Certain Separated State Funds - I hereby order the following: Section 1 ( 1 ) [1] Water users and industrial consumers who are (or are) obliged to pay the water resource contribution (hereinafter referred to as VKJ) prescribed by Act LVII of 1995 on Water Management (hereinafter referred to as: Vgtv.) shall determine the amount of their payment obligation based on water use and the basic contribution by taking into account the multipliers specified in Annex 1 to this Decree . ( 2 ) The definitions of the terms necessary for the application of multipliers are contained in Annex 2 to this Decree . Section 2 [2] Section 3 [3] Section 4 [4] When calculating the VKJ payment obligation, taking into account the water use purpose stated in the establishment permit and the "g" multiplier corresponding to the water resource planned to be used, as well as the "t" multiplier relating to the overloading of the water body, 50% of the water quantity reserved in the water right establishment permit - indicated as water demand in the permit - shall be considered as water demand. Section 5 ( 1 ) In the case of the water quantity serving as the basis for the VKJ calculation, the following shall be taken into account in terms of measurement: a ) [5] the water quantity shall be determined by means of a continuously measuring certified water meter per water abstraction facility or a well water meter calibrated by an accredited calibration laboratory no more than 5 years ago, or in the case of surface waters, by means of a calibrated water level meter or a calibrated water flow meter; several water procurement facilities may only be measured together if the nature of the water resource and the water quality category are the same; b ) [6] in the case of underground water use, the water meter and the well water meter must always be placed at the wellhead, and in exceptional cases - if this is technically impossible (in the case of siphon water extraction or thermal water use) - in front of the distribution pipe; c ) at a hydroelectric power plant, the water quantity shall be determined based on the water absorption and the operating time according to the arithmetic mean of the water heights corresponding to the highest and lowest operating water levels; d ) in the case of surface water use, where the irrigation water service is based on a contract with a water service provider and the water withdrawal is metered by the service provider, the water volume accounted for by the service provider shall be taken as the basis for determining the water user's actual water consumption and this water volume shall be considered metered; e ) [7] the readings of the water meter, well water meter and water flow meter must be read monthly on the first working day of the month, and the readings of the water level meter must be read every working day, and the readings must be documented in a measurement log kept on site; f ) [8] if the measuring device fails and the water user does not ensure the measurement according to point a) within 30 - 90 - days in the case of small consumers and periodic water users, the given settlement period shall be considered unmetered and the water quantity measured in the same period of the previous calendar year, or failing that, the water quantity shall be determined by the calculation according to paragraph (2); g ) in the case described in Section 2 of the regulation when calculating the VKJ,the water quantity determined by the water authority shall be deemed to be the measured water quantity. h ) [9] the operator or manager of the water facility shall ensure the use, proper operation and maintenance of the measuring device detailed in point a) and the recording of the measured data. i ) [10] in the case of water use for irrigation, rice production and fish farming, the amount of water determined in the manner specified in the Ministerial Decree on the technical rules for activities and facilities for the utilization, protection and prevention of water damage shall be deemed to be measured. ( 1a ) [11] The water user shall notify the territorially competent water authority of any malfunction or replacement of the measuring devices within eight days. The notification shall include credible evidence that the installed measuring device complies with the provisions of paragraph (1) a). Failure by the licensee to do so shall constitute operation contrary to the water law permit. ( 2 ) In the case of the water volume serving as the basis for the VKJ calculation, in the absence of a water volume meter, the following must be taken into account when calculating the water volume: 16/03/26, 20:23 43/1999. If such documents are not available or the inspection has established that they are not kept continuously, the volume of water shall be determined on the basis of the operating hours and nominal capacity of the water extraction facility; b ) [12] in the case of the water volume calculation performed according to point a), the multiplier (m=2) valid for the calculated water use shall be applied when calculating the VKJ. ( 3 ) [13] The multiplier referred to in paragraph (2)(b) shall not apply where surface water abstraction occurs after more than one calibrated measuring device. 6 . § [14] ( 1 ) In view of the provisions of Section 15. (7) and Section 15/C. (1a) of the Vgtv. and that the obligation to pay the water resource contribution may not hinder the financing of preventive or restorative measures taken in order to achieve the environmental objectives relating to the good status of waters pursuant to the Government Decree on certain rules of river basin management, the calculation of the water resource contribution a ) the water resource character specified in Annex 1 with regard to geographical characteristics b ) the class or category classifications specified in Annex 1 with regard to environmental impact c ) the coefficient "g" assigned to the type of water use specified in Annex 1 with regard to economic and social impacts must be taken into account. ( 2 ) [15] ( 3 ) [16] ( 4 ) [17] 6/A . § [18] If the water user has several water procurement facilities, the quantity specified in Section 15/C. (1) point l) of the Vgtv. shall be taken into account first for the water procurement facility with the lowest "g" multiplier, in order, until the water user exhausts the exemption. § 7 [19] In the blank fields of the table containing the multiplier "g" in point 1. e) of Annex 1 - taking into account the concepts defined in Annex 2 - the multiplier "g" for other water uses for economic purposes shall be applied. Section 8 [20] Section 8/A [21] The multiplier "t" specified in Annex 1, point 1, sub-point db) shall not be appliedin the case of developments for water saving purposes proven by technical parameters, for a period of 3 years from the date of entry into force of the amendment to the relevant water law operating permit. Section 9 ( 1 ) If the water user transfers part of the water produced (withdrawn) by him to another user - with the permission of the water authority - the VKJ shall be paid by the transferor, taking into account the nature of the recipient's water use. ( 2 ) [22] The provisions of the water right connection specified in Section 20 (2) of the Water Resources Act and separate legislation shall apply to the transfer and receipt of the permitted water quantity pursuant to paragraph (1), with the proviso that the transferor may fully transfer the amount of the VKJ paid for the transferred water - unless the parties have agreed otherwise - to the transferee or may demand reimbursement of the amount of the contribution. 9/A . § [23] Water users for irrigation, fish farming and rice production purposes do not have to pay a basic contribution up to the amount specified in Section 15/C. (1) paragraph l) of the Water Resources Act , even if a ) if the actual water use exceeded the water quantity specified in the water right permit, or b ) if the amount of water specified in the water rights permit has not been used. 9/B . § [24] If the water user for irrigation, fish farming and rice production purposesextracts water pursuant toand n) of paragraph (1) of Section 15/C. Vgtv. , the quantity of water thus extracted shall not be taken into account when determining the rate specified in point l) of paragraph (1) of Section 15/C. Vgtv. Section 10 ( 1 ) [25] The water user must pay the VKJ related to the water volume contracted in the water right establishment and operation permit by the 15th day of the first month following the relevant year. ( 2 ) [26] The calculated VKJ, late payment surcharge, tax penalty and default penalty must be paid into a centralized collection account managed by the water authority competent for the place where the payment obligation arises and kept at the Hungarian State Treasury. ( 3 ) [27] Section 11 ( 1 ) This decree shall enter into force on the 5th day following its promulgation. Sections ,,, 9/A. and 9/B. Sections , and Annexes 1 and 2 of this Decree ,established by Decree 34/2016. (VIII. 2.) BM on the amendment of certain ministerial decrees on water management, shall be applied for the first time when fulfilling the obligation to pay the water resource contribution for the year 2017, making declarations and providing data. Section 11/B [31] This regulationserves to comply with Article 9 of Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy. The rule for calculating VKJ is: VKJ = "V" (m3) X "A" (Ft/m3) X "m" X "t" X "g". a) "V" is the volume of water planned or used by the water user. b) The amount of the "A" basic contribution is determined by the Vgtv. c) The value of the multiplier "m" modifying the basic contribution depending on the volume of water use: ca) in case of metered water use: 1.0, cb) in the case of calculated water use: 2.0. d) The water body overload factor "t" is the coefficient for the status classification of water bodies in the river basin management plan, the value of which is: da) in the case of surface water abstraction, in the case of water bodies with a status or potential of good or higher, and in the case of water bodies with a status or potential of worse than good - but not attributable to quantitative reasons - and their catchment area, in the case of groundwater abstraction, in the case of water bodies with a quantitatively good status: 1.0. db) in the case of surface water abstraction, in the case of a catchment area of surface water bodies with a status or potential that is worse than good due to quantitative reasons, in the case of groundwater abstraction, in the case of a quantitatively poor status and a "good but weak risk" classification - with the exception of subparagraph dc) -: 1.2. dc) in the case of groundwater abstraction in the case of water uses from a bank-filtered water resource with a quantitatively poor status and a "good but low risk" classification: 1.0. e) The basic contribution is modified by the multiplier "g" depending on the nature of the water use and the water resource. Category IV: The water quality at the water abstraction point exceeds the following threshold value in terms of one or more parameters , taking into account the environmental quality limit values for priority substances and certain other pollutants as set out in Annex 1 to Decree 10/2010 (VIII. 18.) of the Minister of the Interior on water pollution limit values for surface water and the rules for their application (hereinafter: Decree 10/2010) : 3.4.1. if Decree 10/2010 of the Minister of Agriculture contains both a maximum permissible concentration and an annual average value for inland surface waters, then the amount of the pollutant exceeds the value of the difference between the maximum and the annual average value increased by half; 3.4.2. if Decree 10/2010 of the Ministry of the Interior only contains a maximum permissible concentration for inland surface waters, then a value exceeding 50% thereof; 3.4.3. if Decree 10/2010 of the Ministry of the Interior only contains an annual average value for inland surface waters, then twice the average value.
