Jo amend the Land Planning and Soil Conservation Ordinance. · [31st December. 1957.] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the National Assembly of Ghana in this present Parliament assembled, and by the authority of the same as follows: Date of commence• ment. 1. (1) This Act may be cited as the Land Planning and Soil Shoz:t title Conservation (Amendment) Act, 1957, and shall be read as one =~n;~er with the Land Planning and Soil Conservation Ordinance, 1953, ~~- 3]~~ hereinafter referred to as the Ordinance. 1953. (:!) The Interpretation Ordinance shall apply to the interpre- Cap. 1. tation of this Act as it applies for the interpretation of an Ordinance. 2. The long title of the Ordinance is hereby amended by deleting Amendment all words and punctuation after the word " provide" and substi- 0 g~og 3 1t~ tu ting therefor the following words:- f 95/· " for the better utilization of land in designated areas by land planning :rnd soil conservation and for the establishment of committees for purposes incidental thereto. " 3. Rrplace ment of sec tipn 4 (2) (b) of No. 32 of 19.53. Amendment of s<'ction 7 (I) of No. 32 of 1953. Addition of new sections 7A a.nd 7B. 4. Section ,1 of the Ordinance is amended by substituting for paragraph (b) of the subsection (2) the following paragraph: " (b) prescribe the representation and quorum necessary for the conduct of business at any meeting of the planning committee; " 5. Subsection ( l) of section 7 of the On.linance is hereby amended (a) by the deletion of the word " and " following the word "land" in paragraph (d), an(! by the substitution of a semi-colon fur the full stop after thl'. word '· land " in paragraph (e) and the adc\itii.:m thereafter of the ,vord ,, ,, or (b) by the addition of the follo,ving new paragraph: " (j) the utilization of land or water to promote or increase food production. " 6. The Ordinance is hereby amended by the addition immediately following section 7 of new sections 7 A and 7B as follows .. Com- 7 A. A Committee may for the purposes of this ;~:~t~Y Ordinance within its planning area promote any other land alteration or improvement in the use of land by use. proper methods of land cultivation and soil conserva tion. Additional 7B. (1) Where a committee is -C\f C inion that ~~=~~!es. land within its planning area (a) is for purposes of agriculture or animal husbandry exhausted or inadequate for nie occupants; or (b) may be used for other or more suitable purposes, the committee may recommend the transfer of any farmer occupying the land to any planning area within the designated area or to any other land within the planning area. (2) If the ::\Iinister approves, any farmer may, where he consents, be so transferred with any movable property belonging to him and be re-settled as a farmer within the designated area on any land made available for the purpose: Provided that the actual cost of any such transfer and re-settlement may where certified as rC'asonable by the planning committee recommending the trans fer be paid out of the Consolidated Fund. (:l) The approval of the :\Iinistcr shall be in writing under his hand and may be given generally or as a special case. (,1) For the purposes of this section, " farmer " means a person whose sole or principal occupation is the utilization of land for agriculture or animal husbandry and includes a farm worker and the dependents· of a farmer.
