(1) If within fishery limits there is a contravention of an enforceable Community restriction relating to sea fishing, the master, owner and charterer of any relevant fishing boat aze each guilty of an offence and liable on summary conviction or on conviction on indictment to a penalty not exceeding the penalty (if any) for the time being stipulated by order of the Ministers under section 30(2) of the Fisheries Act 1981(b) in respect of contraventions of that restriction tried summarily or (as the case may be) on indictment. (a) Order in Council No.XXVII1 of 1989; and No.IV of 1992. (b) An Act of Parliament (1981 c.29). ( 2 ) Where no penalty is so stipulated, section 2 of the Fishing (Bailiwick of Guernsey) Law, 1989, as amended, shall apply in respect of the contravention. Interpretation. 2. (1) Expressions used in this Order shall have the meanings given by the said Law of 1989 . (2) The Interpretation (Guernsey) Law, 1948 (c ) shall apply to the interpretation of this Order throughout the Bailiwick. Citation. 3. This Order may be cited as the Fishing (Penalties) (Bailiwick of Guernsey) Order, 1992. Extent. 4 . This Order shall have effect throughout the ~ailiwick of Guernsey. Commencement. 5. This order, made for the purposes of the Fishing (Bailiwick of Guernsey) Law, 1989, as amended, prescribes the penalties which may be imposed in respect of contraventions of enforceable Community restrictions relating to sea fishing, and brings such penalties into line with those which may be imposed in Great Britain under the Fisheries Act 1981.
