(1) The Environmental Pollution (Waste Control and Disposal) (Fees) Regulations, 20 10' are amended as follows. a Ordinance No. XVIIl of 20 10. Order in Council No. XIII of 2004 as amended by Order in Council No. XIII of 201 0 and Ordinance No. XVIII of 201 0 and to which there are further amendments not relevant to these Regulations. C G.S.I. No. 46 of 201 0. (2) In the first column of Schedules 2 and 3, in the description of operation in Category 8, at the end add "other than an operation falling within Category 6, 7 or 10A". (3) In Schedule 2 (prescribed fee to accompany application in relation to prescribed operation other than a waste transport operation) (a) after the row relating to Category 10 of the Table add the following row (b) in the description of operation in Category 11, for " 1 to 10" substitute "5 to 10A". (4) In Schedule 3 (annual licence fee for prescribed operations other than waste transport operations) "Category 10A. An operation involving the disposal of waste wood, which has been sorted, by incineration in a boiler with a rated thermal output of not less than 0.4 megawatts and not more than 3 megawatts. (a) after the row relating to Category 10 of the Table add the following row £500 £500 I 1 £1,000 £500 (b) in the description of operation relating to category 11, for "1 to 11 " substitute "categories 5 to 10A". "Category 10A. An operation involving the disposal of waste wood, which has been sorted, by incineration in a boiler with a rated thermal output of not less than 0.4 megawatts and not more than 3 megawatts. Interpretation. 2. (1) In these Regulations, unless the context requires otherwise £500 II "enactment" means any Law, Ordinance or subordinate legislation, and "subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any enactment and having legislative effect. d (2) The Interpretation (Guernsey) Law, 1948 applies to the interpretation of these Regulations. (3) Any reference in these Regulations to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied. Citation and commencement. 3. These Regulations may be cited as the Environmental Pollution a Ordres en Conseil Vol. XIII, p. 355. Cameron Director of Environmental Health and Pollution Regulation EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Environmental Pollution (Waste Control and Disposal) (Fees) Regulations, 2010. They provide, by amendment to Schedules 2 and 3 to the Regulations, for a new category of fee for both applications in relation to licences and annual licence fees for certain operations involving incineration of sorted waste wood in a boiler. They also amend the description of waste operation in Category 8 of Schedules 2 and 3 to clarify the types of incineration operation intended to fall into Category 8 and make minor and consequential amendments to the description of waste operation in Category 11 of those Schedules. These Regulations come into force on the gth ~lune, 201 1.
