A PROCLAMATION TO AMEND THE WATER RESOUR CES DEVELOPMENT FUND ESTABLISHMENT AND ADMINISTRATION PROCLAMATION WHEREAS, it has become necessary to amend the Water Resources Development Fund Establishment and Its Administration Proclamation; NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows: 1. Short Title This Proclamation may be cited as the “Water Resources Development Fund Establishment and Administration (Amendment) Proclamation No. 581/2008”. 2. Amendment The Water Resources Development Fund Establishment and Its Administration Proclamation No. 268/2002 is hereby amended as follows: 1/ Sub-Article (7) of Article 2 of the Proclamation is repealed and amended by the following new Sub-Article(7): አףםአـףኛ ዓُא qÜ R #7 አዲስ አበֹו ግንቦُ 09 qN 2ְֱך ዓ.ו 14th Year No 37. ADDIS ABABA 27th May, 2008 4¹þ1)6 gA ØÁ‰L ነU¶T Uz¤È qÜ R #7 ግንቦُ 09 qN 2ሺህ ›.M Federal Negarit Gazeta No. .37 27th May, 2008…. page 4106 ጠጥ ውሃና ሳንא דـየከ ֳُד ’וּהـ‘ /7» וጅُ፣ እንዲሁץን አገָግֹُ ድֹּלَ የאስኖ የֱብֱד ףם ُנበץ ነው፣» 2/ ከአዋጁ አንׂשጽ 2 ንዑስ አንׂשጽ /8/ ׂשጥֹ የגከֳـው አዲስ ንዑስ አንׂשጽ /9/ ፣ָקוጨـ ዎ٤עበዳـከ ֳُד ’ፈንድ עዘዋዋـ‘ /9» በዳـֳ ግና ጽሕፈُ ቤًנደגየ ֹּלֶאـ ው ገንዘብנያበድגሶ የָא ዎ٤ע ነው፣» 3/ የአዋጁ አንׂשጽ 4 ንዑስ አንׂשጽ /3/ ץרـዞ በגከֳـው አዲስ ንዑስ አንׂשጽ /3/ ክָّ፣ــ «3/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ እና /2/ የـጠُשׂשን ዓֶדዎ٤ ዕውን ֲץא ስֳאስדግ ወጪን በנድדֳ ֶይ የـנטאـ የו¡נ ጊዜ ብድץ «፡፡ץበደד 4/ የአዋጁ አንׂשጽ 5 ንዑስ አንׂשጽ /3/ ץרـዞ በגከֳـው አዲስ ንዑስ አንׂשጽ /3/ ክָّ፣ــ «3/አበዳעዎ٤ና ֳጋֹּל ድץጅِ٤ ወֳድን በֳאגከُ የגያስוׂשጡُ ቅድא ሁኔٍ ከֳַ ቦץዱ የገንዘብና ኢኮ ኖג ُדָ גኒስَץ ከגወስነው ጣעያ ሳያָፍ በብድץ ֶይ የגከፈֳ ውን የወֳድ אጠን ይወስናָ፡፡» 5/ የአዋጁ አንׂשጽ 7 ንዑስ አንׂשጽ /2/ ץרـዞ በגከֳـው አዲስ ንዑስ አንׂשጽ /2/ ክָّ፣ــ «2/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ ከـደነገገው በـጨעד በዚֱ አዋጅ አንׂשጽ 04 /4/ ُנטא በቦץዱ የגፀድאא ּׁשዘኛዎـ ٤ፈፃג ይֲናִ፡፡ » 6/ የአዋጁ አንׂשጽ 01 ንዑስ አንׂשጽ /4/ እና አዲስ ንዑስ ִُـከגዘው በץרـ /5/ አንׂשጽ /4/ እና /5/ ــክـዋָ፣ «4/ ቦץዱ በגያፀድׂשው የብድץ አר ጣጥ אאዘኛ ُנטא በየዓًא የּשץׂשג የብድץ ጥያቄዎ٤ን በאገ ጽׂשጽ ንዑስ አንׂשበዚֱ አን וገו በውን ገንዘብרበרየ ُנטא /5/ « ጣָ፡፡רይ ץበብድ ዎ٤עበዳـֳ “7/ ‘Institution’ means urban water supply and sanitation service providers and irrigation cooperative association’; 2/ The following new Sub-Article (9) is added under Article 2 of the Proclamation: “9/ ‘Revolving Fund’ means the fund collected from borrowers and loaned to borrowers by the office”. 3/ Sub-Article (3) of Article 4 of the Proclamation is repealed and amended by the following new Sub-Article (3): “3/ To grant, for the realization of the objectives stated in Sub-Articles (1) and (2) of this Article, long term loans on the basis of the principle of cost recovery”. 4/ Sub-Article (3) of Article 5 of the Proclamation is repealed and amended by the following new Sub-Article(3) “3/ Unless there are certain preconditions laid down by creditors and donors, the Board shall determine the interest rate payable on loans and such rate shall not exceed the ceiling set by the Ministry of Finance and Economic Development, 5/ Sub-article (2) of Article 7 of the Proclamation is repealed and amended by the following new Sub-Article (2): “2/ In addition to the provisions of Sub Article (1) of this Article, the criterion approved by the Board pursuant to Article 14(4) of this Proclamation shall be applicable”. 6/ Sub-Articles (4) and (5) of Article 11 of the Proclamation are repealed and amended by the following new Sub-Articles (4) and (5): “4/ Grant loans out of the money collected pursuant to Sub-Article (5) of this Article upon evaluating the annually submitted requests on the basis of the criteria approved by the Board”. 4¹þ1)7 gA ØÁ‰L ነU¶T Uz¤È qÜ R #7 ግንቦُ 09 qN 2ሺህ ›.M Federal Negarit Gazeta No. .37 27th May, 2008…. page 4107 «5/ ֳፈንዱ אግֹُו የגገֹוውን የብድץ በዚֱ וና ወֳድ እንዲሁֹּלֶאـ አዋጅ አንׂשጽ 5 ከـጠו ُשׂשን ጮ٤ የגገኘውን רـብሳּת ገንዘብ ሁִ በወቅً ይרበስָֹו፣ በፈንዱ ሂሳብו ገּת በדድנግ በـዘዋዋע ፈንድ ይዞ ֳאـሳሳይ የብድץ አገָግֹُ ያውֳዋָ፡፡» 4. አዋጁ የגፀናበُ ጊዜ ይይֱֱ አአዋዋጅጅ በበፌፌዴዴָָףף ነነጋጋُُעע ጋጋዜዜጣጣ ٍٍُُזז ከከወወጣጣበበُُ ׂשׂשንን ጀጀצצוו የየፀፀናና ይይֲֲናናָָ፡፡፡፡ አአዲዲስስ አአበበֹוֹו ግግንንቦቦُُ 0099 ׂשׂשንን 22ְֱֱךְך ዓዓ..וו GR¥ wLdgþ×RgþS yxþT×eà ØÁ‰§êE ÄþäK‰sþÃêE ¶pBlþK PÊzþÄNT “5/ Make timely collection of repayment of loans and interests as well as all money to be collected from sources mentioned under Article 5 of this Proclamation and deposit the same in the account of the Fund as a revolving fund for similar purpose of lending service to borrowers”. 4. Effective Date This Proclamation shall enter into force up on the date of publication in the Federal Negarit Gazeta.
