Short Title In this Proclamation: Debub Negarit Gazeta — No. 4 17" July, 1997—Page 2 This Proclamation may be cited as ‘The Southern Nations, Nationalities and Peoples’ Rezional State Cooperative Office Establishment Proclamation No. 14 1997”. Definitions mm 3 I 1) “Regional State’? means the Southern Nations, Nationalities and Peoples’ Regional State; 2) “Executive Committee” means the Southern Nations, Nationalities and Peoples’ Regional State Executive Committee; 3) “Region” means the Southern Nations, Nationalities and Peoples’ Region. Establishment 1) The Southern Nations, Nationalities and Peoples’ Regional State Cooperative Office (hereinafter “the Office”) is hereby established as an autonomos governmental office. 2. The Office shall be accountable to the Executive Committee and the President of the Regional State. Organization of the Office The Office shall have: 1) aHead appointed by the Executive Committee upon presentation by. the President of the Regional State, 2) the necessary staff. Head office The Office shall have its head office in Awassa, and offices in all Zones, Special Woredas and Woredas of the Region. Objectives The Office shall have the following main objectives: 1) to make studies on the reorganization of cooperati societies such as agricultural, artisans, thrifts ane credit, housing, etc... which have previously bee organized by different offices of the Region; ganize, strengthen and promote these cooperati societies as well as those to be established in th future in accordance with international principles cooperatives; 2) to create suitable conditions for members ¢ cooperative societies to get the necessary input loan and market services, raw materials and othe similar support in order to increase production an productivity; 3) with respect to the market economic policy of t country, to encoruage cooperative societies to stre gthen and unify their labour, know-how, and finane to develop their economy and besides benefiti themselves in the long-run, to contribute to & country’s development; 4) to safeguard cooperative societies against inte ference as well as to protect them from mis propriation of their money and property, to he members develop a sense of ownership toward the cooperative societies; 1S

Ps ‘ ©. 4 The Cfficc shall have the following powers and Guus: 1) 2) 3) 4) 5) 6) 7) 8) 9) to intiate policies useful for the development of cooperative societies; prepare laws and regulations and submit same to the concerned body as well as implement them upon approval follow up the implementation of Federal and Regional! laws, regulations and directives coopearatives; based on international principles of cooperatives and taking into consideration the objective situtation of the Region, to organize, register issue certificate of legal personality and cancel cooperative socieites; to initiate loan policies with a view to strengthening cooperative societies, undertake studies on the establishment of cooperative societies banks by developing and integrating the financial capacity of cooperative societies and implement same upon approval; in order to achieve their objectivies, to render the necessary professional assistance to cooperative socicties with a view to modernizing their management accounting of system us well as enabling them to utilize better working methods; prepare educational and training programes inorder to assist members to practise saving and lo gain a sense of ownership toward their coopeartive socieities; to prepare continual training and educational programes aiming at the development of the concept of cooperatives and give same to members and employees of cooperatives as well as to cooperative professionals; design ways and means to arrange scholarship programes by cooperating and in- tegrating with the concerned bodies; to undertake studies and research aiming at streng- thening and promoting cooperative societies; per- form market surveys, gather and distribute the resulting information, gather and coordinate stats- tical data and disseminate same to the concerned body; to prepare and distrbuite model by-laws; prepare other directives, follow up and supervise their implementation; to strive for the respect of tie right of cooperative societies by creating closer relations with the relevant governmental and non-governmental or- ganizations, help them in getting the necessary support; to assure that cooperative socicties function trecly without interference from any one; ensure that a reliable control system is set up inorder to prevent misappropriation of the finance and property of cooperative societies; audit their accounts and follow up that the necessary measures are taken, render support to cooperative societies in their effort to recover lost money and property; concerning

Debub Negarit Gazeta — No. 4 17" July, 1997—Page 4 10) to arbitrate conflicts arising between cooperative societies, give decisions on questions of amal- gamation, division or dissolution of cooperative societies; 11) with a view to creating and enhancing public awareness of the concept of cooperatives to educate and spread propaganda through mass- media and other means as well; to own property; by informing the Executive Committee, enter into contracts; sue and be sued 12) in its own name; 13) to perform such other functions as may be necessary for the execution of its objectives. Power and Duties of the Head of the Office 1) The Head shall direct, administer and control the activities of the Office. Without prejudice to the provisions of sub-Article | of this Article, the Head shall; (a) implement the powers and duties of the Office specified in this Proclamation; prepare the annual plan and budget of the Office and implement same upon apprval; 2) (6) (c) effect expenditure in accordance with th approved plan and budget of the Office; represent the Office in all its dealings wit third parties; (d) (e) submit reports on the activities of the Oftice. 3) The Head may delegate part of his powers at duties to other officials and employees of the Ofti to the extent necessary for the efficient impleme tation of the Office’s powers and duties. The Budget The budget of the Office shall be allocated by t Regional State. Books of Account 1) The Office shall keep complete and accurate boo of account. The books of account of the Office shall be audit annually by the Regional State Auditor General auditors assigned by fim. Powers to issue directi ves 2) The Office may issue directives necessary for the pro implementation of this Proclamation. Transfer of Right and Obligations The rights and obligations of different offices of Region which have organized cooperative socielics hereby transfered to the Office with respect cooperative societies.

Repealed and Inapplicaple Laws 1) 2) Article 5(8), 6(10), 13(7) last sentence, and 14(11) second sentence of the Definition of Powers and Duties of the Executive Organs of the Southern Nations, Nationalities and Peoples’ Regional State Proclamation No. 3/1995 are hereby repealed. Any proclamation, regulation or directive which is inconsistent with this Proclamation shall be inap- plicable on matters provided for herein.
