P.O.Box 80001 ÃNÇ êU Unit Price የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፌደራል ነጋሪት ጋዜጣ FEDERAL NEGARIT GAZETTE OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ የሕዝብ ተወካዮች ምክር ቤት ጠባቂነት የወጣ ማውጫ አዋጅ ቁጥር ፩ሺ፪፻፹፰/፪ሺ፲፭ የዕፅዋት ዘር አዋጅ……………ገፅ ፲፬ሺ፯፻፺ Content Proclamation No. 1288/2023 Seed Proclamation...........................Page 14790 አዋጅ ቁጥር ፩ሺ፪፻፹፰/፪ሺ፲፭ የዕጽዋት ዘር አዋጅ የኢትዮጵያ የዕፅዋት ዘር ዘርፍ የግብርና ምጣኔ ሃብት ዕድገትን፣ የውጭ ኢንቨስትመት ማበረታታትን፣ የውጭ ምንዛሬ ገቢ ማሳደግን፣ ከውጭ የሚገባ የግብርና ምርትን ሚዛናዊ በሆነ ንግድ እንዲመራ ማድረግ፣ የምግብ፣ ስነ-ምግብ እና የመኖ እንዲሁም የደን ውጤቶችን ዋስትና ማረጋገጥ አስፈላጊ በመሆኑ፤ ዘላቂ የዕፅዋት ዘር ሥርዓት በመዘርጋት የዝርያ እና ዘር በብዛትና በጥራት ለአምራቾች እንዲቀርብ በማድረግ ሥርዓተ ምህዳር ላይ የሚኖረውን አስተዋጽኦ ማሳደግ በማስፈለጉ፤ PROCLAMATION NO. 1288/2023 SEED PROCLAMATION WHEREAS, Ethiopia’s seed sector is vital to enhance the country’s agricultural economic development, facilitate direct foreign investment, hard currency generation, leading agricultural import-export trade balances, food, nutrition, feed and forest products security; WHEREAS, it has become necessary to supply improved varieties and quality seed in required amount and quality to producers by putting in place a sustainable seed system with purpose of enhancing its contribution to ecosystem; 29th Year No.30 ADDIS ABABA 24th July, 2023 ሃያ ዘጠነኛ ዓመት ቁጥር ፴ አዲስ አበባ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ም gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14791 የግልና የመንግሰትን የዕፅዋት ዘር ኩባንያዎች በማሳተፍ እና ዓለም አቀፋዊ ተወዳዳሪነትን በማረጋገጥ ለምርምር፣ ለቴክኖሎጂ ሽግግርና ሥርፀት፣ ለምርትና ምርታማነት ዕድገትና ለምርት ጥራት የሚያበረክተውን አስተዋጽኦ በላቀ ደረጃ ማሳደግ በማስፈለጉ፤ በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግሥት አንቀጽ ፶፭ ንዑስ አንቀጽ (፩) መሠረት የሚከተለው ታውጇል። ክፍል አንድ ጠቅላላ ፩. አጭር ርዕስ ይህ አዋጅ “የዕፅዋት ዘር አዋጅ” ቁጥር ፩ሺ፪፻፹፰/፪ሺ፲፭ ተብሎ ሊጠቀስ ይችላል። ፪. ትርጓሜ የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር በዚህ አዋጅ ውስጥ፡ ፩/ “ዕፅዋት” ማለት ከእንስሳትና ከደቂቅ ዘአካላት ውጭ ያለ ማንኛውም ሕይወት ያለው የሚራባ አካል ነው፤ ፪/ “ዘር” ማለት ለዕፅዋት ማራባት የሚያገለግል እውን ዘር፣ አኩራች፣ የተክል ቁርጥራጭ፣ ሥራ ሥር፣ ችግኝ፣ ሳየን፣ መሰረተ ግንድ ወይም ሌላ ዓይነት የተክል አካል ነው፤ ፫/ “ዝርያ” ማለት በአንድ የዕፅዋት ምድብ ውስጥ የታወቀ የመጨረሻ ዝቅተኛ ደረጃ ያለው የዕፅዋት ምድብ ሆኖ፡ ሀ) ከአንድ ከተወሰነ ጄኖታይፕ ወይም ከብዙ ጄኖታይፖች ጥምረት በሚመነጩ ባህርያት በመታየት ራሱን የሚገለጽ፤ WHEREAS, it is essential, through ensuring private and public seed companies’ participation and global competitiveness, to strongly enhance the seed sector`s contribution to research, introducing technology and its, adoption, for enhancing production, productivity and product quality; NOW, THEREFORE, in accordance with Article 55 Sub-Article (1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby Proclaimed as follows. PART ONE GENERAL 1. Short Title This Proclamation may be cited as the “Seed Proclamation No.1288/2023.” [ 2. Definition In this Proclamation, unless the context otherwise requires: 1/ “Plant” means a living organism excluding the animal kingdom and micro-organisms that are capable of re-production; 2/ “Seed” means any botanical seed, bulbs, tubers, cuttings, rhizomes, roots, seedlings, scion, root stock or any other plant part intended for propagation of plants; 3/ “Variety” means means a plant grouping within a single botanical taxon of the lowest known rank and: a) defined by the expression of the characteristics of a given genotype or combination of genotypes; ፲፬ሺ፯፻፺፩ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14792 ለ) ካሉት ባህርያት መካከል ቢያንስ በአንዱ ከሌሎች ማናቸውም የዕፅዋት ምድብ የሚለይ፤ እና ሐ) ባህርያቱን ሳይቀይር መራባት በመቻሉ ምክንያት እንደ አንድ ዓይነት ምድብ ሊወሰድ የሚችል የዕፅዋት ምድብ ነው፤ ፬/ “የአርሶ አደሮች ወይም ከፊል አርብቶ አደሮች ዝርያ” ማለት፡ ሀ) በአርሶ አደሮች ወይም ከፊል አርብቶ አደሮች መሬት ላይ በባህላዊ መንገድ የለማ እና የበለፀገ፣ ወይም ለ) አርሶ አደሮች ወይም ከፊል አርብቶ አደሮች በዋነኛነት ከተለያዩ የዕፅዋት ምንጮች ያዳቀሉት ወይም የመረጡት ዝርያ ነው፤ ፭/ “ጄኖታይፕ” ማለት የአንድ ዕፅዋት የዘረ-መል ውቅር ነው፤ ፮/ “ዝርያ መልቀቅ” ማለት የምርምር ሂደት ጨርሶ የዝርያ ብቃት ማረጋገጫ እና የባሕርይ ልየታ ፍተሻ መስፈርት ሲያሟላ ዝርያው እንዲባዛ፣ እንዲመረት፣ ዘሩ ለሀገር ውስጥ ወይም ለውጭ ሀገር ገበያ እንዲውል በባለስልጣኑ ለመፍቀድ የሚያስችል ሂደት ነው፤ ፯/ “ብሔራዊ የዝርያ ብቃት ማረጋገጫ ሙከራ” ማለት አንድ እጩ ዝርያን ለመጠቀም ኢኮኖሚያዊ፣ ማህበራዊ እና አካባቢያዊ ፋይዳውን በቅርብ ጊዜ ከተለቀቀ እና ከአካባቢ ዝርያ ጋር ለማወዳድር የሚደረግ ሙከራ ነው፤ ፰/ “ነባር ዝርያ” ማለት አርሶ/አርብቶ አደሩ ለረጅም ጊዜ ሲጠቀምበት የኖረ ና ከዚህ በፊት ያልተለቀቀ ዝርያ ነው፤ b) distinguished from any other plant grouping by the expression of at least one of the said characteristics; and c) considered as a unit with regard to its ability for being propagated unchanged; 4/ “Farmers or Semi-Pastoral` Variety” means variety which is: a) traditionally cultivated and developed by farmers or pastoral communities in their fields; or b) predominantly breed or selected by farmers or pastoral communities from various plant source; 5/ “Genotype” means the genetic constitution or genetic make-up of a particular plant; 6/ “Variety Release” means a process whereby a plant variety, after completion of research process, has satisfactorily went through National Performance Trials (NPT) and Distinctness, Uniformity & Stability (DUS) tests and authorized by Authority for further multiplication or production or sale for domestic or foreign market; 7/ “National Performance Trial (NPT)” means testing a candidate variety to assess its economic and social value as well as environmental benefit by comparing it against recently released and local variety prior to utilization; 8/ “Local Variety” means a variety that has been used by farmers or semi-pastoralist for a long time and has not been released before; ፲፬ሺ፯፻፺፪ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14793 ፱/ “ሀገራዊ ፋይዳ ያለው ዝርያ” ማለት ሚኒስቴሩ ለልማት ፍላጎቱ በልዩ ሁኔታ አጥንቶ ለለያቸውና ከባለሥልጣኑ ጋር ስምምነት ለደረሰባቸው ለውጭ ንግድ መሻሻል፣ ከውጭ የሚመጡ ምርቶችን ለመተካት፣ ለአግሮ ኢንዱስትሪ ጥሬ ዕቃ አቅርቦት፣ ለምግብና ስነ-ምግብ ዋስትና ለማረጋገጥ የሚረዳ ነው፤ ፲/ “የባሕርይ ልየታ ፍተሻ” ማለት ለተለያዩ የዕፅዋት አይነቴዎች የወጣውን ከሌላው የተለየ፣ ወጥነት ያለው እና ሊቀያየር የማይችል የዝርያ መስፈርት ዕጩ ዝርያው ማሟላት አለማሟላቱ የሚረጋገጥበት የሙከራ አይነት ነው፤ ፲፩/ “የዘር ደረጃ” ማለት አራቢን፣ ቅድመ መስራችን፣ መስራችንና እስከ ሶስተኛው ትውልድ ያለውን የተመሰከረለት ዘርን የሚያካትት ነው፤ ፲፪/ “መነሻ ዘር” የአንድን ዘር ደረጃ ለማምረት በምንጭነት የሚያገለግል ዘር ነው፤ ፲፫/ “አራቢ ዘር” ማለት የመጀመሪያ የዘር ደረጃ ነው፤ ፲፬/ “ቅድመ መስራች ዘር” ማለት ከአራቢ ዘር የሚገኝ የዘር ደረጃ ነው፤ ፲፭/ “መስራች ዘር” ማለት ከቅድመ መስራች ዘር የሚገኝ የዘር ደረጃ ነው፤ ፲፮/ “የተመሰከረለት ዘር” ማለት በትውልዱ ከመስራች ዘር ወይም ከአንደኛው፣ ከሁለተኛው ወይም ከሶስተኛው ከተመሰከረለት ዘር የሚገኝ የዘር ደረጃ ነው፤ ፲፯/ “የጸደቀ ዘር” ማለት በሀገር ውስጥ የተመረተ ወይም ከውጭ የገባ ሆኖ የዘር ጥራት ደረጃ መስፈርቶችን ማሟላቱ በባለሥልጣኑ ወይም በክልል ባለስልጣን የተረጋገጠ ዘር ነው፤ ፲፰/ “የአስቸኳይ ጊዜ ዘር” ማለት የተገኘበት ወይም ምንጩ የታወቀና አጣዳፊ የዘር እጥረት ሲያጋጥም ጥቅም ላይ የሚውል ነው፤ 9/ “A Variety of Significant National Interest” means a variety identified through special study by the Ministry, with an agreement of the Authority, for its development interest specific to improvement of export trade, import substitution, supply of raw materials for agro-industries, food & nutrition security; 10/ “Varietal Description” is a test conducted on a candidate variety to confirm whether it fulfills Distinctness, Uniformity and Stability requirement set for various plant species; 11/ “Seed Class” means breeder, pre-basic, basic and certified seeds of the first, second and third generations; 12/ “Source Seed” means a seed intended to produce a specific seed class; 13/ “Breeder Seed” means seed of the first seed class; 14/ “Pre-Basic Seed” is a seed class that is descent from breeder seed; 15/ “Basic Seed” means seed class that is descent from pre-basic seed; 16/ “Certified Seed” means a seed that is a direct descent from basic or the first, second or third class of certified seed; 17/ “Approved Seed” means locally produced or imported seed certified by the Authority or Regional Authority for compliance with quality standards; 18/ “Emergency Seed” means seed of a known source that is intended to meet an acute seed shortage; ፲፬ሺ፯፻፺፫ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14794 ፲፱/ “የመጠባበቂያ ዘር” ማለት የዕፅዋት ዘር እጥረት እንዳያጋጥም አስቀድሞ የሚከማች ዘር ነው፤ ፳/ “ጥራቱ የተገለፀ ዘር” ማለት ዘጠና በመቶ በአምራቹና አስር በመቶ በክልል ባለስልጣን የዘር ጥራት ማረጋገጥ ሥራ ተደርጎበት የሚቀርብ ዘር ነው፤ ነገር ግን እንደአስፈላጊነቱ የክልል ባለሥልጣን የቁጥጥር ደረጃ ከ፲ በመቶ በላይ ከፍ ሊል የሚችል ሆኖ ዝርዝሩ በመመሪያ ይወሰናል፤ ፳፩/ “ገደብ የተጣለበት ዘር” ማለት በአገር ውስጥ ገበያ ላይ እንዳይውል፣ ወደ አገር እንዳይገባና ከአገርም እንዳይወጣ የተከለከለ ዘር ነው፤ ፳፪/ “ልውጥ ህያው” ማለት ሰው ሰራሽ የሆነ ወይም ከሌላ ህያው የተወሰደ ይሁን ከቅሪት የተወሰደ ወይም እንደ አዲስ የተቀመመ ባይተዋር ዘረመል ወይም ስለተከተተበት የዘረመሎቹ ይዘት ወይም የባህሪው ክስተት የተለወጠበት ህያው ነው፤ ፳፫/ “የብቃት ማረጋገጫ የምስክር ወረቀት” ማለት አንድ ሰው ዘር ማምረት፣ ማዘጋጀት፣ ማከፋፈል፣ መቸርቸር እና ራስ አገዝ የዘር ጥራት ማረጋገጥ አገልግሎት ላይ ለመሰማራት ሲፈልግ መስፈርት ማሟላቱ ሲረጋገጥ የሚሰጥ ነው፤ ፳፬/ “የዘር ጥራት ደረጃ” ማለት በመስክ እና በላብራቶሪ የተፈቀደ የዘር ጥራት መጠን መለኪያ ነው፤ ፳፭/ “የዘር ጥራት ማረጋገጥ” ማለት አንድ ዘር የዘር ጥራት ደረጃ ማሟላቱ የሚፈተሸበት እና ውሳኔ የሚሰጥበት ሂደት ነው፤ ፳፮/ “የቅድመ ቁጥጥር” ማለት የመነሻ ዘር ለቀጣይ የዘር ብዜት ተግባር ከመዋሉ በፊት የሚካሄድ የጥራት ማረጋገጥ ሂደት ነው፤ 19/ “Reserve Seed” means seed that is stored in advance to avoid seed shortage; 20/ “Quality Declared Seed” means a seed supplied with a 90% certification role by the producer and 10% by the regional Authority; however, as appropriate the certification role of the Regional Authority may exceed 10%; details shall be prescribed in the Ministerial Directive; 21/ “Restricted Seed” means seed prohibited from being marketed locally, imported into, or exported from, Ethiopia; 22/ “Modified Organism” means any biological entity which has been artificially synthesized, or in which the genetic material or the expression of any of its traits has been changed by the introduction of any foreign gene whether taken from another organism, from a fossil organism or artificially synthesized; 23/ “Certificate of Competency” is issued when a person fulfills requirements set for seed production, processing, wholesale, retail sale and self-certification service; 24/ “Seed Quality Standard” means a measure of allowable seed quality parameter at field and laboratory level; 25/ “Seed Quality Approval” means the process of evaluating and deciding on the quality of a seed about its compliance with seed quality standards; 26/ “Pre-Control” is a certification process conducted to verify varietal purity of an approved source seed for further multiplication; ፲፬ሺ፯፻፺፬ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14795 ፳፯/ “ድህረ ቁጥጥር” ማለት ለቀጣይ ዘር ብዜት የማይውል የተመሰከረለትን ዘር ጥራት የሚረጋገጥበት ሂደት ነው፤ ፳፰/ “የዘር ኢንስፔክተር” ማለት በመስክ የዘር ጥራትን አንዲያረጋግጥ በባለስልጣኑ ወይም በክልል ባለስልጣን የሚሰየም የተፈጥሮ ሰው ነው፤ ፳፱/ “የዘር ላቦራቶሪ አናሊስት” ማለት በላቦራቶሪ የዘር ጥራትን አንዲያረጋግጥ በባለስልጣኑ ወይም በክልል ባለስልጣን የሚሰየም የተፈጥሮ ሰው ነው፤ ፴/ “አነስተኛ ይዞታ ያለው አርሶ አደር ወይም አርብቶ አደር” ማለት በሕግ የመሬት ይዞታ ማረጋገጫ ሰርትፍኬት የተሰጠው፣ የመሬት ይዞታው ከ፲ ሄክታር ያልበለጠ፣ የራሱንና የቤተሰቡን ጉልበት በመጠቀም የግብርና ልማት የሚያካሂድና ኑሮው በዋናነት በግብርና ላይ የተመሰረተ አርሶ አደር ወይም ከፊል አርብቶ አደር ነው፤ ፴፩/ “ራስ አገዝ የዘር ጥራት ማረጋገጥ” ማለት በክልል ባለስልጣን ወይም በባለስልጣኑ ፈቃድ ያገኘ አምራች ያመረተውንና ያዘጋጀውን ዘር ራሱ በዘር ጥራት ደረጃ መሰረት አረጋግጦ የሚሸጥበት ሂደት ነው፤ ፴፪/ “የሶስተኛ ወገን የዘር ጥራት ማረጋገጥ” ማለት አምራች ያልሆነ ግን በባለስልጣኑ ወይም በክልል ባለስልጣን ፈቃድ ያገኘ ሰው የዘርን ጥራት የሚያረጋግጥበት ሂደት ነው፤ ፴፫/ “ባለስልጣን” ማለት የኢትዮጵያ ግብርና ባለስልጣን ነው፤ ፴፬/ “የክልል ባለስልጣን” ማለት በክልል የዘር ጥራትን ለማረጋገጥ ስልጣን የተሰጠው አግባብ ያለው አካል ነው፤ ፴፭/ “ሚኒስቴር ወይም ሚኒስትር” ማለት እንደቅደም ተከተሉ የግብርና ሚኒስቴር ወይም ሚኒሰትር ነው፤ 27/ “Post-Control” is seed certification process conducted to verify the varietal purity of approved seed which is not further multiplied; 28/ “Seed Inspector” means a natural person who is assigned by an authority or regional authority to approve seed quality at field level; 29/ “Seed Laboratory Analyst” means a natural person who is assigned by an Authority or Regional Authority to approve seed quality at laboratory level; 30/ “Small Holder Farmer or Pastoralists” means a farmer or pastoralist who is officially granted a certificate of land holding of not more than 10 hectare and engaged in agricultural activity using his own and family labor; and his lively hood is predominately dependent on agriculture; 31/ “Self-Seed Quality Certification” means a seed certification process whereby the seed producer is licensed by a Regional Authority or an Authority to certify by himself and sell its own produced and processed seed certifying it in accordance with seed quality standards; 32/ “Third Party Seed Certification” means a seed certification process done by non-seed producer who is licensed by Regional Authority or an Authority; 33/ “Authority” means the Ethiopian Agriculture Authority; 34/ “Regional Authority” means an eligible body responsible to approve seed quality at Region level; 35/ “Minister or Ministry” means the Minister of Agriculture or Ministry of Agriculture; ፲፬ሺ፯፻፺፭ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14796 ፴፮/ “ክልል” ማለት በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገመንግሥት አንቀጽ ፵፯ መሰረት የተቋቋመ ነው፤ ፴፯/ “ቢሮ” ማለት የክልል ግብርና ቢሮ ነው፤ ፴፰/ “ሰው” ማለት የተፈጥሮ ሰው ወይም በሕግ የሰውነት መብት የተሰጠው አካል ነው፤ ፴፱/ ማንኛውም በወንድ ፆታ የተገለጸው ሴትንም ይጨምራል። ፫. የተፈጻሚነት ወሰን ፩/ ይህ አዋጅ በማንኛውም ዘር ላይ ተፈጻሚ ይሆናል፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተገለጸው እንደተጠበቀ ሆኖ ይህ አዋጅ፡ ሀ) ማንኛውም ሰው ካመረተው ምርት ላይ ጠብቆ በሚጠቀምበት ዘር፤ ለ) አነስተኛ የመሬት ይዞታ ባላቸው አርሶ አደሮች ወይም አርብቶ አደሮች መካከል ከምርቱ ጠብቆ እርስ በርስ በሚደረግ ልውውጥ ወይም በማንኛውም ሰው በዝርያ ባለቤትነት መብት ባልተመዘገብ ዝርያ ዘር በሚከናወን ሽያጭ፤ ሐ) ለምርምር እና ትምህርት ሥራ በሚውል ዘር፤ ላይ ተፈጻሚ አይሆንም፡፡ 36/ “Region” means any Region referred to in Article 47 of the of the Constitution of the Federal Democratic Republic of Ethiopia; 37/ “Bureau” means Regional Bureau of Agriculture; 38/ “Person” means any natural or juridical person; 39/ any expression in the masculine gender includes the feminine. 3. Scope of Application 1/ This Proclamation shall be applicable to any seed. 2/ Without prejudice to the provision of Sub-Article (1) of this Article, the Proclamation shall not be applicable to: a) the use, by any person, of farm-saved seed; b) the exchange of farm-saved seed among smallholder farmers or pastoralists or any seed sale conducted among themselves on a non-registered for variety protection right; c) seed intended for research and education purpose. ፲፬ሺ፯፻፺፮ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14797 ክፍል ሁለት ዝርያ መልቀቅና መመዝገብ ፬. ዝርያዎችን ስለመልቀቅ ፩/ ባለስልጣኑ እንደ አስፈላጊነቱ፡ ሀ) ዕጩ የዝርያ ብቃት ማረጋገጫ እና የባህርይ ልየታ ፍተሻ በራሱ በመስራት፣ በዝርያ ገምጋሚ ኮሚቴዎች በማስገምገም እና በብሔራዊ ዝርያ አጽዳቂ ኮሚቴ ውሳኔ አንዲሰጥ በማድረግ፤ ወይም ለ) የዝርያ ብቃት ማረጋገጫ ወይም የማላመድ ሙከራ ወይም የባህርይ ልየታ ፍተሻ ወይም ሁለቱን ወይም ሶስቱን በእጩ ዝርያ አመልካች እንዲሰራ በማድረግ፣ በብሔራዊ ዝርያ ገምጋሚ ኮሚቴዎች በማስገምገም እና በብሔራዊ ዝርያ አጽዳቂ ኮሚቴ ውሳኔ አንዲሰጥ በማድረግ፤ ወይም ሐ) በውጭ ሀገር ዕውቅና ባለው ተቆጣጣሪ አካል የተሰራ የዝርያ የባህሪ ልየታ ፍተሻ እና በአመልካቹ የሀገር ውስጥ የማላመድ ሪፖርት በመቀበል፤ የዝርያ ለቀቃ እና ምዝገባን የአሰራር ሥርዓትን ተግባራዊ ያደርጋል፤ ዝርዝር አፈጻጸሙ በመመሪያ ይወሰናል፡፡ ፪/ ባለስልጣኑ በየትኛው የዝርያ ለቃቃና ምዝገባ የአሰራር ሥርዓት ማለፍ ስላለባቸው የዕፅዋት ዓይነቴዎች ዝርዝር አግባብነት ባለው መገናኛ ብዙኃን እንዲገለጽ ያደርጋል፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ ፩ የተጠቀሰው እንደተጠበቀ ሆኖ ሚኒስቴሩ አስፈላጊ ሆኖ ሲያገኘው ከባለስልጣኑ ጋር በመመካከር፡ PART TWO VARIETY RELEASE AND REGISTRATION 4. Release of Varieties 1/ As deemed necessary, with particulars to be described in Directives, the Authority shall employ the following variety release and registration systems; a) conducts candidate variety performance trial and variety examination by itself, hosts evaluation by National Variety Evaluation Committee and get final approval by National Variety Release Committee; or b) enable the applicant of the candidate variety to conduct variety performance or adaptation trials or variety description trial or both; and evaluation by National Variety Evaluation Committee; and final approval by National Variety Release Committee; or c) accepts a DUS report of an authorized foreign regulatory body and locally conducted adaptation trial report of the applicant. 2/ The Authority shall determine the species that need to be released & registered under each option; and publicize them using an appropriate media. 3/ Without prejudice to the provision of Sub-Article (1) of this Article, as desired the Ministry in consultation with the Authority: ፲፬ሺ፯፻፺፯ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14798 ሀ) በዓይነታቸው ልዩ ሀገራዊ ፋይዳ ያላቸው፣ የተለዩ እና በውጭ ሀገር የተመዘገቡ ዝርያዎች በሀገር ውስጥ የዝርያ ማላመድ ሙከራ ማካሄድ ሳያስፈልግ በቀጥታ እንዲመረቱ ሊፈቅድ ይችላል፤ ለ) በፊደል ተራ “ሀ” የተገለጸው እንደተጠበቀ ሆኖ ስለ ዝርያው ልዩ ሀገራዊ ፋይዳ በጽሑፍ መቅረብ ይኖረበታል፡፡ ፬/ ሆኖም በንዑስ አንቀጽ ፫ ሥር የተጠቀሰው ልዩ ሁኔታ ተግባራዊ ከመሆኑ በፊት ባለስልጣኑ ዝርያው፡ ሀ) ከሌሎች ዝርያዎች የተለየ፣ ወጥነት ያለው እና ሊቀያየር የማይችል የዝርያ ባህርይ ሪፖርት መቅረቡን፤ ለ) የሀገሪቱ የብዝሃ ሕይወት እና የኳራንቲን መሥፈርት መሟላቱን፤ በማረጋገጥ ጥቅም ላይ አንዲውል ይደርጋል፡፡ ፭/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) ፊደል ተራ (ሐ)፣ ንዑስ አንቀጽ (፫) እና ንዑስ አንቀጽ (፬) መሰረት አንድ የዕፅዋት ዝርያ ወደ ሀገር ውስጥ ገብቶ መመረት ከጀመረ በኋላ በዝርያው ምክንያት ለሚደርስ ማንኛውም ጉዳት የዝርያው ባለቤት ወይም ሕጋዊ ወኪሉ ሙሉ ኃላፊነት ይወስዳል፡፡ ፮/ ዘሩን አባዝቶ ለውጭ ሀገር ገበያ ለመላከ ዓላማ የሚውል ማንኛውም ያልተመዘገበ ዝርያ ወደ ሀገር በሚገባበት ወቅት፡ ሀ) አግባብነት ያላቸው የጀነቲክ ሃብት አጠቃቀም እና የኳራንቲን ሕጎችን ማሟላቱ ተረጋግጦ፤ ለ) የዝርያ የማላመድ ሙከራ ማካሄድ እና በዝርያ መዝገብ መመዝገብ ሳያስፈልግ፣ በሀገር ውስጥ ተባዝቶ ቀጥታ ወደ ውጭ ይላካል፤ ዝርዝር አፈጻጸሙ በሚኒስቴሩ መመሪያ ይገለጻል፡፡ ፯/ የአርሶ አደሮች ወይም ከፊል አርብቶ አደሮች ዝርያ የሚለቀቅበት እና የሚመዘገብበት አሰራር ይዘረጋል፡፡ a) shall permit the production of selected foreign registered varieties with special significant national interest without undergoing variety adaptation trial; b) without prejudice letter” a” of sub article 3, a written justification shall be submitted on the significance national interest of the variety. 4/ Prior to registering a variety in a registry in accordance with Sub-Article 3 of this Article, the Authority shall ascertain: a) submission of DUS test report; b) fulfilment of national biodiversity and quarantine requirements. 5/ A variety owner or his legal representative shall take full responsibility for any damage caused by production of a variety according to Sub-Article “1 paragraph (c)”, “3” & “4” of this Article. 6/ Unregistered variety intended exclusively for export market may be imported: a) as long as it meets biodiversity and quarantine requirements of the country; b) multiplied in the country without undergoing adaptation trial and not registered on the variety registry; details shall be prescribed in the ministerial Directive. 7/ A system shall be put in place that allows the release and registration of farmers or semi pastoralist varieties. ፲፬ሺ፯፻፺፰ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14799 ፰/ የዝርያ ለቀቃ እና ምዝገባ ኮሚቴዎችን በተመለከተ ባለስልጣኑ፡ ሀ) የዕጩ ዝርያዎችን ብቃት የሚገመግሙ ቴክኒካል ኮሚቴዎችን ያቋቁሟል፤ ለ) ከመመረት ውጭ የሚሆኑ የእጽዋት ዝርያዎችን የሚገመግም ቴክኒካል ኮሚቴ ያቋቁማል፤ ሐ) የቴክኒካል ኮሚቴዎችን ሪፖርቶች መሠረት በማድረግ ዕጩ ዝርያዎች ላይ እና ከመመረት ውጭ በሆኑ ዝርያዎች ላይ ውሳኔ የሚሰጥ ብሔራዊ የዝርያ አጽዳቂ ኮሚቴ ያቋቁሟል፤ መ) የሚቋቋሙት ኮሚቴዎችን ስብጥር እና አሰራር በዝርያ ለቀቃ እና ምዝገባ መመሪያ ይወሰናል፤ ሠ) የዝርያ ፍተሻ ባለሙያ ይመድባል፡፡ ፭. ብሔራዊ የዝርያ መዝገብ ባለስልጣኑ፡ ፩/ በዚህ አዋጅ አንቀጽ (፬) በተደነገገው መሰረት ዝርያዎችን በብሔራዊ የዝርያ መዝገብ ውስጥ ያካትታል፤ ፪/ ሀገሪቱ አባል በሆነችባቸውና ባጸደቀቻቸው ዓለም አቀፍ ስምምነቶች የዝርያ መዝገብ ላይ የተመዘገቡትን ዝርያዎች ተቀብሎ በዝርያ መዝገቡ ያካትታቸዋል፤ ፫/ በተለያየ ምክንያት ከመመረት የወጡ ዝርያዎች ከዝርያ መዘገብ ይሰርዛል፡፡ 8/ Regarding variety release and registration committees, the Authority: a) shall set up technical committees responsible for evaluation of candidate variety; b) shall set up a technical committee responsible to evaluate varieties that need to be out of production; c) shall set up a National Variety Release Committee (NVRC) that decides based on the reports of the technical committees, on candidate and obsolete varieties; d) The composition and operations of the committees shall be prescribed under the variety release and registration Directive; e) shall assign variety examiner. 5. National Variety Registry The Authority: 1/ Shall register varieties in the National Variety Registry Book, in accordance with the provision of Article 4 of this Proclamation; 2/ Shall register, in its registry book, a variety listed in a variety catalogue of international agreements for which the country ratified and is a member; 3/ Shall cancel varieties from the registry book that are obsolete due to various reasons. ፲፬ሺ፯፻፺፱ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14800 ክፍል ሦስት የዕጽዋት ዘር ማምረት፣ ዝግጅትና ግብይት ፮. ስለ ዘር ማምረት ዕቅድ ፩/ ማንኛውም ለገበያ የሚሆን ዘር በማምረት የሚሰማራ ሰው ስለሚያመርተዉ ዘር ዕቅድ ለባለስልጣኑ ወይም ለክልል ባለስልጣን አስቀድሞ በሚወሰን ጊዜ የማሳወቅ ግዴታ አለበት፡፡ ፪/ ባለስልጣኑ የሚከተሉትን ሀገራዊ መረጃዎች የያዘ የዘር ምርት መረጃ ቋት ያዘጋጃል፡ ሀ) ዓመታዊ የምርት ዕቅድና የፈጻሚዎች የኃላፊነት ድርሻ፤ ለ) ዓመታዊ የዘር ምርት በዝርያ ዓይነት፣ በዘር ደረጃ፣ በአምራችና በጥቅል፤ ሐ) ዘር ለማምረት ጥቅም ላይ የዋለ መሬት፣ መሠረተ ልማትና ሌሎች ግብዓቶች፤ እና መ) ለብሔራዊ የዘር ምርት አስፈላጊ የሆኑ ሌሎች መረጃዎች፡፡ ፫/ የዘር ምርት መረጃ ቋት ከዘር አምራቾችና አከፋፋዮች መዝገብ ጋር የተያያዘ መሆን አለበት፡፡ ፯. የዕጽዋት ዘር ማምረት ፩/ ማንኛውም ሰው፡ ሀ) በዓመታዊ ሰብሎች ዘር ማምረት ለመሰማራት፤ ለ) በደንና በፍራፍሬ እንዲሁም ሌሎች ቋሚ ሰብሎች የዘር ምንጭነት አገልግሎት ለመስጠት የእናት ዛፍ እና የማምረቻ ቦታውን በማሰመዘገብ፤ የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ PART THREE SEED PRODUCTION, PROCESSING AND MARKETING 6. Seed Production Plan 1/ Any person who wants to engage in commercial seed production shall make known his production plan to an Authority or Regional Authority, in a pre-set time. 2/ The Authority shall keep a National Seed Production Database containing: a) annual production plan and specific responsibilities of implementors; b) annual seed production by type of variety, class of seed, by producers and in an aggregate form; c) land, infrastructure and other inputs used to produce seed; and d) any other relevant information to the National Seed Production. 3/ The Seed Database shall be linked to seed producers and distributors registry. 7. Seed Production 1/ Any person who wants to engage: [[a) in annual crop seed production; b) in forest, fruit and other perennial crops seed production and to serve as source seed shall register his parent seed source tree and production site; and acquire a certificate of competency; ፲፬ሺ፰፻ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14801 ሐ) ለገበያ የሚሆን የተመሰከረለት ዘር ወይም መስራች ዘር ወይም ሁለቱንም በማምረት ተግባር ላይ ከመሰማራቱ በፊት ለእነዚህ የዘር ደረጃዎች የተዘጋጀውን የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ መ) አራቢ ዘር እና ቅድመ መስራች ዘር ለማባዛት የሚፈልግ ከሆነ እነዚህን የዘር ደረጃዎች ለማባዛት የሚያስችለውን የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ ሠ) በዚህ አዋጅ መሰረት በሚወጣ መመሪያ የሚወሰኑትን መስፈርቶች እስካሟላ ድረስ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) ፊደል ተራ (ሐ) እና (መ) የተጠቀሱትን ሁለት የብቃት ማረጋገጫ የምስክር ወረቀቶች ከማግኘት አይከለከልም፤ ረ) በዚህ ንዑስ አንቀጽ ከፊደል ተራ (ሀ) እስከ (ሠ) የተገለጸው አንደተጠበቀ ሆኖ ከአንድ ክልል በላይ በዘር ማምረት የሚሰማራ ከሆነ ከባለስልጣኑ፤ በአንድ ክልል ብቻ ተወስኖ የሚያመርት ከሆነ ከክልል ባለስልጣን የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ ሌሎች አፈጻጸሞች በመመሪያ ይወሰናሉ፡፡ ፪/ ለገበያ የሚሆን ዘር በማምረት ተግባር ላይ የሚሰማራ ማንኛውም ሰው የብቃት ማረጋገጫ ለማግኘት የውስጥ የዘር ጥራት ቁጥጥር ሥርዓት መዘርጋት ይኖርበታል፡፡ ፫/ በዘር ማምረት የተሰማራ ሰው የሚያመርተውን ዘር ምንጭ፣ ዘር ደረጃና ሌሎች የጥራት መስፈርቶችን ለባለስልጣን ወይም ለክልል ባለስልጣን የማሳወቅ ግዴታ አለበት፡፡ ፬/ የብቃት ማረጋገጫ የምስክር ወረቀት የተሰጠው ዘር አምራች አግባብነት ባለው ማንኛውም ሌላ ህግ የተደነገገው እንደተጠበቀ ሆኖ የተመዘገቡ ዝርያዎችን አራቢ ዘር፣ ቅድመ መሥራች ዘር እና መሥራች ዘርን ከሚያባዙ ተቋማት ማግኘት ይችላል፡፡ c) in production & marketing of certified or basic seed or both shall acquire certificate of competence specific to those seed classes; d) in multiplication of breeder and pre-basic seed shall acquire a certificate of competency specific to multiplication of those seed classes from the Authority or Regional Authority; e) shall not be prohibited from acquiring the two kinds of certificates of competency, described under (C)” and “(D)” of this Article of Sub Article 1, as far as he is able to fulfill requirements to be prescribed by Directive under this Proclamation; f) without prejudice to the provisions under paragraph (A) to (E) of this Sub Article 1, has to acquire a certificate of competency from the Authority when engaging in seed production activity in more than one Region and from a Regional Authority when engaged in the respective Region; Other details shall be described in a Directive. 2/ Any person who engaged in commercial seed production shall establish an internal seed quality control system. 3/ Any seed producer shall be responsible to ascertain and describe to the Authority or Regional Authority about eligibility of seed source, seed class and other quality requirements. 4/ Any seed producer with a certificate of competence, subject to any other applicable laws, has a right to access breeder seed, pre-basic seed and basic seed of registered varieties from producers. ፲፬ሺ፰፻፩ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14802 ፭/ ማንኛውም ዘር አምራች ሆኖ ዘር በማምረት ለመሰማራት የሚፈልግ ሰው በራሱ መሬት ወይም በሌሎች አምራቾች መሬት በውል ላይ ተመስርቶ ዘር ማምረት ይችላል፡፡ ዝርዝር አፈጻጸሙ በመመሪያ ይወሰናል፡፡ ፰. የዘር ዝግጅት ማንኛውም ሰው ከአንድ ክልል በላይ በዘር ዝግጅት ሥራ ለመሰማራት ሲፈልግ ከባለስልጣኑ፤ በአንድ ክልል ብቻ ተወስኖ የሚሰራ ከሆነ ከክልል ባለስልጣን የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ ዝርዝር አፈጻጸሙ በመመሪያ ይወሰናል፡፡ ፱. የዘር ግብይት ፩/ በዚህ አዋጅ የዘር ግብይት ዓይነቶች የሚከተሉትን ያካትታል፡ ሀ) ወደ ሀገር ውስጥ ማስገባትና ወደ ውጭ መላክ፤ ለ) በሀገር ውስጥ ማከፋፈል እና መቸርቸር፤ ሐ) የደንና የፍራፍሬ ዘር በመልቀም መሸጥ፤ መ) ዘር ማከም፣ ማሰራጨት፣ ማጓጓዝ፣ ማከማቸት፤ እና ሠ) በመመሪያ የሚወሰኑ ሌሎች የግብይት ዓይነቶች፡፡ ፪/ ማንኛውም ሰው፡ ሀ) በሀገሪቱ ከአንድ ክልል በላይ በዘር ግብይት ተግባር ላይ የሚሰማራ ከሆነ ከባለስልጣኑ የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ ለ) በአንድ ክልል በመወሰን በዕፅዋት ዘር ግብይት ተግባር ላይ የሚሰማራ ከሆነ ከክልል ባለስልጣን የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ 5/ Any person who wants to engage in seed production as producer can produces seed either on his own farm or under contract with seed grower; Details shall be prescribed in a Directive. 8. Seed Processing Any person who wants to engage in seed processing shall bear certificate of competency from the Authority when engaged in more than one Region and from Regional Authority when engaged in the respective Region; Details shall be prescribed by Directive. 9. Seed Marketing 1/ Under this Proclamation, seed marketing includes the following: a) seed import and export; b) wholesale and retail sale for local market; c) collection and sale of forest and fruit seed; d) seed treatment, distribution, transport and storage; and e) other marketing types to be prescribed by a Directive. 2/ Any person: a) who engages in seed marketing in two and more Regions shall acquire a certificate of competence from the Authority; b) who engages in seed marketing within one Region shall acquire a certificate of competency from respective Regional Authority; ፲፬ሺ፰፻፪ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14803 ሐ) የመንግሥት ዝርያዎች መነሻ ዘር በመጠቀም ዘር የሚያመርትና ለገበያ የሚያቀርብ ከሆነ ያልተዋወቁ አዳዲስ የመንግስት ዝርያዎችን የማስተዋወቅ ግዴታ ይኖርበታል፡፡ ፫/ የዕጽዋት ዘር ግብይት በግል፣ በማህበራት፣ በመንግስት ወይም በሌሎች አቅራቢዎች ሊከናወን ይችላል፡፡ ፬/ የዘር ግብይት ስርዓቱ ዝርዝር አፈጻጸም አስመልክቶ በመመሪያ ይወጣል፡፡ ፲. የዘር ማምረትን፣ ዝግጅትን እና የግብይት የሥራ ወሰንን ስለማስፋት በአንድ ክልል ተወስኖ ይሰራ የነበረ የዘር አምራች ወይም አዘጋጅ ወይም አከፋፋይ ከአንድ ክልል በላይ ለመሰማራት የሚፈልግ ከሆነ፡ ፩/ አስቀድሞ በክልል ውስጥ ይሰራበት የነበረውን የብቃት ማረጋገጫ የምስክር ወረቀት ለክልል ባለስልጣን መመለስ፤ እና ፪/ መስፈርቶችን በማሟላት ከባለስልጣኑ አዲስ የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት ይኖርበታል፡፡ ፲፩. የመጠባበቂያ ዘር ሥርዓት ሚኒስቴሩ የዘር እጥረት እንዳይከሰት አግባብነት ካላቸው አካላት ጋር በመተባበር የመጠባበቂያ ዘር ሥርዓትን ይዘረጋል፤ ዝርዝር አፈጻጸሙም በሚኒስትሮች ምክር ቤት ደንብ ይወሰናል፡፡ ፲፪. የመረጃ አያያዝ ባለስልጣኑ በሀገር አቀፍ ደረጃ፤ የክልል ባለስልጣን ደግሞ በክልል ደረጃ ዘርን በተመለከተ መረጃን ይመዘግባል፤ ያደራጃል፤ እንደ አስፈላጊነቱ ተደራሽ ያደርጋል፡፡ c) shall conduct promotion of new public varieties that have not yet been popularized, if he markets seed produced from source of seed of public varieties. 3/ Seed marketing can be run by private, cooperative or public firms or any other suppliers. 4/ Details of the seed marketing system shall be prescribed by a Directive. 10. Expanding Seed Production, Processing and Market Boundaries When a Region level seed producer, processor or wholesaler wants to operate in more than one Region: 1/ he shall first return the Regionally issued certificate of competency to the respective Regional Authority; and 2/ shall acquire a new one from the Authority upon fulfilling requirements. 11. Seed Reserve System To alleviate seed shortages, the Ministry in collaboration with other eligible bodies, shall put seed reserve system in place; details shall be prescribed by Council of Ministers Regulation. 12. Data Management The Authority, at National level, and the Regional Authority in its respective Region, shall document, organize and, as deemed necessary make accessible any seed related data. ፲፬ሺ፰፻፫ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14804 ክፍል አራት የዘር ጥራት ማረጋገጥ ፲፫. የዘር ጥራት ደረጃ ፩/ ባለስልጣኑ የዘር ጥራት ደረጃ ያወጣል፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተጠቀሰው አገላለጽ እንደተጠበቀ ሆኖ ባለስልጣኑ በዘር ጥራት ደረጃ ዝግጅት ከኢትዮጵያ ደረጃዎች ኢንስቲትዩት ጋር በትብብር ይሰራል፡፡ ፫/ የወጣ የጥራት ደረጃ መተግበሩን ለማረጋገጥ ባለስልጣኑ እና የክልል ባለስልጣን የቁጥጥር ሥራ ያከናውናሉ፡፡ ፲፬. የዘር ጥራት ፍተሻ ላብራቶሪዎች ፩/ ባለስልጣኑ፡ ሀ) በሀገር ውስጥ የሚገኙ የዘር ላብራቶሪዎች በዓለም አቀፍ ደረጃ ተቀባይነት ያለው የዘር ጥራት ቁጥጥር የአሰራር ሥርዓት እንዲጠቀሙ ያመቻቻል፤ ለ) የዘር ላብራቶሪዎች አግባብ ባለው ሀገር አቀፍ ወይም ዓለም አቀፍ አካል እውቅና እንዲያገኙ መስፈርቶች ያስተዋውቃል፤ ይደግፋል፤ ሐ) በዓለም አቀፍ ደረጃ ተቀባይነት ያለው ሀገራዊ የዘር ላብራቶሪ ያቋቁማል፤ ወይም ይሰይማል፤ መ) በክልል የሚገኙ የመንግስት ወይም የግል ወይም የማህበራት ዘር ላብራቶሪዎች ደረጃቸውን የጠበቁ መሆናቸውን በየጊዜው ያረጋግጣል፤ ሠ) የክልል ባላስልጣን የዘር ላቦራቶሪዎች የፍተሻ ብቃት ለመገምገም ናሙና ይወስዳል፤ ሀገራዊ የፍተሻ አሰራር መጣጣም እንዲኖርም በትብብር ይሰራል፡፡ PART FOUR SEED QUALITY CERTIFCATION 13. Seed Quality Standards 1/ The Authority shall set seed quality standards. 2/ Without prejudice to Sub-Article (1) of this Article, the Authority may cooperate with Ethiopian standard Institute in preparation of seed quality standard. 3/ The Authority and the Regional Authority shall perform inspection to ensure implementations of the ratified quality standards. 14. Seed Quality Testing Laboratories 1/ The Authority shall: a) facilitate adoption of internationally recognized seed quality control system within all seed laboratories of the country; b) promote requirements and support accreditation of seed laboratories by an appropriate national or international body; c) establishes or designates an internationally recognized seed laboratory; d) regularly approves whether Regional seed laboratories, owned by Regional States or private seed firms or cooperatives, are in conformity with standards; e) collaborates with Regional Authority towards national harmonization; and draws duplicate samples to evaluate testing proficiency. ፲፬ሺ፰፻፬ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14805 ፪/ የዘር ላቦራቶሪዎች በናሙና አውጭ ወይም በኢንስፔክተር በሚቀርብላቸው ናሙና መሰረት በላቦራቶሪ አናሊስት አማካይነት የጥራት እና ጤንነት ፍተሻ ያከናውናሉ፤ ውጤቱን ይገልጻሉ፡፡ ፲፭. የዘር ጥራት ኢንስፔክሽን ፩/ የዘር ኢንስፔክሽን፡ ሀ) በሀገር ውስጥ ተመርቶ ለውጭ ገበያ ለሚቀርብ ዘር በሚመረትበት ወይም በሚዘጋጅበት ቦታ በባለስልጣኑ ይከናወናል፤ ለ) በሀገር ውስጥ ተመርቶ ለአገር ውስጥ ገበያ የሚቀርብ ዘር በሚመረትበት ወይም በሚዘጋጅበት ወይም በሚሸጥበት ቦታ በክልል ባለስልጣን ይከናወናል፤ ሐ/ ህገ ወጥ የዘር ግብይትን ለመቆጣጠር በክልል ባለስልጣን እና እንደአስፈላጊነቱ በባለሰልጣኑ ይከናወናል፤ ዝርዝር አፈጻጸሙ በሚኒስቴሩ መመሪያ ይወሰናል፡፡ ፪/ ባለስልጣኑ እና እያንዳንዱ የክልል ባለስልጣን የዚህን አዋጅና በአዋጁ መሠረት የወጣ ደንብንና መመሪያን ተፈፃሚነት ለማረጋገጥ እንደአስፈላጊነቱ የግል ወይም የመንግስት የዘር ኢንስፔክተሮችን ይሰይማሉ፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) መሠረት የተመደበ የዘር ኢንስፔክተር፡ ሀ) ከዘር ጥራት ደረጃዎች ጋር የተጣጣመ መሆኑን በምርመራ ለማረጋገጥ የዘር ናሙና ይወስዳል፤ ለዘር ላቦራቶሪ ያስረክባል፤ ለ) በዚህ አዋጅና በአዋጁ መሠረት ለወጡ ደንቦችና መመሪያዎች አፈጻጸም አግባብነት ያላቸው የምስክር ወረቀቶች፣ የማስገቢያ ፈቃዶች፣ መዛግብቶችና ሌሎች ሰነዶች እንዲቀርቡለት መጠየቅና መመርመር እንዲሁም ኮፒ ማድረግ ይችላል፤ 2/ Seed laboratories shall perform quality and health tests by a laboratory seed analyst based on samples submitted by inspectors or samplers and report results; details shall be prescribed in Directives. 15. Seed Quality Inspection 1/ Seed quality inspection shall be done: a) by the Authority at production site or processing plant for seed produced locally for export purpose; b) by Regional Authority at production or processing or selling sites for seed produced locally for domestic market; c) to control illegal seed trade by Regional Authority and as deemed necessary by the Authority; details shall be prescribed by a Directive. 2/ The Authority and each Regional Authorities shall assign private or public seed inspectors to ensure implementation of this Proclamation; and Regulations and Directives to be issued based on this Proclamation hereafter. 3/ any seed inspector assigned pursuant to Sub Article (2) of this Article: a) draws seed sample and submit to seed laboratory to test its conformity to seed standards; b) inspects certificates, import permits, compiled records and other relevant documents to ensure compliances with this Proclamation; Regulations and Directives issued hereunder, and make copies thereof; ፲፬ሺ፰፻፭ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14806 ሐ) በዚህ አዋጅና በአዋጁ መሠረት የወጡ ደንቦችና መመሪያዎች መከበራቸውን ለማረጋገጥ በማናቸውም የመንግስት የስራ ሰዓት ወደ ማናቸውም ዘር ማምረቻ ቦታ፣ ዘር መጋዘን ወይም ዘር ማዘጋጃ ተቋም በመግባት ወይም በማናቸውም ሰዓት ማንኛውንም ዘር የጫነ ተሽከርካሪ በማስቆም ኢንስፔክሽን ማካሄድ ይችላል፤ መ) ኢንስፔክሽን ሲያካሂድ ከባለስልጣኑ ወይም ከክልል ባለሥልጣን የተሰጠውን የመታወቂያ ካርድ ለሚመለከተው ሰው ማሳየት አለበት፤ ሠ) የዘር ኢንስፔክተር የዘር ኢንስፔክሽን ሲያከናውን ጉዳዩ የሚመለከተው ሰው የመተባበር ግዴታ አለበት፤ ፬/ ባለስልጣኑ በሀገር አቀፍ ደረጃ ተመሳሳይ የሆነ የኢንስፔክሽን አሠራር ስርዓት እንዲኖር ያደርጋል፤ እንደ አስፈላጊነቱም ለክልሎች የጥራት ቁጥጥር ሥልጠናና ድጋፍ ይሰጣል፡፡ ፲፮. የዘር ጥራት ማረጋገጥ ፩/ የዘር ጥራት ማረጋገጥ በአራቢ ዘር፣ በቅድመ መስራች ዘር፣ በመስራች ዘር፣ በተመሰከረለት አንደኛ፣ ሁለተኛ እና ሦስተኛ የዘር ደረጃ እንዲሁም ጥራቱ በተገለጸ እና በአስቸኳይ ጊዜ ዘር ላይ ተግባራዊ ይሆናል፡፡ ፪/ የዘር ጥራት ማረጋገጥ በሚከተሉት አማራጮች ሊከናወን ይችላል፡ ሀ) ሙሉ በሙሉ በባለስልጣኑ ወይም በክልል ባለስልጣን፤ ለ) ጥራቱ በተገለጸ ዘር ጥራት ማረጋገጥ፤ ሐ) በራስ አገዝ የዘር ጥራት ማረጋገጥ፤ ወይም መ) በሶስተኛ ወገን የዘር ጥራት ማረጋገጥ፡፡ c) enters, at working hours, to any seed field, seed store or processing plant, or at any time stop a vehicle which carries seed, and undertake inspection to verify compliance with this Proclamation; Regulations and Directives issued hereunder; d) shall show his identity card, issued by the Authority or the Regional Authority, to concerned person to undertake seed inspection; e) The concerned person shall cooperate with a seed inspector in the course of seed inspection undertaken. 4/ The Authority shall ensure harmonized inspection procedures throughout the country and provide inspection training and support to Regional Authorities, as deemed necessary. 16. Seed Quality Certification 1/ Shall be applied on breeder seed, pre-basic seed, basic seed, and on certified seed class 1 st , 2 nd , 3 rd , quality declared seed and emergency seed. 2/ May be carried out with the following quality assurance options: a) fully by the Authority or Regional Authority; or b) quality declared seed certification scheme; or c) self-seed certification scheme; or d) third-party seed certification scheme. ፲፬ሺ፰፻፮ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14807 ፫/ የክልል ባለስልጣን፡ ሀ) በክልሉ ለሚመረት፣ ለሚዘጋጅ፣ለሚከማች እና ለሀገር ውስጥ ገበያ የሚቀርብን እና ሙሉ በሙሉ በክልሉ ባለስልጣን ቁጥጥር አንዲደረግበት የተወሰነን ዘር ጥራት ያረጋግጣል፤ ለ) ጥራቱ የተገለጸ ዘር ጥራትን ያረጋግጣል፤አፈጻጸሙም በመመሪያ ይገለጻል፡፡ ሐ) ለራስ አገዝ ወይም ለሶስተኛ ወገን ጥራት ማረጋገጥ አገልግሎት ለመሰማራት ለሚፈልግ ሰው የብቃት ማረጋገጫ የምስክር ወረቀት ይሰጣል፤ አፈጻጸሙን ይቆጣጠራል፡፡ዝርዝሩ በመመሪያ ይገለጻል፡፡ ፬/ ባለስልጣኑ፡ ሀ) ከውጭ የሚገባ ዘር ከኢትዮጵያ ዘር ጥራት ደረጃዎች ጋር መጣጣሙን ያረጋግጣል፤ ለ) በሀገር ውስጥ ተመርቶ ለውጭ ገበያ የሚቀርብ ዘር ከተቀባዩ ሀገር ወይም እንደ አሰፈላጊነቱ ከዓለም አቀፍ ጥራት ደረጃ ጋር መጣጣሙን ያረጋግጣል፤ ሐ) ከሀገር ውጭ ለተቋቋሙ ለማናቸውም ከኢትዮጵያ ዘር ጥራት ምርመራና ማረጋገጥ ሥርዓት ጋር ተመሳሳይነት አላቸው ብሎ ላመነባቸው የዘር ጥራት አረጋጋጭ ድርጅቶችና ለምርመራ ውጤታቸው እውቅና ሊሰጥ ይችላል፤ መ) በክልል ባለስልጣን ሲጠየቅ በአንድ ክልል መመረቱ ተረጋግጦ በሌላ ክልል ለሚከማች ዘር የላቦራቶሪ ፍተሻ አገልግሎት ይሰጣል፤ የዘር ጥራት ደረጃ ላሟላ ዘር የጥራት ማረጋገጫ የምስክር ወረቀት እና ምልክት ይሰጣል፡፡ 3/ The Regional Authority: a) shall certify Regionally produced seed, processed, stored and supplied for domestic market; and seed that is decided to be controlled for quality fully by the Regional Authority; b) shall certify quality declared seed; in which its detail shall be prescribed in a Directive; c) may issue certificate of competency for self seed certification or for a person who apply for a third-party seed certification services and controls its implementation; details shall be prescribed in a Directive. 4/ The Authority: a) shall approve the compliance of imported seeds to seed quality standards of Ethiopia; b) shall approve the quality of locally produced seed for export market is in conformity with the standards of the recipient country; or as deemed to be necessary to international quality standards; c) may recognize any foreign competent seed certification agency and the results of its tests when it ascertains that it is in conformity with the Ethiopian seed quality testing system; d) upon request by Regional Authority, shall provide seed laboratory testing service for seed produced in one Region but stored in another Region; and issue certificate of seed quality and label to a seed in conformity with seed quality standards. ፲፬ሺ፰፻፯ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14808 ፭/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) የተገለጹትን የጥራት ማረጋገጥ አማራጭ አሰራሮች እና ዝርዝር አፈጻጸም በመመሪያ ይገለጻል፡፡ ፲፯. የዘር ጥራት ማረጋገጫ የምስክር ወረቀት ፩/ የክልል ባለሥልጣን በክልሉ ውስጥ ተመርቶና ተዘጋጅቶ ለሀገር ውስጥ ገበያ የሚቀርብ ዘር፡ ሀ) ዝርያው በብሔራዊ የዝርያ መዝገብ ውስጥ የተመዘገበ መሆኑን፤ ለ) የብቃት ማረጋገጫ የምስክር ወረቀት በተሰጠው ሰው የተመረተና የተዘጋጀ መሆኑን፤ ሐ) በዚህ አዋጅ መሰረት ጥራቱ የተፈተሸና ከዘር ጥራት ደረጃም ሆነ ከሌሎች መስፈርቶች ጋር የተጣጣመ መሆኑን፤ ሲያረጋግጥ የዘር ጥራት ማረጋገጫ ምስክር ወረቀት ለጸደቀ ዘር ይሰጣል። ፪/ ባለስልጣኑ ከውጭ የገባ ዘር፡ ሀ) በብሔራዊ የዝርያ መዝገብ ከተመዘገበ ዝርያ የተገገኘ ዘር መሆኑን፤ ለ) የብቃት ማረጋገጫ የምስክር ወረቀት በተሰጠው የዘር አስመጪ የገባ መሆኑን፤ ሐ) በዚህ አዋጅ መሰረት የተመረመረና ከዘር ጥራት ደረጃ ጋር የተጣጣመ መሆኑን፤ መ) አዋጁን ተከትሎ በሚወጣ ደንብና መመሪያ የተወሰኑ ሌሎች መስፈርቶችን የሚያሟላ መሆኑን፤ ሲያረጋግጥ የዘር ጥራት ማረጋገጫ ምስክር ወረቀት ይሰጣል። 5/ Shall prescribe in a ministerial Directive about seed quality certification schemes, illustrated under Sub-Article (2) of this Article, and their implementation details. 17. Certificate of Seed Quality Approval 1/ Each Regional Authority shall issue a seed quality certificate for seed produced and processed and supplied to domestic market confirming that: a) the variety is listed in the national variety registry book; b) the seed is produced and processed by a person holding a certificate of competence; c) the seed is inspected and tested in accordance with this Proclamation and found to be in conformity with the applicable seed quality standards and other requirements; 2/ The Authority shall issue a certificate of seed quality assurance for imported seed, ascertaining that the seed: a) is produced from a variety listed in the national variety registry book; b) is imported by a seed importer with certificate of competence; c) is quality tested in accordance with this Proclamation and found to be in conformity with seed quality standards; d) the seed fulfills any other requirement as may be prescribed by Regulations and Directives issued following this Proclamation. ፲፬ሺ፰፻፰ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14809 ፫/ ባለስልጣኑ ወደ ውጭ የሚላክ ዘር፡ ሀ) በብሔራዊ የዝርያ መዝገብ የተመዘገበ ዝርያ መሆኑን ወይም ሳይመዘገብ ተባዝቶ ወደ ውጭ እንዲላክ የተፈቀደለት ዝርያ መሆኑን፤ ለ) የተመረተውና የተዘጋጀው የብቃት ማረጋገጫ የምስክር ወረቀት በተሰጠው ሰው መሆኑን፤ እና ሐ) አዋጁን ተከትሎ በሚወጣ ደንብና መመሪያ የተወሰኑ ሌሎች መስፈርቶችን የሚያሟላ መሆኑን፤ ሲያረጋግጥ የዘር ጥራት ማረጋገጫ የምስክር ወረቀት ይሰጣል። ፬/ ማንኛውም የዘር ጥራት ማረጋገጫ የምስክር ወረቀት፡ ሀ) በሀሰተኛ፣ በተሳሳተ ወይም ባልተሟላ መረጃ የተገኘ ከሆነ፤ ወይም ለ) የቅድመ ወይም ድህረ ቁጥጥር ሙከራ ወይም የድጋሜ የዘር ላቦራቶሪ ፍተሻ ተካሂዶ የዘር ጥራት ደረጃዎች አሟልቶ ካልተገኘ፤ ይሰረዛል፡፡ ፭/ ባለስልጣኑ ወይም የክልል ባለስልጣን የዘር ጥራት ምስክር ወረቀት ከመሰረዙ በፊት ለባለቤቱ በማሳወቅ ቅሬታው የሚደመጥበትን እድል ይሰጠዋል፡፡ ፲፰. የዘር ጥራት ማረጋገጫ መለያ ምልክት ስለማድረግ ማንኛውም ዘር የባለስልጣኑ ወይም የክልል ባለስልጣን የዘር ጥራት ማረጋገጫ መለያ ምልክት ሳይደረግበት ለሀገር ውስጥ ወይም ለውጭ ገበያ ሊቀርብ አይችልም፡፡ 3/ The Authority shall issue a certificate of quality to a seed for export market after ascertaining that the seed: a) is produced from a variety listed in the National variety registry book; or it is produced exclusively for export without listing of the variety in the variety regstry; b) is produced and processed by a person with a certificate of competence; and c) fulfills any other requirement as may be prescribed by Regulations and Directives issued following this Proclamation. 4/ Any certificate of seed quality assurance may be revoked if: a) it is obtained on the basis of false, misleading or incomplete information; or b) the seed doesn’t not meet seed quality standards following a pre or post control tests or any other seed laboratory re-testing. 5/ Prior to revoking a certificate of seed quality, the Authority or Regional Authority shall notify the holder of the certificate and give him an opportunity to be heard. 18. Labeling No seed may be supplied to domestic or export market unless labeled with seed quality assurance certificate label of the Authority or Regional Authority. ፲፬ሺ፰፻፱ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14810 ፲፱. ቅድመ ወይም ድህረ ቁጥጥር የክልል ባለስልጣን ማንኛውም የጸደቀ ዘር፡ ፩/ የቀጣይ ዘር ደረጃ ለማምረት ተግባር ከመዋሉ በፊት በጥራቱ ላይ በቂ መረጃ ማሰባሰብ አስፈላጊ ሆኖ ሲገኝ የቅድመ-ጥራት ፍተሻ ያካሂዳል፤ የተገኘው ውጤት ከዘር ጥራት ደረጃ ጋር ካልተጣጣመ የጸደቀው ዘር ለቀጣይ ዘር ደረጃ ብዜት አንዳይውል ያደርጋል፤ ፪/ የጥራት ደረጃ መስፈርት ሳያሟላ የጥራት ማረጋገጫ መሰጠቱን ወይም መቀየጡን ለመጠርጠር ምክንያት ሲኖር ከተሰራጨው ዘር ላይ ናሙና ወስዶ ድህረ ቁጥጥር ፍተሻ ያካሂዳል፤ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) መሰረት የተገኘው ውጤት ከዘር ጥራት ደረጃ ጋር ካልተጣጣመ ሥርጭት እንዲቋረጥ ያደርጋል፤ ተጎጂዎችም የሚካሱበትን ሁኔታ ያመቻቻል፤ ይህም በሚኒስትሮች ምክር ቤት ደንብ ይወሳናል፡፡ ፳. የዘር ጥራት ደረጃ ስለማያሟላ ዘር ፩/ ፍተሻ የተደረገበት ዘር የጥራት ደረጃ መስፈርቶችን ካላሟላ የዘር ጥራት ደረጃው ዝቅ እንዲል ወይም ውድቅ እንዲሆን ይደረጋል፡፡ ፪/ የዕጽዋት ዘር ውድቅ እንዲሆን የተደረገበት ማንኛውም ሰው የሚከተሉት የመጠቀም አማራጮች ሊሰጡት ይችላሉ፡ ሀ) በሰው፣ በአንስሳት፣ በአካባቢ እና በአጎራባች ዕጽዋት ላይ አሉታዊ ተጽዕኖ እንደ ሌለው በባለስልጠኑ ወይም በክልል ባለስልጣን ሲረጋገጥ በራሱ መሬት ላይ መዝራት፤ ወይም ለ) የዕጽዋት ዘሩ በበሽታ ካልተበከለ እና በኬሚካል ካልታሸ ለምግብነት ወይም ለመኖነት እንዲውል ማድረግ፡፡ 19. Pre and Post-Control The Regional Authority on approved, may carry out: 1/ A pre-control test to collect enough data on its quality before permitting further multiplication to produce the next seed class; and rejects the non-conforming approved seed from further multiplication; 2/ A post control test taking sample from market, if there is a reason to suspect issuance of seed quality certificate for non-conforming approved seed or adulteration; 3/ Cancelation, according to Sub-Article (2) of this Article, further distribution and use; and facilitate compensation procedures for seed users affected by non-conforming seed with the standards; Compensation details shall be prescribed by the Regulation of Council of Ministers. 20. Non-Conforming Seed 1/ If a seed fails to meet seed quality standards and requirements, it shall be either downgraded or rejected. 2/ Any person whose seed has been rejected shall be given the option to: a) use it for planting on his own fields; verifying that it has no harmful effect on humans, animals, environment or nearby plants; b) sale it for use as food or feed, unless the seed is found to be treated with chemicals, contaminated with disease or otherwise unfit for such use. ፲፬ሺ፰፻፲ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14811 ፫/ ውድቅ እንዲሆን የተደረገ ዘር በዚህ አንቀጽ ንዑስ አንቀጽ (፪) መሠረት በጥቅም ላይ ሊውል የማይችል ሆኖ ሲገኝ እንዲወገድ ይደረጋል፡፡ ፳፩. የዕጽዋት ዘር ከውጭ ስለማስገባትና ወደ ውጭ ስለመላክ ማንኛውም ሰው፡ ፩/ ዘር ከውጭ ሀገር አስገብቶ የሚያከፋፍል ወይም ወደ ውጭ የሚልክ ከሆነ ከባለስልጣኑ የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አለበት፤ ፪/ የማስገቢያ ወይም የመላኪያ ፈቃድ ከባለስልጣኑ ካልተሰጠው በስተቀር ዘርን ወደ ሀገር ውስጥ ማስገባት ወይም ወደ ውጭ መላክ አይችልም፤ ፫/ ለዘር ማባዛት ዓላማ ወደ ሀገር ውስጥ የሚገባ የማንኛውም ዝርያ ዘር አስመልክቶ በዚህ አዋጅ አንቀጽ (፬) ሥር በተገለጸው መሰረት ተግባራዊ መሆን አለበት፤ ፬/ በዚህ አንቀጽ ከንዑስ አንቀጽ (፩-፫) የተገለጸው አንደተጠበቀ ሆኖ ዘር ከውጭ ሀገር አስገብቶ ከዘር ማምረት እና ግብይት ውጭ ለሆነ አገልግሎት የሚያውለው ከሆነ የብቃት ማረጋገጫ የምስክር ወረቀት ማግኘት አይጠበቅበትም፤ ፭/ ልውጥ ህያው ያለው ዘር ወደ ሀገር ውስጥ ሊያሰገባ የሚችለው አግባብ ካለው ሕግ ጋር ሰለመጣጣሙ ሲረጋግጥ ይሆናል፤ ፮/ ገደብ የተጣለበትን ዘር ወደ ውጭ ሀገር መላክ ወይም ወደ ሀገር ውስጥ ማስገባት አይችልም፤ ፯/ በሁለተኛው ትውልድ ራሱን የማይደግም ዘረ-መል ቴክኖሎጂ ያለበትን ዘር ወደ ሀገር ውስጥ ማስገባት አይችልም፡፡ ፳፪. የአስቸኳይ ጊዜ ዘር ስለማቅረብ በኢትዮጵያ ውስጥ አጣዳፊ የዘር እጥረት ሲያጋጥም ሚኒስቴሩ የአስቸኳይ ጊዜ የዕጽዋት ዘር እጥረት መፈጠሩን በይፋ የማሳወቅና ችግሩ ላጋጠማቸው አካባቢዎች እንዲቀርብ የመፍቀድ ሥልጣን ይኖረዋል፤ ዝርዝር አፈጻጸሙ በሚኒስቴሩ መመሪያ ይወሰናል፡፡ 3/ Where a rejected seed cannot be used, pursuant to Sub-Article (2) of this Article, shall be disposed off. 21. Import and Export of Seed Any person: 1/ Shall hold certificate of competency from Authority to engage in import for wholesale or export seed; 2/ Shall not import or export without an import or export permit issued by the Authority; 3/ Import of any variety of seed for multiplication purposes shall be done in accordance with Article 4 of this Proclamation; 4/ Without prejudice the provisions under this Article Sub-Article (1-3), shall not be expected to hold certificate of competency for importing seed for other uses other than seed production and marketing; 5/ To import seed with modified organism, it shall e its compliance to applicable laws; 6/ Shall not import or export restricted seed; or 7/ Shall not import any seed that does not reproduce itself. 22. Supply of Emergency Seed In case of an acute seed shortage in Ethiopia, the Ministry shall have the power to officially declare a seed emergency and authorize the supply of emergency seed to affected areas of the country; details shall be stated in the Ministry Directive. ፲፬ሺ፰፻፲፩ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14812 ክፍል አምስት የብቃት ማረጋገጫ የምስክር ወረቀት አስተዳደር ፳፫. የብቃት ማረጋገጫ የምስክር ወረቀት ስለማግኘት ፩/ ማንኛውም ሰው የብቃት ማረጋገጫ ለማግኘት ለባለስልጣኑ ወይም ለክልል ባለስልጣን ማመልከቻ ማቅረብ አለበት፡፡ ፪/ ባለስልጣኑ ወይም የክልል ባለስልጣን የብቃት ማረጋገጫ ለማግኘት የቀረበለትን ማመልከቻ መርምሮ እና በመስክ ኢንስፔክተር ወይም አንደ አስፈላጊነቱ የላቦራቶሪ አናሊስት ልኮ በማረጋገጥ አመልካቹ መስፈርቶች የሚያሟላ መሆኑን ሲያረጋግጥ የተጠየቀውን የምስክር ወረቀት ይሰጣል፡፡ ፫/ ባለስልጣኑ ወይም የክልል ባለስልጣን የአመልካቹ የብቃት ማረጋገጫ ጥያቄ ተቀባይነት ያላገኘ ከሆነ የክልከላውን ምክንያት በመግለጽ ለአመልካቹ ማሳወቅ አለበት፡፡ ፬/ የብቃት ማረጋገጫ አሰጣጥ መስፈርትን፣ የምስክር ወረቀት ጸንቶ የሚቆይበት ጊዜና የሚታደስበት ሁኔታ በሚኒሲቴሩ መመሪያ ይወሰናል፡፡ ፳፬. የብቃት ማረጋገጫ የምስክር ወረቀትን ስለማገድና መሰረዝ ፩/ የብቃት ማረጋገጫ የምስክር ወረቀት የተሰጠው ማንኛውም ሰው፡ ሀ) የምስክር ወረቀቱ የተሰጠባቸውን ሁኔታዎች ጠብቆ ማቆየት ካልቻለ፤ ወይም PART FIVE ADMINISTRATION OF CERTIFICATE OF COMPETENCE 23. Acquiring of Certificate of Competence 1/ Any person to acquire a certificate of competency shall submit an application to the Authority or Regional Authority. 2/ The Authority or Regional Authority shall issue certificate of competency examining the application submitted for obtaining a certificate of competence and conforming the application at field level sending a field inspector, or as deemed necessary a laboratory seed analyst, ascertaining that the applicant satisfies the requirements. 3/ When any application for a certificate of competence is rejected, the Authority or Regional Authority shall communicate the applicant by stating the reasons thereof. 4/ The requirements for issuance & duration of validity of certificates of competence and conditions of their renewals shall be prescribed by a Directive. 24. Suspension and Revocation of Certificate of Competence 1/ Where any person holding a certificate of competence: a) fails to maintain the conditions for which the certificate of competence was issued; or ፲፬ሺ፰፻፲፪ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14813 ለ) ይህን አዋጅ ወይም አዋጁን ለማስፈጸም የወጣ ደንብን ወይም መመሪያን ተላልፎ ሲገኝ፤ ባለስልጣኑ ወይም የክልል ባለስልጣን ጉድለቶቹን ተገቢ በሆነና ተለይቶ በተገለጸ የጊዜ ገደብ ውስጥ እንዲያስተካክል በማስገንዘብ የምስክር ወረቀቱን አግዶ ሊያቆየው ይችላል። ፪/ ባለስልጣኑ ወይም የክልል ባለስልጣን የብቃት ማረጋገጫ የምስክር ወረቀቱን በሚከተሉት ምክንያቶች ይሰርዛል፡ ሀ) የምስክር ወረቀቱን ያገኘው ሀሰተኛ ማስረጃ በማቅረብ ሆኖ ከተገኘ፤ ለ) በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት ለምስክር ወረቀቱ መታገድ ምክንያት የሆነውን ጉድለት ያለበቂ ምክንያት በተሰጠው የጊዜ ገደብ ውስጥ ማስተካከል ካልቻለ፤ ወይም ሐ) የዚህን አዋጅ ድንጋጌዎች በመተላለፍ የወንጀል ድርጊት ፈጽሞ ከተገኘ፡፡ ፫/ ባለስልጣኑ ወይም የክልል ባለስልጣን የብቃት ማረጋገጫ የምስክር ወረቀቱን እንደሰረዘ በምስክር ወረቀቱ ላይ ተመስርቶ የተሰጠው የንግድ ፈቃድ እንዲሰረዝ ለሚመለከተው ፈቃድ ሰጭ አካል በጽሁፍ ያሳውቃል፤ ባለስለልጣኑ ወይም የክልል ባለስልጣን የንግድ ፈቃዱ እንዲሰረዝ የሚያሳውቅበትን የጊዜ ገደብ በሚኒስቴሩ መመሪያ ይወሰናል፡፡ ፳፭. መረጃ ስለመያዝና ተደራሽ ስለማድረግ ማንኛውም የብቃት ማረጋገጫ የምስክር ወረቀት ያገኘ ሰው፡ ፩/ የእያንዳንዱን ዘር የማምረቻ ቦታ፣ የተመረተ፣ የተዘጋጀ፣ ከውጭ ያስመጣውን፣ ወደ ውጭ የላከውን፣ ያከፋፈለውን ወይም የቸረቸረውን ዘር በዝርዝር መዝግቦ መያዝ ይኖርበታል፤ b) contravenes with any provision of this Proclamation or Regulation or Directive issued hereunder; the Authority or the Regional Authority may suspend the certificate of competence and instruct the holder to rectify the irregularities within a specified period. 2/ The Authority or the Regional Authority shall revoke any certificate of competence where the holder of the certificate: a) is found to have obtained the certificate of competence upon presentation of false evidence; b) in the case of suspension under Sub-Article (1) of this Article, fails to rectify the irregularities, without sufficient reason, within the specified time limit; or c) has committed an offence against the provisions of this Proclamation. 3/ The Authority or the Regional Authority, upon revoking a certificate of competence, shall notify, in writing, to the eligible body that issued a business license based on the certificate in question; The deadline for notifying cancelation of certificate of competency shall be prescribed by the Directive of the Ministry. 25. Data Documentation and Access Any holder of a certificate of competence shall: 1/ Document and keep particular data of each field and seed produced, processed, imported, exported, wholesaled or retailed, as the case may be; ፲፬ሺ፰፻፲፫ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14814 ፪/ እነዚህን መረጃዎች በባለስልጣኑ ወይም በክልል ባለስልጣን ሲጠየቅ ማቅረብ አለበት። ክፍል ስድስት ልዩ ልዩ ድንጋጌዎች ፳፮. ስለ ትብብር ፩/ ይህን አዋጅና በአዋጁ መሠረት የሚወጣ ደንብና መመሪያ ወጥነት ባለው መልኩ ለመተግበር እንዲቻል ባለስልጣኑ እና የክልል ባለስልጣን፤ እንዲሁም የክልል ባለስልጣናት እርስ በርሳቸው በትብብር ይሰራሉ፤ ፪/ ባለስልጣኑ ሀገራዊ የዝርያና የዘር ጥራት ቁጥጥር ሥርዓት ወጥነት በክልሎች መካከል ለማስፈን ዓመታዊ የጋራ መድረክ ሊያደራጅ ይችላል፤ ፫/ ይህን አዋጅና በአዋጁ መሠረት የሚወጣ ደንብና መመሪያ ለመተግበር በሚያስችል መልኩ ሚኒስቴሩ እና ቢሮ የየራሳቸውን የዘር አማካሪና አስተባባሪ አካላትን ሊያደራጁ ይችላሉ፤ አፈጻጸሙም በሚኒስቴሩ መመሪያ ይወሰናል፡፡ ፬/ የፌደራል እና የክልል መንግስታት፡ ሀ) በዘር ዘርፉ ለተሰማሩ ወይም ለሚሰማሩ የዘር አምራች እና ግብይት ድርጅቶች ወይም ተቋማት የማበረታቻ ሥርዓት በትብብር ይዘረጋሉ፤ ለ) ብሔራዊ የዘርያ ብቃት ማረጋጋጫ፣ የዝርያ ባህሪ ፍተሻ፣ የቅድመ እና ድህረ ቁጥጥር ተግባራትን ለማከናወን የሚያስችሉ የሙከራ ጣቢያዎች እንዲቋቋሙ በጋራ ይሰራሉ፡፡ ፳፯. ስለ ቅሬታ አቀራረብ የቅሬታ አቀራረብን በተመለከተ በአስተዳደር ሥነ ሥርዓት አዋጅ ቁጥር ፩ሺ፩፻፹፫/፪ሺ፲፪ መሰረት ተፈጻሚ ይሆናል፡፡ 2/ Provide such data upon request by the Authority or Regional Authority. PART SIX MISCELLANEOUS PROVISIONS 26. Cooperation 1/ The Regional Authorities shall collaborate with the Authority and among themselves to ensure harmonized implementation of this Proclamation and Regulations and Directives issued hereunder with. 2/ The Authority may regularly organize annual platform to ensure harmonized variety and seed quality control system at national level. 3/ The Ministry and the Bureau may establish their respective seed advisory and coordination bodies to ensure full implementation of this Proclamation, Regulations and Directives issued hereunder; details shall be prescribed by a Directive. 4/ The Federal & Regional Governments shall in collaboration: a) put an incentive mechanism in place for already engaged seed producers and marketers and for those to engage hereafter; b) work together to establish trial stations for National Variety Performance testing, for variety examination, pre and post control tests. 27. Grievance Procedure Grievance procedures shall be executed according to the Federal Administrative Procedure Proclamation No.1183 /2020. ፲፬ሺ፰፻፲፬ gA Ød‰L ነU¶T Uz¤È qÜ R ፴ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ›.M Federal Negarit Gazette No. 30, 24th July, 2023 ………..page 14815 ፳፰. ወንጀል እና ቅጣት የዚህን አዋጅ ድንጋጌ እንዲሁም ይህን አዋጅ ተክትሎ የሚወጣ ደንብና መመሪያ የተላለፈ ማንኛውም ሰው አግባብ ባለው የወንጀል ሕግ ተጠያቂ ይሆናል፡፡ ፳፱. ደንብና መመሪያ የማውጣት ስልጣን ፩/ የሚኒስትሮች ምክር ቤት ይህን አዋጅ ለማስፈጸም የሚያስፈልግ ደንብ ሊያወጣ ይችላል። ፪/ ሚኒስቴሩ ይህን አዋጅ እና አዋጁን ተከትሎ የሚወጣ ደንብ ለማስፈጸም የሚያስፈልግ መመሪያ ሊያወጣ ይችላል፡፡ ፴. የተሻሩ ሕጎች የዕፅዋት ዘር አዋጅ ቁጥር ፯፻፹፪/፪ሺ፭ በዚህ አዋጅ ተሽሯል። ፴፩. አዋጁ የሚጸናበት ጊዜ ይህ አዋጅ በፌደራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡ አዲስ አበባ ሐምሌ ፲፯ ቀን ፪ሺ፲፭ ዓ.ም ሣህለ-ወርቅ ዘውዴ የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፕሬዚዳንት 28. Offences and Penalties Any person, who contravenes the provisions of this Proclamation and Regulations and Directives issued hereunder, shall be made accountable by an eligible criminal law. 29. Power to Issue Regulation and Directive 1/ The Council of Ministers may issue Regulations necessary for the implementation of this Proclamation. 2/ The Ministry may issue Directives necessary for the implementation of this Proclamation and Regulations to be issued hereunder. 30. Repealed Laws The Seed Proclamation No.782/2013 is hereby repealed. 31. Effective Date This Proclamation shall enter into force on the date of its publication in the Federal Negarit Gazette.
