3. Establishment ፫. መቋቋም 1/ The Reconciliation Commission (hereinafter ፩/ የዕርቀ-ሰላም ኮሚሽን (ከዚህ በኋላ ኮሚሽን referred to as” The Commission“) is hereby እየተባለ የሚጠራ) በዚህ አዋጅ ተቋቁሟል። established by this Proclamation. 2/ The Commission shall have its own office, ፪/ ኮሚሽኑ የራሱ ጽሕፈት ቤት፣ በጀት እና አስፈላጊ budget and necessary staff. የሆኑ ሠራተኞች ይኖሩታል፡፡ 3/ Office of the Commission shall have legal ፫/ የኮሚሽኑ ጽሕፈት ቤት ሕጋዊ ሰዉነት አለው፡፡ personality. 4/ The Commission shall be accountable to the ፬/ የኮሚሽኑ ተጠሪነት ለጠቅላይ ሚኒስትሩ ይሆናል፡፡ Prime Minister. ፬. የኮሚሽኑ አባላትና አሰያየም 4. Appointment of members of the Commission 1/ Number of members of the commission shall ፩/ የኮሚሽኑ አባላት ቁጥር በመንግስት የሚወሰን be determined by the government ይሆናል፡፡ 2/ Chairperson, Deputy Chairperson and other ፪/ የኮሚሸኑ ሰብሳቢ፣ ምክትል ሰብሳቢ እና ሌሎች Members of the Commission shall, up on አባላት በጠቅላይ ሚኒስቴሩ አቅራቢነት በሕዝብ recommendation by the Prime Minister ተወካዮች ምክር ቤቱ ይሰየማሉ:: appointed by the House Of People’s Representative ፫/ የጽሕፈት ቤቱ ኃላፊ የኮሚሽኑ ፀሐፊ ሆኖ 3/ The Head Of The Office serve as the ያገለግላል:: Commission’s Secretariat. ፭. የኮሚሽኑ ዓላማ 5. Objectives of the Commission የኮሚሽኑ ዓላማ በኢትዮጵያ ህዝቦች መካከል ሰላም፣ Objective of the Commission is to maintain peace ፍትህ፣ ብሄራዊ አንድነትና መግባባት፣ እንዲሁም እርቅ justice, national unity and consensus and also እንዲሰፍን መስራት ነው፡፡ Reconciliation among Ethiopian Peoples. ፮. የኮሚሽኑ ሥልጣንና ተግባራት [[[[[[

6. Powers and Duties of the Commission ኮሚሽኑ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፦ The Commission shall have the following Powers and Duties: ፩/ ስራዉን በሚመለከት ማንኛዉም ያገባኛል የሚል 1/ Concerning its work announce and make every ሰው ወይም አካል ሃሳቡን እንዲያቀርብ ጥሪ concerned person or body to present his idea and ማቅረብ እና አስፈላጊውን ምዝገባ ማካሄድ፤ the necessary registration. 2/ Make its work accessible, participatory by using ፪/ ስራዉን በቴክኖሎጂ የተደገፈ በማድረግ ተደራሽ፣ technology; organize Reconciliation work shop in አሳታፊ፣ ሁሉም አካል እኩል ተደማጭ የሚሆንበት which all parties to be hear of; የዕርቀ-ሰላም ውይይት መድረክ ማዘጋጀት፤ ፲ሺ፱፻፹፭ gA Ød‰L ነU¶TUz¤È qÜ_R ፳፯ ጥር ፳፰ ቀን ፪ሺ፲፩ ዓ.ም Federal Negarit Gazette No 27, 5th, February 2019…….page 10985 ፫/ የተለያየ አቋም የያዙ የህብረተሰብ ክፍሎችን 3/ Identify principles and values which will be base በማወያየትና ለሃገራዊ እርቅ መሰረት የሚሆኑ for national Reconciliation by making discussion የጋራ መርህዎችንና እሴቶችን መለየት፤ with groups of society which have different view; ፬/ የግጭቶችንና የመብት ጥሰቶቹን መነሻ ምክንያት 4/ Make examination to identify the basic reasons of ለመለየት ፖለቲካዊ፣ ማህበራዊና ኢኮኖሚያዊ disputes and violations of human rights by taking አውዶችን፣ የተጎጂዎችንና ጥፋተኞቸን አስተያየት into consideration of political, social and economic በመወሰድ ማጣራት ማካሄድ፤ circumstances and the view of victims and offenders; ፭/ ለሰራው አስፈላጊ ነው ብሎ ያመነበትን 5/ To take or order presence of any document or ማንኛዉንም የሰነድ ወይም ሌላ መረጃ ለአገር information from government or anybody which ደህንነት ሲባል በሚስጥር እንዲጠበቁ በህግ ጥበቃ the commission deemed necessary for its work except those that are given legal protection as ከተደረገላቸው ውጪ ከመንግስትም ይሁን confidential for the sake of national security ; ከማናቸውም ሌላ አካላት የመቀበልና በፈለገው ጊዜ እንዲያቀርቡ የማዘዝ፤ ፮/ ሀላፊነቱን ለመወጣት የማናቸውንም ተቋም ይዞታ 6/ To visit premise of any institutions and to take የመጎብኘት፣ በጉብኝቱም ጊዜ የሚያገኛቸውን copy of any information and document found by its ማናቸውንም መረጃዎችና፣ ሰነዶችን ቅጂ visit; የመውስድ፤ ፯/ መረጃ ለመሰብሰብ በተናጠልም ሆነ በቡድን፣ 7/ To collect information make interview either በምስጢርም ሆነ ለሀዝብ ክፍት በሆነ ሁኔታ ቃለ individually or in a group in secret or in an open መጠይቅ ማድረግ፣ መጥሪያ በመላክ ማንኛዉም way to the public; order the presence of anyone through summon and require to give his statement ሰው እንዲቅርብ የማዘዝ እና ቃሉን በቃለ መሃላ through oath; እንዲሰጥ የማድረግ፤ ፰/ ሃላፊነቱን ለመወጣት እንድሁኔታው የፌደራልም 8/ Depending on the situations to get support from ሆነ የክልል ፖሊስ እገዛ የማግኘት፤ federal or regional state police to execute its duties; ፱/ በማጣራት የሚደርስባቸውን መደምደሚያዎች 9/ Notify to the public and concerned government እንደሁኔታው በየጊዜው ለህዘብና ለሚመለክታቸው organs the conclusions reached through the የመንግስት አካላት ማሳወቅ፤እና examination as appropriate; and ፲/ በህዝቦች መካከል የተፈጠረ ልዩነት እንዲረግብ እና 10/ Make Reconciliation among peoples to narrow መግባባት እንዲፈጠር እርቀ ሰላም እንዲወርድ the difference created and to create consensus. የማድረግ። ፲ሺ፱፻፹፮ 10986 gA Ød‰L ነU¶TUz¤È qÜ_R ፳፯ ጥር ፳፰ ቀን ፪ሺ፲፩ ዓ.ም Federal Negarit Gazette No 27, 5th, February 2019…….page ፯. የኮሚሽኑ ስብሰባ 7. Meetings of the Commission ፩/ የኮሚሽኑ መደበኛ ስብሰባ በየአስራ አምስት ቀኑ 1/ The Commission shall hold its regular meetings ይካሄዳል፣ ሆኖም እንደአስፈላጊነቱ በማናቸውም ጊዜ every fifteen days; provided, however that it may አስቸኳይ ስብሰባ ሊደረግ ይችላል፡፡ hold extraordinary meetings at any time where necessary. ፪/ ከኮሚሽኑ አባላት ከግማሽ በላይ የሚሆኑት ከተገኙ 2/ There shall be quorum where more than half of the ምልዓተ-ጉባኤ ይሆናል፡፡ members of the commission are present at a meeting. ፫/ የኮሚሽኑ ምክረ ሃሳቦች በስምምነት ያልፋሉ፡፡ 3/ The Council shall pass its recommendation by consensus. ፬/ በምክረ ሀሳቦቹ ላይ የጋራ ስምምነት የማይደረስ 4/ In case of failure to reach consensus on ከሆነ በአብላጫ ድምፅ ያልፋሉ፡፡ recommendations, decisions shall be made by majority vote. ፭. የዚህ አንቀጽ ድንጋጌዎች እንደተጠበቁ ሆኖ ኮሚሽኑ 5/ without prejudice to the provisions of this Article, የራሱን የስብሰባ ሥነ-ሥርዓት ደንብ ሊያወጣ the Commission may adopt its own rules of ይችላል፡፡ procedure. ፰. የኮሚሽኑ ሰብሳቢ ስልጣንና ተግባር 8. Powers and duties of the chair person of the commission የኮሚሽኑ ሰብሳቢ፡- Chairperson of the commission shall: 1/ Direct the general activities of the commission; ፩/ አጠቃላይ የስራ እንቅስቃሴዉን በበላይነት ይመራል፡፡ 2/ Assign the necessary supportive staff to the ፪/ ለኮሚሽኑ አስፈላጊ የሆኑ የድጋፍ ሰጭ commission; and ሠራተኞች የመድባል፡፡ 3/ Make relation with third parties representing the ፫/ ኮሚሽኑን በመወከል ከሌሎች አካላት ጋር ግንኙነት Commission. ያደርጋል፡፡

9. Powers And Duties of the Deputy Chair Person Of ፱. የኮሚሽኑ ምክትል ሰብሳቢ ሥልጣንና ተግባር The Commission The Deputy Chairperson Of The Commission shall: የኮሚሽኑ ምክትል ሰብሳቢ፡- ፩/ ሰብሳቢው በማይኖርበት ጊዜ ሰብሳቢዉን ተክቶ 1/ Perform the activity of the chairperson in his ይሰራል፤ absence. ፪/ ሰብሳቢው የሚሰጡት ተግባራት የፈጽማል:: 2/ Perform other activity given to him by the Chairperson. ፲. የጽህፈት ቤቱ አቋም 10. Organization Of The Office የኮሚሽኑ ጽሕፈት ቤት:- Office of the Commission shall have: ፩/ በጠቅላይ ሚኒስትሩ የሚሾም ሃላፊና ፤እና 1/ Head appointed by the Chairperson Of The Commission; and ፪/ አስፈላጊ ሰራተኞች ይኖሩታል፡፡ 2/ The necessary staff. gA ፲ሺ፱፻፹፯ 10987 Ød‰L ነU¶TUz¤È qÜ_R ፳፯ ጥር ፳፰ ቀን ፪ሺ፲፩ ዓ.ም Federal Negarit Gazette No 27, 5th, February 2019…….page ፫/ የኮሚሽኑ ዋና ፅ/ቤት በአዲስ አበባ ሆኖ 3/ The head office of Commission shall be in Addis እንደአስፈላጊነቱ በሌሎች ክልሎች ቅርንጫፍ Ababa and may have branch offices at regions, as ሊኖረው ይችላል:: may be necessary. ፲፩. የጽህፈት ቤቱ ስልጣንና ተግባር 11. Powers And Duties Of Office ጽህፈት ቤቱ የሚከተሉት ሥልጣንና ተግባራት The Office shall have the following Powers and Duties: ይኖሩታል:- ፩/ ለኮሚሽኑ አጠቃላይ የአስተዳደርና ፋይናንስ 1/ Render general financial and administrative አገልግሎት ይሰጣል፤ service to the Commission; ፪/ ለኮሚሽኑ የህዝብ ተሳትፎና ምክክር መድረኮችን 2/ Provide logistics support to the Commission on የሎጅስቲክስ ድጋፍ ይሰጣል፤ public participation and discussion forum; ፫/ የኮሚሽኑን ቃለ ጉባኤዎች፣ ውሳኔዎችንና ሌሎች 3/ Register and keep minutes, decisions and other ሰነዶችን በሚገባ ተመዝግበው እንዲጠበቁ documents; ያደርጋል፤ ፬/ የኮሚሽኑን ስራ ለማሳለጥ አስፈላጊውን ድጋፍና 4/ To give necessary support and assistance to facilitate activities of the commission. እገዛ ያደርጋል። ፲፪. የጽህፈት ቤቱ ኃላፊ ስልጣንና ተግባር 12. Powers And Duties Of The Office The Head of the Office shall: የጽ/ቤቱ ኃላፊ :- 1/ Direct and administer the activities of the Office; ፩/ የጽሕፈት ቤቱ ሥራዎች ይመራል ፣ ያስተዳድራል፤ 2/ Prepare the work programs and budgets of the ፪/ የኮሚሽኑ ዕቅድና በጀት ያዘጋጃል ሲፀድቅም ተግባራዊ Commission and implement same upon approval; ያደርጋል፤ 3/ Represent the Office in all dealings with third ፫/ ጽሕፈት ቤቱ ከሶስተኛ ወገኖች ጋር በሚያደርጋቸው parties. ግንኙነቶች ጽሕፈት ቤቱን ይወክላል::

13. Independency Of The Commission ፲፫. የኮሚሽኑ ገለልተኝነት ኮሚሽኑ ስራውን በነፃነትና በገለልተኝነት ያከናውናል። The Commission shall perform its activities freely and independently. ፲፬. የስራ ዘመን 14. Terms Of The Commission 1/ Terms of the Commission shall be up to three ፩/ የኮሚሽኑ የስራ ዘመን አስከ ፫ ዓመት ነው። years. 2/ Without prejudice to Sub-Article 1 of this article, ፪/ በዚህ አንቀፅ ንዑስ አንቀፅ ፩ የተጠቀሰው ቢኖርም term of the Commission may be prolonged as may የኮሚሽኑን የስራ ዘመን እንድሁኔታው ሊራዘም be necessary. ይችላል። gA ፲ሺ፱፻፹፰ Ød‰L ነU¶TUz¤È qÜ_R ፳፯ ጥር ፳፰ ቀን ፪ሺ፲፩ ዓ.ም Federal Negarit Gazette No 27, 5th, February 2019…….page 10988 ፲፭. የመተባበር ግዴታ 15. Duty to Cooperate ማን ማንኛውም ሰው ኮሚሽኑ በዚህ አዋጅ የተሰጠውን Any person shall have an obligation to cooperate with ሃላፊነት ለመወጣት በሚያደርገው እንቅስቃሴ ውስጥ the Commission for any legal questions requested by ለሚያቀርበው ማንኛውንም ህጋዊ ጥያቄ ትብብር the Commission to enable to Commission undertake የማድረግ ግዴታ አለበት። its responsibility provided under this Proclamation. ፲፮. በጀት 16. Budget የኮሚሽኑ በጀት በመንግሥት ይመደባል። The budget of the Commission shall be allocated by Government. ፲፯. የሂሳብ መዛግብት 17. Books of Accounts ፩/ ኮሚሽኑ የተሟሉና ትክክለኛ የሆኑ የሂሳብ 1/ The Commission shall keep complete and accurate መዛግብት ይይዛል፡፡ books of accounts. ፪/ የኮሚሽኑ የሂሳብ መዛግብትና ገንዘብ ነክ ሰነዶች 2/ The books of accounts and financial documents of በዋናው ኦዲተር ወይም እርሱ በሚሰይማቸው the Commission shall be Audited annually by the ኦዲተሮች በየዓመቱ ይመረመራሉ፡፡ Auditor General or by auditors designated by him. ፲፰. ጠቋሚዎችንና ምስክሮችን ስለመጠበቅ 18. Protection Of Witnesses And whistle-blower ፩/ ማንኛዉም ሰው በኮሚሽኑ ፊት ቀርቦ በሚሰጠው 1/ No one may be accused by the testimony given to ቃል መሰረት ክስ ሊመሰረትበት እንደዚሁም the Commission as well as the testimony given የሰጠው ቃል በእርሱ ላይ ማስረጃ ሆኖ before the Commission could not serve as and ሊቀርብበት አይችልም፡፡ evidence up on him. ፪/ ለጠቋሚዎችና ለምስክርች ጥበቃ ለማድረግ የወጣ 2/ The provisions of the laws for the protection of the ሕግ ለኮሚሽኑ ቃላቸው እና መረጃ ለሚሰጡ witnesses and whistle blowers shall apply to those ሰዎችም ተግባራዊ ይሆናል:: who have provided testimonies and evidences to the Commission. ፲፱. ደንብና መመሪያ የማውጣት ሥልጣን 19. Power To Issue Regulation and Directive ፩/ የሚንስትሮች ምክር ቤት ይህንን አዋጅ 1/ Council of Ministers may issue Regulations necessary for the effective implementation of this ለማስፈፀም የሚያስፈልጉ ደንቦችን ሊያወጣ Proclamation. ይችላል፡፡ ፪/ ኮሚሽኑ ይህንን አዋጅና በዚህ አንቀፅ ንዑስ አንቀፅ 2/ The Commission may issue Directives necessary for (፩) መሰረት የወጡ ደንቦችን ለማስፈፀም the effective implementation of This Proclamation and Regulations issued under Sub Article 1 of this የሚያስፈልጉ መመሪያዎችን ሊያወጣ ይችላል፡፡ Article. gA ፲ሺ፱፻፹፱ Ød‰L ነU¶TUz¤È qÜ_R ፳፯ ጥር ፳፰ ቀን ፪ሺ፲፩ ዓ.ም Federal Negarit Gazette No 27, 5th, February 2019…….page 10989 ፳. አዋጁ የሚፀናበት ጊዜ 20.
