P.O.Box 80001 ÃNÇ êU Unit Price የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፌደራል ነጋሪት ጋዜጣ FEDERAL NEGARIT GAZETTE OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ የሕዝብ ተወካዮች ምክር ቤት ጠባቂነት የወጣ አዋጅ ቁጥር ፩ሺ፹፪/፪ሺ፲ ዓ.ም የአፍሪካ ሴቶች መብቶች ፕሮቶኮል ማጽደቂያ አዋጅ ………………………...........................ገጽ ፲ሺ፫፻፲፯ Proclamation No.1082/2018 Proclamation to Ratify The Protocol to the African Charter On Human and Peoples Rights on The Rights of Women in Africa……………………………...Page 10317 አዋጅ ቁጥር ፩ሺ፹፪/፪ሺ፲ የአፍሪካ የሰዎች እና ሕዝቦች መብቶች ስምምነት የአፍሪካ ሴቶች መብቶች ፕሮቶኮል ለማጽደቅ የወጣ አዋጅ የአፍሪካ የሰዎች እና ሕዝቦች መብቶች ስምምነት የአፍሪካ የሴቶች መብቶች ፕሮቶኮል ሐምሌ ፬ ቀን ፲፱፻፺፭ ዓ.ም በማፑቶ ሞዛምቢክ ስምምነት የተደረሰበት በመሆኑ፣ የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ መንግስት ፕሮቶኮሉን ግንቦት ፳፬ ቀን ፲፱፻፺፮ ዓ.ም. የፈረመው በመሆኑ፤ ይህንኑ ስምምነት የኢትየጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ የህዝብ ተወካዮች ምክር ቤት ጥር ፳፱ ቀን ፪ሺ፲ ዓ.ም ባካሄደዉ ስብሰባ ያፀደቀዉ በመሆኑ፤ በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግስት አንቀጽ ፶፭(፩) እና (፲፪) መሠረት የሚከተለው ታውጇል:: ፩ .አጭር ርዕስ ይህ አዋጅ “የአፍሪካ ሴቶች መብቶች ፕሮቶኮል ማጽደቂያ አዋጅ ቁጥር ፩ሺ፹፪/፪ሺ፲” ተብሎ ሊጠቀስ ይችላል:: PROCLAMATION NO.1082/2018 PROCLAMATION TO RATIFY THE PROTOCOL TO THE AFRICAN CHARTER ON HUMAN AND PEOPLES’ RIGHTS ON THE RIGHTS OF WOMEN IN AFRICA WHERE AS, the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa was adopted in Maputo, Mozambique on 11 July 2003; WHERE AS, the Federal Democratic Republic of Ethiopia signed the Protocol on 1 st June 2004; WHERE AS, the House of Peoples’ Reperesentatives of the Federal Democratic Republic of Ethiopia has ratified the said Agreement at its session held on 10 th day of January 2017; NOW, THEREFORE, in accordance with Article 55 (1) and (12) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows. 1 .Short Title This Proclamation may be cited as the “Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa Ratification Proclamation No1082/2017”. 24 th Year No.33 ADDIS ABABA March 30 th , 2018 ሃያ አራተኛ ዓመት ቁጥር ፴፫ አዲስ አበባ መጋቢት ፳፩ ቀን ፪ሺ፲ ዓ.ም gA Ød‰L ነU¶T Uz¤È qÜ R ፴፫ መጋቢት ፳፩ qN ፪ሺ፲ ›.M Federal Negarit Gazette No. 33 30th March, 2018……..page ፲ሺ፫፻፲፰ ፮. የስምምነቱ መጽደቅ በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ግንቦት ፳ቀን ፲፱፻፺፮ ዓ.ም የተፈረመው የአፍሪካ የሰዎች እና ሕዝቦች መብቶች ስምምነት የአፍሪካ ሴቶች መብቶች ፕሮቶኮል በዚህ አዋጅ በአንቀጽ ፫ የተመለከቱ ተዓቅቦዎች እና መግለጫዎች በማስገባት ጸድቋል:: ፫.በስምምነቱ ላይ የገቡ ተዓቅቦዎች እና መግለጫዎች ፩/የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ በሚከተሉት የፕሮቶኮሉ አንቀጾች ላይ ተዓቅቦ አድርጓል፤ ሀ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ የፕሮቶኮሉ አንቀጽ ፮(ሐ) ተገዢ አይሆንም፤ ለ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ጋብቻን እንደ ህጋዊ መስፈርት በሚያስቀምጠው የፕሮቶኮሉ አንቀጽ ፮ (መ) ተገዢ አይሆንም፤ ሐ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ በፕሮቶኮሉ አንቀጽ ፮ (ረ) ተገዢ አይሆንም፤ መ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ተጋቢዎች ተለያይቶ መኖር የሚችሉት በፍርድ ቤት ትእዛዝ ብቻ ነው የሚለው የፕሮቶኮሉ አንቀጽ ፯(ሀ) ላይ ተዓቅቦ አድርጓል፤ ተጋቢዎች ተለያይቶ ለመኖር መወሰን እንደሚችሉ የሚደነግገው በኢትዮጵያ ሕግ መሠረት ይፈጸማል፤ ሠ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ በፕሮቶኮሉ አንቀጽ ፲ (፫) ተገዢ አይሆንም፤ ረ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ባሏ የሞተባት ሴት የባሏን ንብረት ለመውረስ መብት ሊኖራት ይገባል የሚለው የፕሮቶኮሉ አንቀጽ ፳፩ (ቸ) ላይ ተዓቅቦ አድርጓል፤ ተጋቢዎች በኑዛዜ የትዳር አጋራቸውን እንዲወርሱ የሚፈቅደው የኢትዮጵያ ሕግ ይፈጸማል፤ ሰ) የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ በፕሮቶኮሉ አንቀጽ ፳፯ ተገዢ አይሆንም፡፡ ፪/ የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ በሚከተሉት የፕሮቶኮሉ አንቀጾች ላይ መግለጫ አስገብቷል፤ ሀ) አስገድዶ የመድፈር ወንጀልን በሚመለከት የፕሮቶኮሉ አንቀጽ ፬ (፪)(ሀ) በኢትዮጵያ የወንጀል ሕግ አንቀጽ ፮፻፳ መሰረት ይፈጸማል፤ 2 .Ratification of the Protocol The Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa signed by the Federal Government Democratic Republic of Ethiopia on 1 st June 2004 is hereby ratified upon entering the reservations and declaration provided under Article 3 of this Proclamation. 3 .Reservations and Declarations on the Protocol 1/ The Federal Democratic Republic of Ethiopia entered reservations on the following provisions of the Protocol: a) The Federal Democratic Republic of Ethiopia does not consider itself to be bound by Article 6(c) of the Protocol; b) The Federal Democratic Republic of Ethiopia does not consider itself to be bound by marriage registration as legally recognized by Article 6(d) of the Protocol; c) The Federal Democratic Republic of Ethiopia does not consider itself to be bound by Article 6(f) of the Protocol; d) The Federal Democratic Republic of Ethiopia enters a reservation on article 7 (a) of the Protocol that requires separation of spouses to be decided by judicial organs. The laws of Ethiopia that permit spouses to separate by agreement shall apply; e) The Federal Democratic Republic of Ethiopia does not consider itself to be bound by Article 10(3) of the Protocol; f) The Federal Democratic Republic of Ethiopia enters a reservation on article 21(l) of the Protocol regarding the right of a widow to inherit her deceased spouse. The law of the country according to which spouses inherit each other if he/she is designated as a legatee by a will shall apply; g) The Federal Democratic Republic of Ethiopia does not consider itself bound by Article 27 of the Protocol. 2/ The Federal Democratic Republic of Ethiopia entered declarations on the following provisions of the Protocol: a) Article 4 (2) (a) shall be applicable in accordance with Article 620 of the Criminal Code of Ethiopia that defines rape to be a forced sexual intercourse that occures out of wedlock. 10318 gA Ød‰L ነU¶T Uz¤È qÜ R ፴፫ መጋቢት ፳፩ qN ፪ሺ፲ ›.M Federal Negarit Gazette No. 33 30th March, 2018……..page ፲ሺ፫፻፲፰ ለ) የፕሮቶኮሉ አንቀጽ ፮(ለ) ፲፰ ዓመት የሆነው ዝቅተኛ የጋብቻ እድሜ ሊቀነስ እንደሚችል በሚደነግገው የኢትዮጵያ ሕግ መሰረት ይፈጸማል፤ ሐ) የፕሮቶኮሉ አንቀጽ ፮(በ) ተጋቢዎች በጋብቻ ወቅት ያገኙት ገቢ የጋራ ሃብት እንደሆነ እና በተጋቢዎች የጋራ ውሳኔ እንደሚተዳደር እና ጥቅም ላይ እንደሚውል በሚደነግገው የኢትዮጵያ ሕግ መሰረት ይፈጸማል፤ መ) ሴቶች ከጋራ ንብረታቸው ፍትሃዊ ድርሻ የማግኘት መብት እንዳላቸው የሚደነግገው የፕሮቶኮሉ አንቀጽ ፯(መ) ተጋቢዎች የጋራ ንብረታቸው ላይ እኩል ድርሻ እንዳላቸው በሚደነግገው የኢትዮጵያ ሕግ መሰረት ይፈጸማል፤ ሠ) የግል ዘርፉ የልጆች አስተዳደግ አስተዋጽኦ የማድረግ የሁለተኛ ደረጃ ኃላፊነት አለባቸው የሚለው የፕሮቶኮሉ አንቀጽ ፲፫ (ቸ) በኢትዮጵያ ሕግ መሰረት ይፈጸማል፤ ረ) በጋብቻ ውስጥ ያሉ ሴቶች ለመውለድ ወይም ላለመውለድ የመወሰን መብትን በሚመለከት በፕሮቶኮሉ አንቀጽ ፲፬(ለ) የተደነገገው የሚፈፀመው የሁለቱን ተጋቢዎች ስምምነት መሰረት በማድረግ ነው፡፡ ፬.አስፈጻሚ አካል የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሴቶችና ህጻናት ጉዳይ ሚኒስቴር ከሚመለከታቸው አካላት ጋር በመተባበር ፕሮቶኮሉን የማስፈጸም እና የመከታተል ኃላፊነት ተሰጥቶታል፡፡ ፭.አዋጁ የሚፀናበት ጊዜ ይህ አዋጅ በፌደራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል:: አዲስ አበባ መጋቢት ፳፩ ቀን ፪ሺ፲ ዓ.ም ዶ/ር ሙላቱ ተሾመ የኢትዮጽያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፕሬዚዳንት b) Article 6(b) of the Protocol shall apply in accordance with the law of Ethiopia that allows dispensation from the minimum age of marriage that is 18 years; c) Article 6(j) of the Protocol shall apply in accordance with the law of Ethiopia according to which income acquired during marriage is a common property of the spouses and it is managed and disposed by their common decision; d) Article 7(d) of the Protocol that provides for the right of women to acquire equitable share from the common property in the marriage shall apply in line with the laws of Ethiopia that provide for equal share of spouses on the common property; e) Article 13 ( j) of the Protocol regarding the secondary responsibility of the private sector to contribute to the upbringing and development of children shall apply in accordance with the domestic law; f) Article 14(b) of the Protocol shall apply in accordance with the aggrement of spouses wheather to have birth or not the right of women within the wedlock. 4. Implementing Organ The Ministry of Women and Children Affairs of the Federal Democratic Republic of Ethiopia is given the responsibility to cooperate with other relevant organs to implement and follow-up the Protocol. 5.Effective Date This Proclamation shall come into force upon its publication in the Federal Negarit Gazette.
