Box ባህር ዳር መስከረም 26 ቀን 2003 ዓ.ም Bahir Dar 13 th , October 2010 16ኛ አመት ቁጥር 15 16 th Year No 15 www.abyssinialaw.com ገ ጽ - 2 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -2 በአማራ ብሔራዊ ክልል ውስጥ የተለያዩ ፖሊሲዎችና እስትራቴጂዎችን ተግባራዊ በማድረግ ፈጣንና ቀጣይነት ባለው የኢኮኖሚ ዕድገት ውስጥ የእንስሳት ሀብትን በመጠበቅ፣ በመንከባከብና በማልማት ከፍተኛ ውጤት ማስገኘት እንዲቻል ለማድረግና የእንስሳት ሀብት ልማትና ጤና ጥበቃ ሥራዎችን በባለቤትነት የሚመራ አካል ማቋቋም አስፈላጊ ሆኖ በመገኘቱ፤ WHEREAS, it has been found necessary to establish an institution which directs the development of livestock resource and health activities by its ownership, to ensure a higher output, in fast and sustainable economic growth, through implementing different policies and strategies of the region by protecting, preserving, and developing livestock resources; በክልሉ ውስጥ የሚገኘውን የእንስሳት ሀብት በተሻለ ሁኔታ ጥቅም ላይ ለማዋል እንዲቻል ለዘርፉ ልማት ማነቆ የሆኑትን የዝርያ ምርታማነት አነስተኛ መሆን፤ የመኖ አቅርቦት ጥራት መጓደል፣ የበሽታ መስፋፋትና የገበያ እጥረት ለመግታትና ለመቅረፍ የእንስሳት ሀብት ልማትና ጤና አጠባበቁ ለእድገታችን ወሣኝ ሚና ያለው መሆኑ ስለታመነበት፤ WHEREAS, it is convinced that the development and health care of livestock resources has a crucial role in order to stop and solve the sectors development bottle-neck, problems as low productivity of breeds, low quality of food supply, spread of disease and market shortage, shortage, so as to enable a better use of livestock resource found in the region; የክልሉን የእንስሳት ሀብት ልማትና ጥበቃው ዘላቂነት ባለው መልኩ እንዲጓዝ የሚደረገውን የልማት ጥረት ከማገዝ ጎን ለጎን በየጊዜው በዘርፉ የወጡና የሚወጡ ፖሊሲዎች፣ ስትራቴጅዎች፣ ደንቦች፣ መመሪያዎችና ፕሮግራሞች ከገጠር ልማት ፖሊሲና ስትራቴጅ ጋር ማጣጣምና ውጤት ማስመዝገብ በማስፈለጉ፤ WHEREAS, it becomes necessary to score a result and to coincide the policy and strategy of rural development with policies, strategies, regulations, directives and programs issued in the sector, besides of the development effort being made to run the development and care of the regional livestock resources in a sustainable manner; የእንስሳት፣ ውጤቶችንና ግብዓቶችን ንግድ ዝውውር ማስፈፀሚያ መመሪዎችን በመቅረፅ፣ በማሻሻልና በመተግበር ህጋዊ አሰራር እንዲሰፍን የሚያደርግና የሚከታተል ተቋም ማደራጀት ተገቢ ሆኖ በመገኘቱ፤ WHEREAS, it has been found appropriate to organize an institute which follow-up and cause to prevail a legal working system through planning, amending and implementing the execution directives of commercial transfer of livestock products and inputs; www.abyssinialaw.com ገ ጽ - 3 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -3 ክልላችን በእንስሳት ሀብት በሀገርና በውጭ ንግድ ተወዳዳሪ ሆኖ እንዲገኝ ለማድረግ ተከታታይ እንስሳት በሽታዎች ቅኝት ጥናት ቁጥጥር በማካሄድ ደረጃ በደረጃ ነፃ የበሽታ ቀጠና አካባቢዎችን ለመፍጠርና እንዲሁም የእንስሳት ኳራንቲን አገልግሎት መስጫ ጣቢያና የቁጥጥር ኬላዎችን በማቋቋም የበሽታ ቁጥጥር ስራዎችን ማጠናከር በማስፈለጉ፤ WHEREAS, it is found necessary to strengthen the disease controlling work to make our regional livestock resources competent in local and foreign trade by performing a continuous survey of livestock diseases, step by step to create disease free zone areas by establishing animal quarantine service centers; በክልሉ ውስጥ በእንስሳት ሀብት ልማትና ጤና ጥበቃ ተግባር የተሰማሩ የግል ባሀብቶች፣ የልማት ድርጅቶችንና ሌሎች ተቋማትን በአግባቡ መደገፍ በማስፈለጉ ፤ WHEREAS, it is found necessary to support appropriately those private investors, development organizations and other institutions which are engaged in the activities of livestock resources and health development in the region; የአማራ ብሔራዊ ክልል መስተዳድር ምክር ቤት በተሻሻለው የብሔራዊ ክልሉ ህገ- መንግስት አንቀጽ 58 ንዑስ አንቀጽ 7 ድንጋጌ ሥር በተሰጠው ስልጣን መሠረት ይህንን ደንብ አውጥቷል። NOW, THEREFORE, the Council of the Amhara National Regional Government, in accordance with the powers vested in it under the provision of Article 58 Sub Article 7 of the Revised National Regional Constitution, hereby issues this regulation. ክፍል አንድ ጠቅላላ PART ONE GENERAL 1. አጭር ርዕስ 1. Short title ይህ ደንብ ‘’የእንስሳት ሀብት ልማት ማስፋፊያ ኤጀንሲ ማቋቋሚያ ክልል መስተዳድር ምክር ቤት ደንብ ቁጥር 81/2003 ዓ/ም’’ ተብሎ ሊጠቀስ ይችላል። This regulating may be cited as “Livestock Resources Development Promotion Agency Establishment, Council of Regional Government Regulation No.81/2010” 2. ትርጓሜ 2. Definition የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር በዚህ ደንብ ውስጥ፦ Unless the context requires otherwise, in this regulation: 1. ‘’ቢሮ’’ ማለት የአማራ ብሔራዊ ክልላዊ መንግሥት ግብርና ቢሮ ነው፣ 1. “Bureau” shall mean the Amhara National Regional state Agriculture Bureau. www.abyssinialaw.com ገ ጽ - 4 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -4 2. ‘’አርቢ’’ ማለት አርሶ አደር ወይም አርብቶ አደር ሲሆን የግል ባለሀብቶችንና ሌሎች በእንስሳት እርባታ ላይ የተሰማሩ ሰዎችን ወይም ድርጅቶችን ይጨምራል። 2. “Animal Rearing” shall mean a farmer or pastoralist including private investors and other people or organizations that are involved in animal husbandry. 3. ‘’እንሰሳት’’ ማለት የዳልጋ ከብት፣ በግ፣ ፍየል፣ ግመል፣ የጋማ ከብት፣ ዶሮ፣ ዓሣማ፣ ሰጎን፣ ጥንቸል፣ ንብ፣ የሐር ትልና የመሣሰሉትን ያጠቃልላል። 3. “Animal” shall mean cattle, sheep, goat, camel, equine, poultry, pig, ostrich, rabbit, bee, silkworm and including others similar. 4. ‘’የእንሰሳት ምርትና ተዋፅኦ’’ ማለት ወተትና የወተት ውጤቶች፣ ማር፣ ሥጋ፣ እንቁላል፣ ቆዳና ሌጦ፣ ፀጉር፣ ላባ፣ ቀንድ ፣ ሰም፣ ሽሆናና አጥንት፣ ሞራና የመሳሰሉትን የሚገልጽ ነው። 4. “Animal products and by products” shall mean milk and its by products, honey, meat, egg, skin and hide, wool, feather, horn, wax, hoof and bone, fat and the like. 5. ‘’ጥራት’’ ማለት የእንሰሳት ምርትና ተዋፅዖ ደረጃውን በጠበቀ አኳኋን ተመርቶ ለአገልግሎት የሚቀርብበት ሁኔታ ነው። 5. “Quality” shall mean animal products and by products that are produced by keeping its standard quality to be available for specific purpose. 6. ‘’የገበያ ጥናት መረጃ’’ ማለት የእንሰሳት ምርትና ተዋፅዖን ተፈላጊነትና የዋጋ ሁኔታ በመከታተል ማጥናትና መረጃዎችን መስጠት ወይም ማሰራጨት ነው። 6. “Market study data” shall mean providing or distributing the demand and cost situation data of animal products and by products through follow up and studying it. 7. ‘’የእንሰሳት በሽታ’’ ማለት በእንሰሳው ውጫዊም ሆነ ውስጣዊ የአካል እንቅስቃሴዎች ክንዋኔ ላይ የሚደርስ ያልተለመደ ችግር ነው። 7. “Animal disease” shall mean the unusual problem occurred to affect the physiology of the external and/or internal body parts of the animal. 8. ‘’ኳራንቲን’’ ማለት እንሰሳትና የመኖ ዕጽዋት እንዲሁም የምርት ውጤቶቻቸውን ወደተወሰኑ ሥፍራዎች እንዳይገቡ ወይም ከተወሰኑ ሥፍራዎች እንዳይወጡ ለመቆጣጠር በማሰብ ማግለልና ከመሰሎቻቸው ለይቶ ማሣደግ ወይም ማስቀመጥና እንዳይሰራጩ ለማድረግ ለዚሁ ተብሎ በተዘጋጀው ክልል ውስጥ ማስቀመጥ ነው። 8. “Quarantine” shall mean a period during which animal, their feed and products, suspected of carrying a pathogen is detained at a port of entry or isolate and grow or preserve in restricted area under enforced isolation to prevent the spread of diseases from an area or region. 9. ‘’ከበሽታ ነፃ የሆነ ቀጠና’’ ማለት አንድን የተመረጠ አካባቢ ተዛማችና ድንበር ዘለል የሆኑ የእንሰሳት በሽታዎችን በተከታታይ ቅኝትና የቁጥጥር ስርዓት በመዘርጋት ከበሽታ ንክኪ ነፃ ተደርጐና ተከልሎ የተጠበቀ ቦታ ነው። 9. “Disease free zone” shall mean a clearly selected & regionalized area made free from a contagious or trans boundary animal diseases by putting in place a continual surveillance and control system there in. www.abyssinialaw.com ገ ጽ - 5 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -5 ክፍል ሁለት ስለ ኤጄንሲው መቋቋም፣ ተጠሪነትና ዓላማዎች PART TWO ESTABLISHMENT, ACCOUNTABILITY AND OBJECTIVES OF THE AGENCEY 3. መቋቋምና ተጠሪነት 3. Establishment and Accountability 1. የአማራ ብሔራዊ ክልላዊ መንግሥት የእንስሳት ሀብት ልማትማስፋፊያ ኤጄንሲ ከዚህ በኋላ ‘’ኤጄንሲው’’ እየተባለ የሚጠራ ራሱን የቻለና ህጋዊ ሰውነት ያለው የክልሉ መንግሥት መ/ቤት ሆኖ በዚህ ደንብ ተቋቁሟል። 1. The Amhara National Regional State Livestock Development Promotion Agency, hereinafter referred to as “The Agency”, is hereby established as an autonomous government agency having its own legal entity under this regulation. 2. የኤጄንሲው ተጠሪነት ለክልሉ ግብርና ቢሮ ይሆናል። 2. The Agency shall be accountable to the Regional Bureau of Agriculture. 4. ዓላማዎች 4. Objectives ኤጄንሲው በዚህ ደንብ መሠረት የሚከተሉት ዓላማዎች ይኖሩታል፦ The Agency shall, according to this regulation, have the following objectives: 1. የሃገሪቱን ፖሊሲዎችና ስትራቴጅዎች መሠረት በማድረግ ተቋሙ ያስቀመጠውን ራዕይና ተልዕኮ ለማሣካት የሚያስችል ኃላፊነትና ተጠያቂነት ያለው የአሰራር ስርዓት መዘርጋት፤ 1. To establish a responsible and accountable working system for the success of the vision and mission put by the Agency, in accordance with the national policies and strategies; 2. በክልሉ ውስጥ የተለያዩ የስነ ምህዳርና የልማት ቀጠናወች ለሚገኙ አ/አደሮች፤ የግል ባለሀብቶች፤ ማህበራትና የመሳሰሉት ባላቸው የኢኮኖሚ አቅምና ስርዓተ ፆታን ባገናዘበ መልኩ አዋጭ አማራጭና ገበያ ተኮር ቴክኖሎጅዎችን በፍጥነትና በተሟላ ሁኔታ ለማቅረብ የሚያስችል የአሰራር ስልት መፍጠር፤ 2. To create a system which enables to supply, in a fast and complete condition, a reliable option and market oriented technologies for the farmers, private investors, associations, and so on found in different agro ecological and development corridors of the region by taking into account their economic capacity and gender perspectives. 3. የዘርፉን መረጃዎች በተሟላ ሁኔትና በፍጥነት ለተጠቃሚው ህብረተሰብ ወቅታዊነቱን በጠበቀ ሁኔታ ለማድረስ የሚያስችል ስልት መቀየስ፤ 3. To create an information system that gives the beneficial community a complete, timely, fast and accessible data of the sector. 4. የክልሉ የእንስሳትና የእንሰሳት ተዋፅኦዎች ጤንነታቸውና ጥራታቸው ተጠብቆ በሃገር 4. To remove the existing fragmented structural organization and function processes of the sector, and to reorganize same with well integrated and linked way so as to attain recordable results. 6. በተለምዶ ሲሠራባቸው የቆዩትን የእንስሳት ሀብት ልማትና ጤና አጠባበቅ ቴክኖሎጅዎችና የብዜት ማእከላት ውጤታማና ትርፋማ እንዲሆኑ የሚያስችል ሥርዓት በመዘርጋትና ኢንተርፕራይዞችን በማቋቋም ዘለቄታዊ አገልግሎት እንዲሰፍን ወደ ግል ድርጅቶች የሚተላለፍበትን ብልሃት ማፈላለግ፤ 6. To search for means to transfer the former traditional livestock resources development and health technologies, multiplication centres to private organizations, for the existence of a sustainable service, by forming enterprises and installing a system that enable them successful and profitable. 7. የእንሰሳት ሀብቱ የተፈጥሮ ሀብትና እንክብካቤውን በሚደግፍ ሁኔታ ጠቀሜታውን አጉልቶ ማውጣት። 7. To show magnificently the importance of animal resources in terms of supporting the natural resources. 5. መደበኛ አድራሻ 5. Principal Address የኤጄንሲው መበደኛ አድራሻ በባህር ዳር ከተማ ውስጥ ይሆናል። The principal address of the Agency shall be in the city of Bahir Dar. ክፍል ሦስት የኤጄንሲው ስልጣንና ድርጅታዊ አቋም PART THREE POWERS AND ORGANIZATIONAL STRUCTURE OF THE AGENCY 6. ስልጣንና ተግባር፦ 6. Powers and Duties ኤጄንሲው በዚህ ደንብ መሰረት ከዚህ በታች የተመለከቱት ስልጣንና ተግባራት ይኖሩታል፤ The Agency shall, pursuant to this regulation, have the following powers and duties: 1. ዘርፉን በሚመለከት ቀደም ሲል የወጡና ለወደፊት የሚወጡ ፖሊሲዎችን፣ ስትራቴጅዎችን፣ አዋጆቸን፣ ደንቦችና መመሪያዎችን በክልሉ ውስጥ ያስፈጽማል፣ ይቆጣጠራል፤ 1. Supervise and cause to be executed in the region those policies, strategies, proclamations, regulations, and directives issued before and to be issued in the future regard to the sector. www.abyssinialaw.com ገ ጽ - 7 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -7 2. በክልሉ ውስጥ የሚገኙትን የእንሰሳት ዝርያዎች በልማት ቀጠናዎች ይለያል፣ የልማት ቀጠናውን መሠረት ያደረገ ስትራቴጅክ ዕቅድ ያዘጋጃ፣ ይተገብራል፣ ይከታተላል፣ ይቆጣጠራል፤ 2. Identify the species of animals found in the region by development corridors; prepare a strategic plan based on development corridors; implement, follow -up and supervise same. 3. የእንስሳት መኖ ልማት ያካሄዳል፣ የግጦሽ መሬትና የእንስሳት ዘር እንዲሻሻልና እንዲጠበቅ ያደርጋል፤ 3. Undertake the development of livestock feed activities; cause to be safeguarded and improved the grazing land and livestock species. 4. የእንስሳት ሀብት ልማትና ጤና አጠባበቅ ፖኬጆችን ይፈጽማል፣ ይከታተላል፣ ከምርምር አካላት ጋር በመቀናጀት ያሻሽላል፣አዳዲሶችንም እየለየ ይቀርፃል፣ ቴክኖሎጂዎችን አባዝቶ ያስፋፋል፣ 4. Execute and follow – up the livestock resource development and health packages jointly with research bodies; identify, design, scale up and expand new technologies. 5. የእንስሳት ምርት ግብዓት አቅርቦትና ብድርን ያመቻቻል፣ያስተባብራል፤ 5. Co-ordinate and facilitate the supply of inputs and credit for animal production. 6. የእንሰሳት የመጠጥ ውሃ እጥረት ባለባቸው አካባቢዎች ከሚመለከታቸው አካላት ጋር በመነጋገር የውኃ እጥረቱ እንዲፈታ ያደረጋል፣ ሁኔታዎችን ያመቻቻል፤ 6. Facilitate conditions and cause to eliminate the problem of drinking water for livestock’s where there is a shortage in area by discussing it with concerned bodies. 7. የሀገረሰብ እንስሳትን ለመጠበቅ ጉዳዩ ከሚመለከተው አካል ጋር በመሆን በቅንጅት ይሰራል፤ 7. Work in harmony with concerned body to conserve local animals. 8. የእንስሳት ሃብት ልማቱን ከደን ልማቱ ጋር በማቀናጀት ከደን ልማት ውስጥ የሚገኙ ውጤቶችን በአግባቡ ለመጠቀም ከሚመለከታቸው አካላት ጋር በቅርብ ይሰራል፤ 8. Work closely with concerned bodies, for the proper use of products found in the forestry, by integrating livestock resource development with forestry development. 9. አግባብ ካላቸው ባለድርሻዎች ጋር በመተባበር ህጋዊና ህገወጥ የቁም እንሰሳት፣ የቆዳና ሌጦ፣የእንሰሳት እርድ፣ የግል እንስሳት መድሃኒትና የክሊኒክ አገልግሎት ንግድና ሌሎች ንግዶችን ይቆጣጠራል፣ የብቃት መስፈርቶችን ያወጣል፣ ማስረጃ ይሰጣል፣ በወጡና በሚወጡ ህጎች መሠረት እርምጃዎችን ይወስዳል፣ እንዲወስዱ ያደርጋል፤ 9. Control the legal and illegal trade of livestock, skin and hide, livestock slaughter, private veterinary pharmacy and clinic service and other related trades with collaboration of proper stakeholders; formulate criteria and give legal document; take and cause to be taken measures based on the rules issued and to be issued in the future. www.abyssinialaw.com ገ ጽ - 8 ዝክረ-ህግ ጋዜጣ ቁጥር 15 መስከረም 26ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 15 6th Day of October 2010, P a g e -8 10. በክልሉ ውስጥ የእንስሳት ንግድ የጉዞ መስመሮችን በመለየት በሕግ እንዲታወቁና ተገቢውን ጥበቃ እንዲያገኙ ያደርጋል፣ የኳራንቲንና የፍተሻ ማዕከላትን ያደራጃል፣ ከአጎራባች ክልሎችና ከፌዴራሉ መንግሥት አካላት ጋር በትብብር ይሰራል፤ 10. Cause to be legally recognized and protected properly of those animal trade trekking routes, in the region, by identifying them; organize quarantine and checking centres; work in collaboration with neighbouring regions and bodies of the federal government. 11. የበሽታ መከላከልን መሠረት ያደረገ የእንሰሳት ጤና አገልግሎት ይሰጣል፣ የእንሰሳት በሽታዎች ምርመራ፣ አሰሳና ቁጥጥር ሥራዎችን ያካሂዳል፣ አስፈላጊ ሆኖ ከተገኘ የእንሰሳት እንቅስቃሴን ይገድባል፣ ክልል አቀፍ የበሽታ ቁጥጥር ስትራቴጂ ይነድፋል፣ ነፃ የበሽታ ቀጣናዎችን ያቋቁማል፤ 11. Render health service of livestock’s based on prevention of disease; undertake diagnosis, observation and controlling activities of animal diseases; restrict , if it is found necessary, livestock’s movement; design regional disease controlling strategy and establish disease free corridors. 12. ለዘርፉ ልማትና ጥበቃ የሚያስፈልጉ መሰረተ ልማቶችን ያቋቁማል፣ እንዲቋቋሙና እንዲስፋፉ ያደርጋል፣ አደረጃጀታቸውን በማሟላት ሙሉ አገልግሎት እንዲሰጡ ያደርጋል፤ 12. Establish and cause to be established and expanded the infra/super structures that are necessary for the development and protection of the sector, and cause them to give full service by fulfilling their organization. 13. ለተጠቃሚው ህብረተሰብ ከበሽታ ነፃ የሆነና ጥራቱ የተጠበቀ ስጋ እንዲቀርብ በቄራዎች የሥጋ ምርመራ እንዲካሄድ ያደርጋል፣ ከሚመለከታቸው አካላት ጋር በመተባበር ደረጃቸውን የጠበቁ ቄራዎች በየከተሞች እንዲገነቡ ያደርጋል፤ 13. Cause to be made a meat inspection by abattoirs in order to provide disease free and qualified meat for the consumers; cause to be constructed standard abattoirs in cities by cooperating with concerned bodies. 14. በዘርፉ የተሰማሩ ባለሀብቶች ጥራትና ደረጃውን የጠበቀ የእንሰሳት ምርት እንዲያቀርቡና አገልግሎት እንዲሰጡ ያደርጋል፣ የአቅም ግንባታ ሥራና የሙያ ድጋፍ ይሰጣል፤ 14. Encourage investors engaged in the sector, to supply and serve qualified and standardized livestock products; provide them capacity building and professional support. 15. ለእንስሳት ምርቱ የገበያ ሁኔታዎችን ያመቻቻል፣ የገበያ መረጃ ለተጠቃሚው በወቅቱ እንዲደርስ ያደርጋል፤ 15. Facilitate market conditions for the livestock products; cause to be provided a market data for the beneficiary on time. 16. በየደረጃው የእንስሳት ጤና አጠባበቅ አገልግሎትን ለማሻሻል የሚያግዙ የእንስሳት እርባታና ጤና ባለሙያዎች ምክር ቤቶችን 16. Enter in to contracts, own property, sue and be sued based on law. 7. ድርጅታዊ አቋም 7.Organizational Structure ኤጄንሲው በአንድ ዋና ዳይሬክተር የሚመራ ሲሆን ለሥራው የሚያስፈልጉ የበታች የሥራ ሀላፊዎችና ደጋፊ ሠራተኞች ይኖሩታል። The Agency shall be led by a Director General; provided, however, that it shall have subordinate heads and support employees necessary for the work. 8. ስለኤጄንሲው ዋና ዳይሬክተር አሿሿምና ተጠሪነት 8. Appointment and Accountability of the Director General of the Agency. 1. የኤጄንሲው ዋና ዳይሬክተር በርዕሰ መስተዳድሩ የሚሾም ሆኖ ተጠሪነቱ ለቢሮው ይሆናል። 1. The Director General of the Agency shall, having been appointed by the Head of the Regional state, be accountable to the Bureau. 2. ዳይሬክተሩ በዚህ ደንብ አንቀጽ 6 ድንጋጌዎች ሥር ለኤጄንሲው የተሰጡትን ስልጣንና ተግባራት በሥራ ላይ ያውላል። 2. The Director General shall implement the powers and duties vested for the Agency under the provision of Article 6 of this regulation. 3. የዚህ አንቀጽ ንዑስ አንቀጽ /2/ አጠቃላይ ድንጋጌ እንደተጠበቀ ሆኖ ዳይሬክተርሩ ከዚህ በታች የተመለከቱት ልዩ ስልጣንና ተግባራት ይኖሩታል፦ ሀ/ የኤጄንሲውን ስራዎች በበላይነት ይመራል ያስተዳድራል ይቆጣጠራል፤ ለ/የኤጄንሲውን የአጭር፣ የመካከለኛና የረጅም ጊዜ ዕቅድ ይነድፋል፣ ያስፈፅማል፤ ሐ/ በክልሉ ሲቪል ሰርቪስ ህግ መሠረት የኤጄንሲውን ሠራተኞች ይቀጥራል፣ ያስተዳድራል፣ ያሰናብታል፤ መ/ ለኤጄንሲው በተፈቀደው በጀትና የሥራ ፕሮግራም መሰረት ገንዘብ ወጪ ያደርጋል፤ ሠ/ ከሦስተኛ ወገኖች ጋር በሚደረጉ ግንኙነቶች ኤጄንሲውን ይወክላል፤ 3. Deputy Director 1. ኤጄንሲው እንደአስፈላጊነቱ በክልሉ ርዕሰ መስተዳድር የሚሾም ምክትል ዳይሬክተር ይኖረዋል። 1. The Agency may, as its necessity, have the Deputy Director appointed by the Head of the Regional Government. 2. ምክትል ዳይሬክተሩ ተጠሪነቱ ለዳይሬክተሩ ሆኖ፤ ሀ/ በዳይሬክተሩ ተለይተው የሚሰጡትን ተግባራት ያከናውናል፤ ለ/ ዳይሬክተሩ በማይኖርበት ወይም ሥራውን ለማከናወን በማይችልበት ጊዜና ሁኔታ እርሱን ተክቶ ይሰራል። 2. The Deputy Director shall be accountable to the Director General and hence: a. Carryout the specified tasks given by the Director. b. Represent the Director and carry out his official functions where he is absent or unable to perform his duty. ክፍል አራት ልዩ ልዩ ድንጋጌዎች PART FOUR MISCELLANEOUS PROVISIONS 10. ስለበጀት 10. Budget የኤጄንሲው በጀት በክልሉ መንግሥት ይመደባል። The budget of the Agency shall be allocated by the Regional Government. 11. ስለ ሂሣብ መዛግብት 11. Books of Account 1. ኤጄንሲው የተሟሉና ትክክለኛ የሆኑ የሂሣብ መዛግብትን ይይዛል 1. The Agency shall keep complete and accurate books of account. 2. የኤጄንሲው የሂሣብ መዛግብትና ገንዘብም ሆነ ንብረት ነክ ሰነዶች በክልሉ ዋና ኦዲተር መስሪያ ቤት ወይም እርሱ በሚሰይማቸው ኦዲተሮች በየጊዜው ይመረመራሉ። 2. Repealed and Inapplicable Laws ከዚህ ደንብ ጋር የሚቃረን ማናቸውም ሌላ ደንብ፣ መመሪያ ወይም የተለመደ አሠራር በዚህ ደንብ ውስጥ በተሸፈኑት ጉዳዮች ላይ ተፈፃሚነት አይኖረውም። Any other regulation, directive, or customary practices which are inconsistent with the issues covered under this regulation shall not be applicable thereto. 13. መብትና ግዴታ ስለማስተላላፍ 13. Transfer of Rights and Obligations. ኤጄንሲውን የሚመለከቱት ሆነው በቀደምት ህግጋትና ደንቦች አማካኝነት ለቢሮው ተሠጥተው የነበሩ መብቶችና ግዴታዎች በዚህ ደንብ መሠረት ወደተቋቋመው ኤጀንሲ ተላልፈዋል። The laws and regulations reflecting the rights and obligations of the Agency, that were vested for the Bureau, are hereby transferred to the Agency established as per this regulation hereof. 14. መመሪያ የማውጣት ስልጣን 14. Power to Issue Directives ይህንን ደንብ በተሟላ ሁኔታ በሥራ ላይ ለማዋል የሚያስፈልጉትን መመሪዎች ኤጄንሲው ሊያወጣ ይችላል። The Agency may issue directives necessary for the full implementation of this regulation. 15. ደንቡ የሚፀናበት ጊዜ 15.
