Powers and Duties of the Prime Minister 3. ስለጠቅላይ ሚኒስትሩ ሥልጣንና ተግባር The powers and duties of the Prime Minister of የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ the Federal Democratic Republic of Ethiopia ጠቅላይ ሚኒስትር ሥልጣንና ተግባር በሕገ shall be as specified under Article 74 of the መንግሥቱ አንቀጽ &4 የተመለከተው ይሆናል፡፡ Constitution.

Powers and Duties of the Deputy Prime 4. ስለምክትል ጠቅላይ ሚኒስትሩ ሥልጣንና Minister ተግባር የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ The powers and duties of the Deputy Prime ምክትል ጠቅላይ ሚኒስትር ሥልጣንና ተግባር Minister of the Federal Democratic Republic of በሕገ መንግሥቱ አንቀጽ &5 የተመለከተው Ethiopia shall be as specified under Article 75 of ይሆናል፡፡ the Constitution. 5. ስለሚኒስትሮች ምክር ቤት ሥልጣንና ተግባር 5. Powers and Duties of the Council of Ministers የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ The powers and duties of the Council of የሚኒስትሮች ምክር ቤት ሥልጣንና ተግባር Ministers of the Federal Democratic Republic of Ethiopia shall be as specified under Article 77 of በሕገ መንግሥቱ አንቀጽ &7 የተመለከተው the Constitution. ይሆናል፡፡

6 — Members of the Council of Ministers

6. Members of the Council of Ministers 6. የሚኒስትሮች ምክር ቤት አባላት 1/ The Council of Ministers shall have the 1/ የሚኒስትሮች ምክር ቤት የሚከተሉት following members: አባላት ይኖሩታል፡- a) the Prime Minister; ሀ/ ጠቅላይ ሚኒስትር፤ b) the Deputy Prime Minister; ለ/ ምክትል ጠቅላይ ሚኒስትር፤ c) Ministers heading the ministries specified under Article 9 of this ሐ/ በዚህ አዋጅ አንቀጽ 9 የተመለከቱትን Proclamation; and ሚኒስቴሮች የሚመሩ ሚኒስትሮች፤ እና d) other officials to be designated by the መ/ በጠቅላይ ሚኒስትሩ የሚሰየሙ ሌሎች Prime Minister. ባለሥልጣኖች፡፡ 2/ Where any Minister referred to in sub-article 2/ በዚህ አንቀጽ ንዑስ አንቀጽ /1//ሐ/ የተመለ (1)(c) of this Article cannot attend the ከተው ማንኛውም ሚኒስትር በምክር ቤቱ ስብሰባ meeting of the Council, the Minister of State ላይ ሊገኝ በማይችልበት ጊዜ የሚኒስቴሩ ሚኒስ of the Ministry or, in the absence of Minister ትር ዴኤታ ወይም ሚኒስትር ዴኤታ ከሌለ of State, the Vice Minister shall take part in ምክትል ሚኒስትር በምክር ቤቱ ስብሰባ ላይ the meeting of the Council. Meeting Procedure of the Council of Ministers 1/ የሚኒስትሮች ምክር ቤት፡- 1/ The Council of Ministers shall: a) have its own procedural manuals; ሀ/ የራሱ የውስጥ ደንብ ይኖረዋል፤ ለ/ በውስጥ ደንቡ በሚወሰነው መሠረት b) conduct ordinary and extraordinary መደበኛና አስቸኳይ ስብሰባዎች meetings in accordance with its rules of ያደርጋል፤ procedure; ሐ/ ምልአተ ጉባኤ የሚኖረው ከአባላቱ c) have a quorum where more than half of ከግማሽ በላይ ሲገኙ ይሆናል፤ its members are present; d) pass decisions by consensus or, failing መ/ የሚያስተላልፈው ውሳኔ በተባበረ that, by majority vote. ድምጽ ይሆናል፤ በተባበረ ድምጽ መወሰን ካልተቻለ በድምጽ ብልጫ ይወሰናል፡፡ 2/ The Prime Minister shall: 2/ ጠቅላይ ሚኒስትሩ፡- ሀ/ የሚኒስትሮች ምክር ቤት አባላት a) without prejudice to the rights of the አጀንዳ የማስያዝ መብታቸው እንደ members of the Council of Ministers to ተጠበቀ ሆኖ፣ ለምክር ቤቱ በአጀንዳ propose agenda items, determine the የሚቀርቡ ጉዳዮችን ይወስናል፤ agenda of the Council; b) preside over the meetings of the ለ/ የምክር ቤቱን ስብሰባ ይመራል፤ Council; ሐ/ ለምክር ቤቱ በአጀንዳ የቀረበ ጉዳይ c) adjourn the meetings of the Council በሚመለከተው የምክር ቤቱ ኮሚቴ under circumstances where he finds it መታየት የሚያስፈልገው ሆኖ ካገኘው necessary to refer a case, included in the ስብሰባውን ለሌላ ጊዜ ያስተላልፋል፡፡ Council’s agenda, to the relevant committee of the Council. 3/ ጠቅላይ ሚኒስትሩ በማይኖርበት ጊዜ 3/ In the absence of the Prime Minister, the ምክትል ጠቅላይ ሚኒስትሩ የምክር ቤቱን Deputy Prime Minister shall preside over the ስብሰባ ይመራል፡፡ meetings of the Council. 8. የምክር ቤቱ ቋሚ ኮሚቴዎች 8. Establishment የሚከተሉት ሚኒስቴሮች በዚህ አዋጅ ተቋቁመዋል፡- The following Ministries are hereby established: gA 5¹þ6)!9 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5629 1/ የአገር መከላከያ ሚኒስቴር፤ 1/ the Ministry of National Defense; 2/ የፌዴራል ጉዳዮች ሚኒስቴር፤ 2/ the Ministry of Federal Affairs; 3/ የውጭ ጉዳይ ሚኒስቴር፤ 3/ the Ministry of Foreign Affairs; 4/ the Ministry of Justice; 4/ የፍትሕ ሚኒስቴር፤ 5/ the Ministry of Civil Service; 5/ የሲቪል ሰርቪስ ሚኒስቴር፤ 6/ የገንዘብና የኢኮኖሚ ልማት ሚኒስቴር፤ 6/ the Ministry of Finance and Economic Development; 7/ የግብርና ሚኒስቴር፤ 7/ the Ministry of Agriculture; 8/ የኢንዱስትሪ ሚኒስቴር፤ 8/ the Ministry of Industry; 9/ የንግድ ሚኒስቴር፤ 9/ the Ministry of Trade; 10/ the Ministry of Science and Technology; 0/ የሳይንስና ቴክኖሎጂ ሚኒስቴር 11/ the Ministry of Transport; 01/ የትራንስፖርት ሚኒስቴር፤ 02/ የመገናኛና ኢንፎርሜሽን ቴክኖሎጂ 12/ the Ministry of Communications and ሚኒስቴር፤ Information Technology; 03/ የከተማ ልማትና የኮንስትራክሽን ሚኒስ 13/ the Ministry of Urban Development and ቴር፤ Construction; 04/ የውሃና ኢነርጂ ሚኒስቴር፤ 14/ the Ministry of Water and Energy; 05/ የማዕድን ሚኒስቴር፤ 15/ the Ministry of Mines; 16/ the Ministry of Education; 06/ የትምህርት ሚኒስቴር፤ 17/ the Ministry of Health; 07/ የጤና ጥበቃ ሚኒስቴር፤ 08/ የሠራተኛና ማኅበራዊ ጉዳይ ሚኒስ ቴር፤ 18/ the Ministry of Labour and Social Affairs; 09/ የባህልና ቱሪዝም ሚኒስቴር፤ 19/ the Ministry of Culture and Tourism; !/ የሴቶች፣ የሕፃናትና የወጣቶች ጉዳይ 20/ the Ministry of Women, Children and Youth ሚኒስቴር፡፡ Affairs. 0. የሚኒስቴሮች የወል ሥልጣንና ተግባር 10. Common Powers and Duties of Ministries Each Ministry shall have the powers and duties እያንዳንዱ ሚኒስቴር፡- to: 1/ በሥራው መስክ፡- 1/ in its area of jurisdiction: ሀ/ ፖሊሲዎችንና ሕጎችን ያመነ a) initiate policies and laws, prepare ጫል፣ ዕቅድና በጀት ያዘጋጃል፣ plans and budgets, and upon approval ሲፈቀድም በሥራ ላይ ያውላል፤ implement same; gA 5¹þ6)" ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5630 ለ/ የፌዴራል መንግሥቱ ሕጎች በሥራ b) ensure the enforcement of the federal ላይ መዋላቸውን ያረጋግጣል፤ government laws; ሐ/ የጥናትና ምርምር ተግባሮችን ያከ c) undertake study and research; collect, ናውናል፤ መረጃዎችን ይሰበስባል፣ compile and disseminate information; ያቀነባብራል፣ ያሰራጫል፤ d) undertake capacity building activities; መ/ የአቅም ግንባታ ሥራዎችን ያከናውናል፤ e) provide assistance and advice to ሠ/ ለክልሎች እንዳስፈላጊነቱ ድጋፍና regional states, as necessary; and ምክር ይሰጣል፤ እንዲሁም ልዩ provide coordinated support to ድጋፍ ለሚሹ ክልሎች በፌዴራል regional states eligible for affirmative ጉዳዮች ሚኒስቴር አስተባባሪነት support as coordinated by the Ministry የተቀናጀ ድጋፍ ያደርጋል፤ of Federal Affairs; ረ/ በሕግ መሠረት ውሎችንና ዓለም f) enter into contracts and international አቀፍ ስምምነቶችን ያደርጋል፤ agreements in accordance with the law; 2/ በማቋቋሚያ ሕጎቻቸው ወይም በዚህ 2/ direct and coordinate the performances of አዋጅ አንቀጽ "3 ተጠሪ የተደረጉለትን the executive organs made accountable to አስፈጻሚ አካላት አፈጻጸም በበላይነት it under the laws establishing them or ይመራል፤ ያስተባብራል፤ አደረጃጀቶቻ under Article 33 of this Proclamation; ቸውን እንዲሁም የሥራ ፕሮግራሞቻቸ review the organizational structures as ውንና በጀቶቻቸውን መርምሮ ለሚመለ well as the work programs and budgets of ከተው የመንግሥት አካል እንዲቀርቡ the executive organs and approve their ይወስናል፤ submission to the appropriate government organs; 3/ ተጠሪ የተደረጉለትን የመንግሥት የል 3/ supervise the public enterprises made ማት ድርጅቶች በመንግሥት የልማት accountable to it in accordance with the ድርጅቶች አዋጅ ቁጥር !5/09)'4 መሠ Public Enterprises Proclamation No. ረት ይቆጣጠራል፣ የልማት አጋZ ሆነው 25/1992, and ensure that they operate as development catalysts; መሥራታቸውንም ያረጋግጣል፤ 4/ የሚያዘጋጃቸው ፖሊሲዎች፣ ሕጎች፣ 4/ address women and youth affairs in the የልማት ፕሮግራሞችና ፕሮጀክቶች preparation of policies, laws and የሴቶችንና የወጣቶችን ጉዳይ እንዲ development programs and projects; ያካትቱ መደረጋቸውን ያረጋግጣል፤ 5/ የአካል ጉዳተኞችና የኤች.አይ.ቪ. ኤድስ 5/ create, within its powers, conditions ተጠቂዎች በኃላፊነቱ ክልል የእኩል whereby persons with disabilities and ዕድል ተጠቃሚና ሙሉ ተሳታፊ H.I.V. AIDS victims benefit from equal የሚሆኑበትን ሁኔታ ያመቻቻል፤ opportunities and full participation; 6/ exercise the powers and duties given to it 6/ በዚህ አዋጅና በሌሎች ሕጎች የተሰጡትን under this Proclamation and other laws; ሥልጣንና ተግባሮች በሥራ ላይ ያውላል፤ 7/ አስፈላጊ ሆኖ ሲገኝ ከሥልጣንና ተግባሩ 7/ where necessary, delegate part of its በከፊል ለሌላ የፌዴራል ወይም የክልል powers and duties to other federal or አካል በውክልና ሊሰጥ ይችላል፤ regional state organs; gA 5¹þ6)"1 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5631 8/ ስለሥራው ክንዋኔ በየወቅቱ ለጠቅላይ 8/ submit periodic performance reports to the ሚኒስትሩና ለሚኒስትሮች ምክር ቤት Prime Minister and the Council of ሪፖርት ያቀርባል፡፡ Ministers. 01. የሚኒስትሮች ተጠሪነትና ኃላፊነት

11 — Accountability and Responsibility of Ministers

11. Accountability and Responsibility of Ministers እያንዳንዱ ሚኒስትር፡- Each Minister shall: 1/ ተጠሪነቱ ለጠቅላይ ሚኒስትሩና ለሚኒ 1/ be accountable to the Prime Minister and ስትሮች ምክር ቤት ይሆናል፤ the Council of Ministers; 2/ የሚመራውን ሚኒስቴር ይወክላል፣ 2/ represent and exercise the powers and ሥልጣንና ተግባሩን ሥራ ላይ ያውላል፤ duties of the Ministry he is heading; 3/ ለሚኒስቴሩ በተፈቀደው በጀትና የሥራ 3/ effect payments in accordance with the ፕሮግራም መሠረት ገንዘብ ወጪ budget and work programs approved for ያደርጋል፤ the Ministry; 4/ ensure the implementation of performance 4/ በሚኒስቴሩ ውስጥ የአፈጻጸም አመራር management system within the Ministry. ሥርዓት ተግባራዊ መደረጉን ያረጋግጣል፡፡ 02. የሚኒስትር ዴኤታዎችና የምክትል ሚኒስ 12. Accountability and Responsibility of Ministers ትሮች ተጠሪነትና ኃላፊነት of State and Vice Ministers 1/ የእያንዳንዱ ሚኒስቴር ሚኒስትር ዴኤታ 1/ Each Minister of State or Vice Minister of a ወይም ምክትል ሚኒስትር ተጠሪነቱ Ministry shall be accountable to the Minister ለሚኒስትሩ ሆኖ ተለይተው የሚሰጡትን and shall carry out the responsibilities ተግባሮች ያከናውናል፡፡ specifically entrusted to him. 2/ The Minister of State or, in the absence of 2/ ሚኒስትሩ በማይኖርበት ጊዜ ሚኒስትር Minister of State, the Vice Minister shall act ዴኤታ ወይም ሚኒስትር ዴኤታ ከሌለ on behalf of the Minister in his absence. ምክትል ሚኒስትር ተክቶት ይሠራል፡፡ Where there are more than one Ministers of ከአንድ በላይ ሚኒስትር ዴኤታዎች ካሉ State or where, in the absence of Minister of ወይም ሚኒስትር ዴኤታ ሳይኖር ከአንድ State, there are more than one Vice በላይ ምክትል ሚኒስትሮች ካሉ እና Ministers, the senior Minister of State or ሚኒስትሩ በተለይ ካልወከለ በሹመት Vice Minister shall act on behalf of the ቅድሚያ ያለው ሚኒስትር ዴኤታ ወይም Minister in his absence. ምክትል ሚኒስትር ተክቶት ይሠራል፡፡ 03. የሀገር መከላከያ ሚኒስቴር 13. The Ministry of National Defense The Ministry of National Defense shall have የሀገር መከላከያ ሚኒስቴር የሚከተሉት the powers and duties to: ሥልጣንና ተግባሮች ይኖሩታል፡- 1/ defend the territorial integrity of the 1/ አግባብ ካላቸው አካላት ጋር በመተባበር country in cooperation with the የሀገሪቱን የግዛት ሉዐላዊነት ያስከብራል፤ appropriate organs; 2/ መከላከያ ሠራዊት ያቋቁማል፣ ያስታ 2/ establish, equip and supervise the defense ጥቃል፣ ይቆጣጠራል፣ የውጊያ ብቃቱን forces and ensure their combat ያረጋግጣል፤ capabilities; gA 5¹þ6)"2 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5632 3/ የሀገሪቱ የመከላከያ ሠራዊት የብሔሮች፣ 3/ ensure that the composition of the national የብሔረሰቦችና የሕዝቦችን ሚዛናዊ defense forces reflect equitable ተዋጽኦ ያካተተ መሆኑንና ተግባሩንም representation of nations, nationalities and ከፖለቲካ ድርጅት ወገናዊነት ነፃ በሆነ peoples and that they carry out their አኳኋን ማከናወኑን ያረጋግጣል፤ functions free of any partisanship to any political organization; 4/ የመከላከያ ሠራዊት ማሠልጠኛ ተቋማት 4/ organize training establishments for the እንዲደራጁ ያደርጋል፤ defense forces; 5/ ከክልል አቅም በላይ የሆነ የፀጥታ 5/ enforce security measures and the መደፍረስ ሲያጋጥም ወይም ማናቸውም constitutional order, when instructed in ክልል ሕገ መንግሥቱን በመጣስ ሕገ accordance with the provisions of the መንግሥታዊ ሥርዓቱን አደጋ ላይ ሲጥል Constitution, where situations endangering በሕገ መንግሥቱ በተደነገገው መሠረት public safety are beyond the control of ሲታዘዝ ፀጥታንና ሕገ መንግሥታዊ regional states or where any Regional ሥርዓቱን ያስከብራል፤ State violates the Constitution and endangers the constitutional order; 6/ የሽምቅ ውጊያንና ሽብርተኝነትን ይከላከላል፤ 6/ combat guerrilla and terrorist activities; 7/ የጦር ሠፈሮችንና ለሠራዊቱ የሚያስ 7/ construct and cause the construction of ፈልጉትን የመኖሪያ ሠፈሮች ይሠ military camps and residential quarters ራል፣ያሰራል፤ required for the defense forces; 8/ በክተት ጊዜ በአገር ውስጥ የሚገኝ ሃብት 8/ prepare plans and get authorizations for በተቀናጀ ሁኔታ ጥቅም ላይ የሚውልበትን the coordinated utilization of resources in ዘዴ እያጠና ያስወስናል፤ the country that may be required in an event of national mobilization; 9/ የክተት አዋጅ በሚታወጅበት ጊዜ ኅብ ረተሰቡ ከጠላት ጥቃት ራሱን የሚከላ 9/ prepare schemes whereby the public can ከልበትን ዕቅድ ያወጣል፣ ሲፈቀድም defend or guard itself against enemy ከሚመለከታቸው አካላት ጋር በመተባበር threats when general mobilization is ሥራ ላይ እንዲውል ያደርጋል፤ declared; and, upon authorization, implement same in cooperation with concerned organs; 0/ በጦርነት ወይም በአስቸኳይ ጊዜ አዋጅ የመከላከያ ሠራዊትን የሚቀላቀል፣ እን 10/ recruit, train and organize national reserve ዲሁም ሰው ሠራሽም ሆነ የተፈጥሮ force that shall join the armed forces in አደጋዎች ሲከሰቱ ዕገዛ የሚያደርግ time of war or state of emergency and that ብሔራዊ ተጠባባቂ ኃይል ይመለምላል፣ shall provide assistance in the event of ያሰለጥናል፣ ያደራጃል፤ man-made or natural disasters; 01/ ሀገር መከላከልን በሚመለከት አግባብ 11/ coordinate the activities of, and cooperate ያላቸውን የፌዴራልና የክልል አካላት with the appropriate federal and regional ያስተባብራል፣ በመተባበርም ይሠራል፤ state organs in matters relating to the defense of the country; 02/ ሀገሪቱ የሚቀርብላትን አለም አቀፍ 12/ organize and deploy competent peacekeeping የሰላም ማስከበር ጥሪ በአግባቡ ለመወ forces where the country is required to ጣት የሚያስችል የሰላም አስከባሪ ኃይል participate in international peacekeeping ያደራጃል፣ ያሰማራል፤ missions; 03/ ከሚከተሉተት ምንጮች የሚገኘውን ገቢ 13/ retain and utilize, upon obtaining the የሚኒስትሮች ምክር ቤትን እያስፈቀደ ለሀገር approval of the Council of Ministers: መከላከያ አቅም ግንባታ እንዲውል ያደርጋል፡- gA 5¹þ6)"3 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5633 ሀ/ የመከላከያ ተቋማት በሰላም ጊዜ የሚኖ a) revenue generated by engaging idle ራቸውን የማምረትና አገልግሎት የመስ facilities of defense institutions, in ጠት ትርፍ አቅም ለገቢ ማስገኛ ተግባር peace times, in income generating እንዲውል በማድረግ የሚገኘውን ገቢ፤ activities; ለ/ ለመከላከያ ጠቀሜታ የማያስፈልጉ b) the proceeds of disposal of properties ንብረቶችን በማስወገድ የሚገኘውን which are no more required for ገቢ፤ እና defense purposes; and ሐ/ በተቆጣጣሪ ባለሥልጣንነት ከሚመራ c) dividends from enterprises put under its ቸው ድርጅቶች የሚገኘውን የትርፍ supervision; ድርሻ፤ for national defense capacity building projects; 04/ በዚህ አንቀጽ ንዑስ አንቀጽ /03/ የተመለ 14/ ensure that the procedures and standards ከተው ገንዘብ አስተዳደር በፋይናንስ አስ embodied in the Financial Administration ተዳደር አዋጅ ቁጥር 6)#8/2ሺ1 እና በአ Proclamation No. 648/2009 and regulations and directives issued there ዋጁ መሠረት በወጡ ደንቦችና መመሪያ under are followed in the administration of ዎች የተደነገጉትን ሥርዓቶችና መመዘኛ the fund referred to in sub-article (13) of ዎች ተከትሎ መፈጸሙን ያረጋግጣል፣ this Article and submit same for auditing በዋናው ኦዲተርም እንዲመረመር by the Auditor General; ያደርጋል፤ 15/ ensure that the defense forces participate 05/ የሠራዊቱ አባላት በሠላም ጊዜ በአገሪቱ in the country’s development activities in የልማት ሥራዎች እንዲሳተፉ ያደርጋል፡፡ times of peace. 04. የፌዴራል ጉዳዮች ሚኒስቴር 14. The Ministry of Federal Affairs 1/ The Ministry of Federal Affairs shall have 1/ የፌዴራል ጉዳዮች ሚኒስቴር የሚከ the powers and duties to: ተሉት ሥልጣንና ተግባሮች ይኖሩታል፡- ሀ/ የሕዝቡ ሰላም መጠበቁን በማረጋገጥ a) cooperate with concerned federal and ረገድ አግባብ ካላቸው የፌዴራልና regional state organs in maintaining የክልል መንግሥት አካላት ጋር public order; በመተባበር ይሰራል፤ ለ/ የኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ b) without prejudice to the provisions of ሪፐብሊክ ሕገ መንግሥት አንቀጽ #8 Article 48 and 62(6) of the Constitution of እና %2/6/ ድንጋጌዎች እንደተጠበቁ the Federal Democratic Republic of ሆነው፣ በክልሎች መካከል የሚነሱ Ethiopia, facilitate the resolution of disputes arising between regional states; አለመግባባቶች የሚፈቱባቸውን ሁኔታ ዎች ያመቻቻል፤ ሐ/ አግባብ ያላቸው ሕጎች እንደተጠበቁ c) without prejudice to the provisions of ሆነው፣ ከክልሎች ጥያቄ ሲቀርብ the relevant laws and upon requests of በክልሎች ውስጥ የሚፈጠሩ አለመ regional states, devise and implement ግባባቶችና ግጭቶች በዘላቂነት የሚ sustainable political solutions for ፈቱበትን ፖለቲካዊ መፍትሔ ይቀ disputes and conflicts that may arise ይሳል፣ ተግባራዊ ያደርጋል፤ within regional states; መ/ ፌዴራል መንግሥቱ በክልሎች ጉዳይ d) coordinate the implementation of ጣልቃ እንዲገባ ሲወስን አፈጻጸሙን decisions authorizing the intervention ያስተባብራል፤ of the federal government in the affairs of regional states; gA 5¹þ6)"4 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5634 ሠ/ በፌዴራል መንግሥትና በክልሎች e) serve as a focal point in creating good መካከል በመግባባትና በአጋርነት ላይ federal-regional relationship and የተመሠረተ መልካም ግንኙነትና ትብብር cooperation based on mutual እንዲኖር በማድረግ የፌዴራል ሥርዓቱ understanding and partnership and እንዲጠናከር የግንኙነቱ ማዕከል ሆኖ thereby strengthen the federal system; ያገለግላል፤ ረ/ ለክልሎች በተለይም ልዩ ድጋፍ f) provide assistance to regional states ለሚሹ ክልሎች ትኩረት በመስጠት particularly to those deserving special ድጋፍ ያደርጋል፤ support; ሰ/ ሌሎች የፌዴራል መንግሥት አካላት ልዩ g) coordinate, integrate and follow up ድጋፍ ለሚሹ ክልሎች የሚያደርጓቸውን supports given by other federal organs ድጋፎች ያስተባብራል፣ ያቀናጃል፣ አፈጻ to regional states deserving special ጸሙን ይከታተላል፤ support; ሸ/ በተለያዩ ሃይማኖቶችና እምነቶች ተከታ h) work in collaboration with pertinent ዮች መካከል ሠላምና መከባበር እንዲ government organs, religious ሰፍን ለማድረግና ግጭትንም ለመከላከል institutions and other organs to ensure እንዲቻል አግባብ ካላቸው የመንግሥት that peace and mutual respect will አካላት፣ የሃይማኖት ተቋማትና ከሌሎች prevail among followers of different ማናቸውም አካላት ጋር በመተባበር ይሠ religions and beliefs, and to be able to ራል፤ የሃይማኖት ድርጅቶችንና ማኀበ prevent conflicts; register religious ራትን ይመዘግባል፤ organizations and associations; ቀ/ የፌዴራል ፖሊስ፣ የፌዴራል ማረሚያ ቤቶችና ፈንጂ የማምከን ሥራዎች i) ensure the proper execution of በአግባቡ እንዲከናወኑ መደረጋቸውን functions relating to federal police, ያረጋግጣል፤ federal prisons and minesweeping; በ/ የጦር መሣሪያ፣ የተኩስ መሣሪያ ወይም j) issue permit for the possession or use ፈንጂ ለመያዝ ወይም በእነዚሁ ለመ of arms, firearms and explosives; ጠቀም ፈቃድ ይሰጣል፣ ፈንጂ ስለሚ determine conditions applicable for ሸጥበት ሁኔታ ይወስናል፣ ፈንጂ ለሚሸ the selling of explosives; issue permits ጡና የጦር ወይም የተኩስ መሣሪያ for the selling and repairing of arms ለሚያድሱ ፈቃድ ይሰጣል፤ and fire arms; ተ/ በፌዴራል ደረጃ የሚከናወኑ የበጎ k) ensure the proper execution at the አድራጎት ድርጅቶችና የማኅበራት federal level of functions relating to ምዝገባ ሥራዎች በአግባቡ እንዲ the registration of charities and ከናወኑ መደረጋቸውን ያረጋግጣል፡፡ societies. 2/ The powers and duties given to the 2/ በሥራ ላይ ባሉ የሌሎች ሕጎች ድን Ministry of Justice, with respect to matters ጋጌዎች የበጎ አድራጎት ድርጅቶችና relating to charities and societies, by the ማኅበራትን በሚመለከት ለፍትህ ሚኒስ provisions of other laws, currently in ቴር ተሰጥተው የነበሩ ሥልጣንና force, are hereby given to the Ministry of ተግባሮች በዚህ አዋጅ ለፌዴራል ጉዳዮች Federal Affairs. ሚኒስቴር ተሰጥተዋል፡፡ 05. የውጭ ጉዳይ ሚኒስቴር 15. The Ministry of Foreign Affairs The Ministry of Foreign Affairs shall have the የውጭ ጉዳይ ሚኒስቴር የሚከተሉት powers and duties to: ሥልጣንና ተግባሮች ይኖሩታል፡- gA 5¹þ6)"5 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5635 1/ ሀገሪቱ በሚኖራት የውጭ ግንኙነት 1/ safeguard the interests and rights of the ጥቅሟና መብቷ እንዲጠበቅና በሌሎች country in connection with its foreign መንግሥታት እንዲከበር ያደርጋል፤ relations and ensure that they are respected by foreign states; 2/ ሀገሪቱ ከጎረቤት ሀገሮች ጋር ያላት 2/ ensure that the country’s good relations መልካም ጉርብትና እንዲጠናከር with neighboring countries are strengthened; ያደርጋል፤ 3/ in consultation with the concerned organs, 3/ ሥልጣኑ በተለይ ለሌላ አካል በሕግ ካልተሰጠ negotiate and sign, upon approval by the በስተቀር፣ ኢትዮጵያ ከሌሎች መንግሥታትና government, treaties that Ethiopia enters ዓለም ዓቀፍ ድርጅቶች ጋር የምታደርጋቸውን into with other states and international በመንግሥት የተፈቀዱ ዓለም አቀፍ ውሎች organizations, except in so far as such ጉዳዩ ከሚመለከታቸው አካላት ጋር በመመ ካከር ይፈርማል፤ እንዲሁም ዓለም አቀፍ power is specifically given by law to other ውሎች እንዲጸድቁ ለማድረግ የሚያስፈ organs; and effect all formalities of ልጉትን ፎርማሊቲዎች ሁሉ ያከናውናል፤ ratification of treaties; 4/ ሥልጣኑ በተለይ ለሌላ አካል ካልተሰጠ 4/ ensure the enforcement of rights and በስተቀር፣ የኢትዮጵያ መንግሥት የፈረ obligations arising from treaties signed by ማቸው ዓለም አቀፍ ውሎች የሚያስከት the Ethiopian government except in so far ሏቸው መብቶችና ግዴታዎች መከበራቸ as specific power has legally been ውን ያረጋግጣል፤ delegated to other organs; 5/ ኢትዮጵያ ከሌሎች መንግሥታትና ዓለም አቀፍ ድርጅቶች ጋር የምታደርጋቸውን ዓለም 5/ register and keep all authentic copies of አቀፍ ውሎች የተመሰከረባቸውን ዋናዎቹን treaties concluded between Ethiopia and ቅጅዎች መዝግቦ ይጠብቃል፤ other states and international organizations; 6/ የኢትዮጵያ መንግሥት በብዙ መንግሥታት መካከል የሚደረጉ ዓለም አቀፍ ውሎችን አስ 6/ perform the functions of a depository of ቀማጭ በሚሆንበት ጊዜ ይኸው ባለአደራነት multilateral treaties when the Ethiopian የሚጠይቀውን ተግባር ያከናውናል፤ government is a depository of such treaties; 7/ በውጭ ሀገር የኢትዮጵያ የዲፕሎማቲክና የቆንስላ ሚስዮኖችን እንዲሁም በዓለም አቀፍ 7/ coordinate and supervise the activities of ድርጅቶች የኢትዮጵያ ቋሚ መልእክተኞች Ethiopia’s diplomatic and consular missions ጽሕፈት ቤቶችን ተግባራት ያስተባብራል፣ and permanent missions of Ethiopia to ሥራቸውንም ይቆጣጠራል፤ international organizations; 8/ ሌሎች የመንግሥት አካላት ከውጭ ሀገር መንግሥታትና ከዓለም አቀፍ ድርጅቶች ጋር 8/ coordinate all relations of other የሚያደርጓቸውን ግንኙነቶች ያስተባብራል፤ government organs with foreign states and international organizations; 9/ በኢትዮጵያ ከሚገኙ የውጭ ሀገሮች መን ግሥታት እንደራሴዎች፣ ቆንስሎችና የዓለም 9/ keep contacts, as may be necessary, with አቀፍ ድርጅቶች ወኪሎች ጋር እንደ foreign diplomatic and consular representatives አስፈላጊነቱ በመገናኘት የጋራ ጥቅሞች in Ethiopia as well as with representatives of የሚጠበቁበትን ሁኔታ ያመቻቻል፤ international organizations with a view to facilitating the protection of mutual interests; 0/ በዓለም ዐቀፍ ሕግና ኢትዮጵያ በተቀ 10/ ensure that privileges and immunities በለቻቸው ዓለም አቀፍ ውሎች ለውጭ አገር accorded to foreign diplomatic missions መንግሥታት እንደራሴዎችና ለዓለም አቀፍ and representatives of international ድርጅቶች ወኪሎች የተሰጡ መብቶች እንዲከበሩ ያደርጋል፤ organizations under international laws and treaties to which Ethiopia is a party are respected; gA 5¹þ6)"6 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5636 01/ አግባብ ባለው ሕግ መሠረት የዲፕ 11/ issue diplomatic and service passports and ሎማቲክና ሰርቪስ ፓስፖርቶች እና diplomatic and service entry visas in የዲፕሎማቲክና ሰርቪስ መግቢያ ቪዛዎች accordance with the relevant laws; ይሰጣል፤ 12/ through pursuing economic diplomacy, cooperate with the concerned organs in: 02/ የኢኮኖሚ ዲፕሎማሲ በማካሄድ፡- a) promoting the country’s foreign trade ሀ/ የሃገሪቱን የውጭ ንግድና ቱሪዝም and tourism; በማስፋፋት፤ ለ/ የውጭ ኢንቨስተሮችን በመለየትና b) identifying and attracting foreign በመሳብ፤ investors; ሐ/ የውጭ የልማት ፋይናንስና የቴክኒክ ተራድኦ የሚገኝበትን ሁኔታ በማመ c) facilitating the mobilization of ቻቸት፤ external financial and technical ረገድ ከሚመለከታቸው አካላት ጋር ይተባበ assistances. ራል፡፡ 13/ ensure that the interests and the rights of 03/ በውጭ ሀገር የሚኖሩ ኢትዮጵያዊያን መብትና Ethiopians residing abroad are protected; ጥቅም እንዲጠበቅ ያደርጋል፤ በኢትዮጵ encourage and support associations formed ያውያን ማኅበረሰብና በኢትዮጵያ ወዳጆች by Ethiopian communities and friends of የተመሠረቱ ማኅበራትን ያበረታታል፣ ድጋፍ Ethiopia. ይሰጣል፡፡

06. የፍትሕ ሚኒስቴር የፍትሕ ሚኒስቴር የሚከተሉት ሥልጣንና ተግባሮች ይኖሩታል፡- 1/ 1/ የሕግ ጉዳዮችን በሚመለከት የፌዴራል መንግሥት ዋና አማካሪ ሆኖ ይሰራል፤ 2/ 2/ የሕግ ማሻሻያ ጥናቶችን እንዲሁም የኮዲፊ ኬሽንና የፌዴራል ሕጐችን የማጠቃለል ሥራ ያካሂዳል፤ የክልሎችን ሕጎች ያሰባስባል፣ እንደአስፈላጊ ነቱም እንዲጠቃለሉ ያደርጋል፤ 3/ 3/ በፌዴራል መንግሥት አካላትና በክልሎች ጥያቄ ሲቀርብለት የሕግ ረቂቆች በማዘጋጀት ይረዳል፤ 4/ የወንጀል መነሻዎችን ያጠናል፣ ቀንስበትን ሥልት ይቀይሳል፤ ላከል ረገድ የሚመለከታቸውን መንግሥታዊ አካላትና ኅብረተሰቡን ያስተባብራል፤ 5/ 5/ በፌዴራል ፍርድ ቤቶች ሥልጣን ሥር የሚወድቅ ወንጀል ተፈጽሟል ብሎ ሲያምን ምርመራ ያካሂዳል ወይም እንዲካሄድ ያደርጋል፣ የምርመራ ሂደቱን ይመራል፣ ይቆጣጠራል፤ የጥፋተኝነት ድርድር ይፈቅዳል፣ በቂ ምክንያት ሲኖር የተጀመረን ምርመራ ያቋርጣል ወይም ተጨማሪ ምርመራ ያከናውናል፤ gA 5¹þ6)"7 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 6/ የፌዴራል መንግሥትን በመወከል የወንጀል ክስ ይመሰርታል፤ ይከራከ ራል፤ በቂ ምክንያት ሲኖር በሕግ መሠረት ክሱን ያነሳል፤ ፍርድ ቤቶች የሚሰጧቸው ውሳኔዎች መፈጸማቸውን ይከታተላል፤ 7/ የወንጀል ፍትህ መረጃዎች አሰባሰብ፣ አያያዝና ሥርጭት ሥርዓት ይዘረጋል፤ ለሚመለከታቸው የፍትህ አካላት ድጋፍ ይሰጣል፤ 8/ የሕዝቡን እንዲሁም የፌዴራል መንግሥትን መብትና ጥቅም ለማስከበር በማናቸውም የፍትሐብሔር ጉዳይ የፌዴራል መንግሥት መሥሪያ ቤቶችንና የልማት ድርጅቶችን በመወከል ሥልጣኑ በሚፈቅድለት ፍርድ ቤት ወይም በማንኛውም ዳኝነት ሰሚ አካል ክስ ይመሰርታል ወይም በማናቸውም የክርክር ደረጃ ጣለቃ በመግባት ይከራከራል፤ የመንግ ሥት መሥሪያ ቤቶቹንና የልማት ድርጅቶቹን የፍርድ ባለመብት ያደረጉ የፍርድ ቤት ውሳኔዎችም እንዲፈጸሙ መደረጋቸውን ይከታተላል፤ 9/ 9/ የፌዴራል መንግሥት መሥሪያ ቤቶችና የልማት ድርጅቶች ተከራካሪ የሚሆኑባቸው የፍትሐብሔር ክሶችና የመብት ጥያቄዎች አያያዝን ይከታተላል፣ ሪፖርት እንዲቀር ብለት ያደርጋል፤ ብቃት ያለው የሕግ ባለሙያ መመደቡን ያረጋግጣል፤ የሕግ ጥሰት አለ ብሎ ሲያምን የእርምት መመሪያ ይሰጣል፣ ተፈጻሚ ነቱንም ይከታተላል፤ 0/ የፌዴራል መንግሥት መሥሪያ ቤቶችና የልማት ድርጅቶች እርስበርሳቸው ተከራካሪ ወገን የሆኑባቸው የፍትሐብሔር ክርክሮች በድርድር እንዲያልቁ ድጋፍ ያደርጋል፤ 01/ በፌዴራል ፍርድ ቤቶች የፍትሐብሔር ክስ ለመመሥረት አቅም የሌላቸውን ዜጎች በተለይም ሴቶችንና ሕፃናትን ወክሎ ይከራከራል፤ 02/ በፌዴራል ፍርድ ቤቶች መከራከር ለሚ ችሉ ጠበቆች ፈቃድ ይሳጣል፣ ይቆጣጠ ራል፤ 03/ የወንጀል ድርጊት ጠቋሚዎችና ምስክሮች በሕግ መሠረት ጥበቃ እንዲያገኙ ያደርጋል፤ 04/ በወንጀል ጉዳዮች የዓለም አቀፍ ትብብ ርን በሚመለከት የሚፈጸሙ ሥራዎችን ያስተባብራል፤ gA 5¹þ6)"8 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 05/ ከሰብአዊ መብት አጠባበቅ አንፃር የሕዝብን ንቃተ ሕግ ለማዳበር በተለያዩ ዘዴዎች የሕግ ትምህርት ይሰጣል፤ የሕግ ትምህርትንና ሥልጠናን በሚመለከት ከሚመለከታቸው አካላት ጋር ይተባ በራል፡፡ 16. The Ministry of Justice The Ministry of Justice shall have the powers and duties to: be chief advisor to the federal government on matters of law; undertake legal reform studies and carry out the codification and consolidation of federal laws; collect Regional State laws and consolidate same as necessary; assist in the preparation of draft laws when so requested by federal organs and regional states; 4/ study the causes of crimes; devise ways and means of crime prevention; coordinate ወንጀል የሚ the relevant government organs and በወንጀል መከ communities in crime prevention; undertake or order the conduct of investigation where it believes that a crime the adjudication of which falls under the jurisdiction of the federal courts has been committed; direct and supervise the process of the investigation; allow plea- bargain; upon the existence of good cause, decide on the discontinuance of an investigation or the carrying out of additional investigation; 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5637 6/ represent the federal government in the institution and trial of criminal charges; withdraw criminal charges for good causes and in accordance with the law; follow up the execution of decisions of the courts; 7/ establish systems for gathering, handling and distribution of information relating to criminal justice; and provide support to the concerned organs of justice; 8/ institute suit on behalf of federal government offices and public enterprises or intervene at any stage of the proceedings of such suit before the competent courts or other judicial bodies where the rights and interests of the public and of the federal government so require; and follow up the execution of court decisions which made government offices and public enterprises judgment creditors; follow up, as necessary, the handling of civil suits and claims to which the federal government offices and public enterprises are parties; cause reports to be submitted to it on same, and ensure that competent legal professionals are assigned; where it believes that an infringement of the law has been committed, it shall give instructions to rectify the irregularities and follow up the observance of same; 10/ assist in the amicable resolution of disputes arising between federal govern- ment offices and public enterprises; 11/ represent citizens, in particular women and children, who are unable to institute and pursue their civil suits before the federal courts; 12/ license and supervise advocates practicing before federal courts; 13/ ensure that whistleblowers and witnesses of criminal offences are accorded protection in accordance with the law; 14/ coordinate activities involving intern- ational judicial assistance with respect to criminal cases; 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5638 15/ create legal awareness through the use of various methods with a view to raising public consciousness in relation to the protection of human rights; cooperate with the appropriate bodies in relation to legal education and training.

17 — The Ministry of Civil Service

17. 20 — The Ministry of Industry

20. 21 — The Ministry of Trade

21. The Ministry of Education !8. የትምህርት ሚኒስቴር The Ministry of Education shall have the የትምህርት ሚኒስቴር የሚከተሉት ሥልጣንና powers and duties to: ተግባሮች ይኖሩታል፡- 1/ set education and training standards, and 1/ የትምህርትና ሥልጠና ስታንዳርድ ያወጣል፣ ensure the implementation of same; በሥራ ላይ መዋሉንም ያረጋግጣል፤ 2/ without prejudice to the generality of sub- 2/ የዚህ አንቀጽ ንዑስ አንቀጽ /1/ article (1) of this Article፡ አጠቃላይ አነጋገር እንደተጠበቀ ሆኖ፡- a) formulate a national qualification framework; ሀ/ ሀገራዊ የብቃት ማዕቀፍ ያዘጋጃል፤ b) formulate a general framework of ለ/ አጠቃላይ የሥርዓተ ትምህርት curricula for education; ማእቀፍ ያዘጋጃል፤ c) set minimum educational qualification ሐ/ የመምህራንን አነስተኛውን የትምህ requirements for school teachers; ርት ብቃት መለኪያ ያወጣል፤ d) set minimum standards for education መ/ የትምህርትና ሥልጠና ተቋማት and training institutions; ሊያሟሉ የሚገባቸውን አነስተኛውን ደረጃ ያወጣል፤ 3/ የከፍተኛ ትምህርት እንዲስፋፋ ያደ 3/ expand and lead higher education; ርጋል፣ በበላይነት ይመራል፤ 4/ በየደረጃው ጥራትና አግባብነት ያለው 4/ ensure that quality and relevant education and training have been offered at all level ትምህርትና ሥልጠና መሰጠቱን ያረጋግ of the educational and training system; ጣል፤ 5/ prepare and administer national 5/ የሀገሪቱን የትምህርትና ሥልጠና ፖሊሲና examinations based on the country's ሥርዓተ ትምህርት መሠረት ያደረጉ ሀገር education and training policy and አቀፍ ፈተናዎች ያዘጋጃል፣ ያስተዳድራል፤ curricula; maintain records and issue የውጤት ሪኮርዶች ይይዛል፣ የውጤት certificates of results; ማረጋገጫ የምስክር ወረቀት ይሰጣል፤ 6/ develop national technical and vocational 6/ የሀገሪቱን የቴክኒክና ሙያ ትምህርትና education and training strategies and ሥልጠና ስትራቴጂን ይቀርጻል፤ በሥራ ensure their implementation; ላይ መዋሉን ያረጋግጣል፤ 7/ ensure that student admissions and 7/ የመንግሥት ከፍተኛ ትምህርት ተማሪ placements in public higher education ዎች ቅበላና ምደባ አፈጻጸም ፍትሃዊ institutions are equitable; መሆኑን ያረጋግጣል፤ 8/ publicize national performance in 8/ ትምህርትና ሥልጠናን በተመለከተ ሀገ education and training. ራዊ የአሕዝቦት ተግባሮችን ያከናውናል፡፡ gA 5¹þ6)$3 ØÁ‰L ነU¶T Uz¤È qÜ_R 1 ጥቅምት 07 q N 2ሺ3 ›.M Federal Negarit Gazeta No. 1 27th October, 2010 …. page 5653 !9. የጤና ጥበቃ ሚኒስቴር 29. 30 — The Ministry of Labour and Social Affairs

30. 32.
