List of and Maximum Levels for Pesticide Residues in and on Certain Products of Plant Origin, and Methods of Sampling and Analysing Pesticide Residues in and on Products of Plant Origin1 Government of the Republic Regulation No. 177 of 31 May 2000 (RT2 I 2000, 46, 285), entered into force 16 June 2000, amended by the following Regulation: 26.06.2001 entered into force 12.07.2001 - RT I 2001, 62, 365. This Regulation is established pursuant to subsection 19 (3) and 49 (4) of the Food Act (RT I 1999, 30, 415; 58, 608). Chapter 1 Maximum levels for pesticide residues in and on certain products of plant origin § 1. The pesticide residue content in and on fruit and vegetables shall comply with the maximum residue levels set out in Annex 1 to this Regulation. § 2. The pesticide residue content in and on the dried leaves and stalks, fermented or otherwise of the tea plant (Camellia sinensis) shall comply with the maximum residue levels set out in Annex 2 to this Regulation. § 3. The pesticide residue content in and on cereals shall comply with the maximum residue levels set out in Annex 3 to this Regulation. § 4. The pesticide residue content in and on fruit and vegetables concerning which no common standards of the European Union are established shall comply with the maximum residue levels set out in Annex 4 to this Regulation. § 5. The pesticide residue content in and on cereals concerning which no common standards of the European Union are established shall comply with the maximum residue levels set out in Annex 5 to this Regulation. § 6. Residues of the pesticide 2,4-D in and on fruit, vegetables and cereals are not permitted. § 7. Residues of the pesticide benomyl in and on fruit and vegetables are not permitted. Chapter 2 Methods of sampling and analysing pesticide residues in and on products of plant origin § 8. In order to determine the pesticide residue content in and on products of plant origin, a separate aggregate sample shall be taken from each lot. § 9. An aggregate sample is made up by uniting and mixing the incremental samples. § 10. As far as possible incremental samples shall be taken at various places distributed throughout the lot; departure from this procedure must be recorded in the record provided for under the Government of the Republic Regulation No. 330 of 2 November 1999 "Approval of Procedure for Sampling and Analysing of Control Samples in Course of Supervision" (RT I 1999, 84, 767). § 11. The combined total of the incremental samples must never be less than that required for the laboratory samples. § 12. The incremental samples shall be of similar size. § 13. The minimum number of incremental samples is as follows: Size of lot Minimum number of incremental samples 1) Homogenous and well mixed products, packages and entire lot 1 2) Heterogenous and poorly mixed products, packages or entire lot. Weight of lot in kilogrammes < 50 3 50 up to 500 5 501 up to 2000 10 > 2000 15 Number of packages or units in lot 1 up to 25 1 26 up to 100 5 101 up to 250 10 > 250 15 § 14. The aggregate sample may be used for the preparation of the final sample. If the aggregate is too large, the final sample may be prepared from it by a method of reduction, for example by quartering, rejecting two diagonally opposite quarters, mixing and requartering the remainder and so on until the size required is reached. In this process, however, individual fruits and vegetables must not be cut or divided. § 15. As many laboratory samples as required shall be prepared from the final sample. For separate types of fruit, vegetables and cereals, the required weight of laboratory samples shall be as follows: Sequence number Type of fruit or vegetables, and cereals Minimum weight Maximum weight 1. All fresh fruit and vegetables 1.1 small, with a weight of up to 25 g each 1 kg 3 kg 1.2 medium, with a weight of 25 g to 250 g 1 kg (10 individual fruits or vegetables) 4 kg 1.3 large, with a weight of up to 500 g each 2 kg (5 individual fruits or vegetables) 5 kg (12 individual fruits or vegetables) 1.4 very large, with a weight of up to 2 kg each 2 individual fruits or vegetables 4 individual fruits or vegetables 2. Fresh pulses 1 kg 2 kg Cereals (including rice) 1 kg 2 kg Tree nuts 1 kg 2 kg Oil seeds 1 kg 2 kg Raw material for brewing industry and confectionary industry (seeds, beans) 1 kg 2 kg 3. Fresh leaf vegetables 0,5 kg 2 kg Herbs and spices (dried) 0,1 kg 0,5 kg 4. Solid products of plant origin 0,2 kg 0,5 kg (of low relative density) 5. All other products of plant origin 0,5 l or 0,5 kg 2 l or 2 kg § 16. If samples are taken at the site, the following instructions shall be followed: 1) samples of fruit, vegetables and cereals shall be taken before the final harvesting or picking; 2) samples shall be taken along a diagonal line in the extent of the whole site; 3) all parts of plants fit for human consumption shall be included in a sample; 4) defective and deformed plants are not included in a sample; 5) samples obtained from the herbaceous parts of plants shall not contain particles of soil; 6) samples shall be placed in clean plastic bags; 7) vegetables shall not be packed in plastic bags but shall be transported in durable cloth bags; 8) if samples cannot be dispatched to a laboratory during the same day that they were taken, the samples shall be frozen; 9) cereals and oleaginous fruit shall be sorted and frozen; 10) samples of fruit and berries shall be taken from several trees or bushes and from various parts of a tree or bush; 11) sepals shall be removed from strawberries and stems shall be removed from currants; 12) vegetable samples shall be gathered from furrows, as far as possible from shadowy places; 13) vegetable samples shall not be washed but shall be cleaned by brushing off the soil; 14) peas and beans shall be removed from pods, stems shall be removed from cucumbers and soiled leaves shall be removed from cabbages; 15) a final sample shall be taken from harvested cereals to obtain a cereal sample. § 17. Products of plant origin which are wholly or extensively spoiled are not used for sampling. § 18. Analyses shall be carried out using methods in accordance with Estonian or international standards or other equivalent methods. § 19. Government of the Republic Regulation No. 41 of 3 March 1998 "Maximum levels for pesticide residues in and on certain products of plant origin, and approval of methods of sampling pesticide residues in and on products of plant origin" (RT I 1998, 24-27, 347; 60, 956; 1999, 15, 234) is repealed. 1 The requirements of the following Directives of the European Communities have been taken into account in drafting this Regulation: 76/895/EEC (OJ L 340, 09.12.1976, p.26), 79/700/EEC (OJ L 207, 15.08.1979, p.26), 80/428/EEC (OJ L 102, 19.04.1980, p.26), 81/36/EEC (OJ L 46, 19.02.1981, p.33), 82/528/EEC (OJ L 234, 9.08.1982, p.1), 86/362/EEC (OJ L 221, 7.08.1986, p.37), 88/298/EEC (OJ L 126, 20.05.1988, p.53), 89/186/EEC (OJ L 66, 10.03.1989, p.36), 90/642/EEC (OJ L 350, 14.12.1990, p.71), 93/58/EEC (OJ L 211, 22.08.1993, p.6), 93/57/EEC (OJ L 211, 23.08.1993, p.1), 94/29/EC (OJ L 189, 23.07.1994, p.67), 94/30/EC (OJ L 189, 23.07.1994, p.70), 95/38/EC (OJ L 197, 22.08.1995, p.14), 95/39/EC (OJ L 197, 22.08.1995, p.29), 95/61/EC (OJ L 292, 12.07.1995, p.27), 96/32/EC (OJ L 144, 18.06.1996, p.12), 96/33/EC (OJ L 144, 18.06.1996, p.35), 97/41/EC (OJ L 184, 12.07.1997, p.33), 97/71/EC (OJ L 347, 18.12.1997, p.42), 98/82/EC (OJ L 290, 29.10.1998, p.25), 99/65/EC (OJ L 172, 8.07.1999, p.40), 99/71/EC (OJ L 194, 27.07.1999, p.36). 2 RT = Riigi Teataja = State Gazette Annex 1 to Government of the Republic Regulation No. 177 of 31 May 2000 "List of and Maximum Levels for Pesticide Residues in and on Products of Plant Origin and Methods of Sampling and Analysing Pesticide Residues in and on Products of Plant Origin" Maximum levels for pesticide residues in and on fruit and vegetables Table 1 Products of plant origin Active substance of pesticide and maximum residue level thereof (mg/kg) 1 2 3 4 5 6 7 1,1 dichloro 2,2-bis (4-ethyl phenyl) ethane 2,4,5-T Aldicarb: S** Aldrin and dieldrin: S Amitraze: S Amitrole 1.
