Application for Approval for Operation in Area of Organic Farming, Procedure for Processing of Applications and Format of Applications Approved by Regulation No 107 of the Minister of Agriculture of 5 December 2006 (RTL 2006, 87, 1601), entered into force 1 January 2007 Amended by the following Regulation (date of approval, publication in the Riigi Teataja, date of entry into force) 22.05.2007 No 77 (RTL 2007, 45, 767) 1.07.2007 The Regulation is established on the basis of subsection 7 (6) of the Organic Farming Act. § 1. Application for approval (1) A person who wishes to engage in the production of the produce and products specified in Article 1.1.a of the Council Regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs (OJ L 198, 22.07.1991, pp 1–15) shall submit an application for approval of the enterprise (hereinafter application) to the Plant Production Inspectorate. [RTL 2007, 45, 767 – entered into force 01.07.07] (2) A person who wishes to engage in the production of the products specified in Article 1.1.b and c, or solely in the marketing, including importing, of the products specified in Article 1 of Council Regulation (EEC) No 2092/91 shall submit an application to the Veterinary and Food Board. Deadlines for submission of applications (1) A person wishing to engage in organic plant production, including gathering mushrooms or plants or organic bee-keeping, shall submit an application and the documents to be annexed thereto within the period of time from 10 March to 10 April during the current year. (2) A person wishing to engage in organic livestock production, production of greenhouse plants, mushroom production, or the production, manufacture or solely the marketing of agricultural produce and products which bear or are intended to bear labelling referring to organic production methods (hereinafter “labelled produce or products”) may submit an application for approval throughout the year. § 3. Information and documents to be annexed to application for approval for operation in area of plant production (1) A person wishing to engage in organic plant production shall annex the following information and documents to the application: 1) a map of the enterprise's agricultural parcels which can be an ortophoto printout or in the case of absence thereof, a copy of the map of agricultural parcels used by the local office of the regional Agricultural Registers and Information Board of the location of the undertaking which sets out all the agricultural parcels, including the agricultural parcels used for non-organic agriculture and the agricultural parcels in which organic plant production is planned to be started, the areas of fields with the accuracy of at least 0.1 hectares, the numbers of agricultural parcels and each field or part of a field together with its number; 2) the plan for conversion of the enterprise to organic plant production, containing data on the lands, animals, buildings and construction works of the enterprise and the machinery and equipment, including agricultural machinery used in the enterprise, data on the production of feedingstuffs and organic fertilisers and information on the work and services related to organic production acquired and provided by the enterprise; 3) crop rotation plan; 4) plant production plan which contains, as a minimum, data concerning the agricultural parcels, fields (number, area), grown plants and their precultures, and the areas under pasturing; 5) other necessary information. (2) A person engaged only in organic production of mushrooms or greenhouse cultures need not submit the data and documents specified in clauses (1) 1) and 3). (3) The crop rotation plan specified in clause (1) 3) need not be prepared concerning: 1) grasslands of at least five years or intended for at least five years; 2) natural grasslands; 3) land used for the production of fruit and berry species, and medicinal plants and herbs; 4) land used for production of hayseed; 5) fields with an area below 0.30 hectares; 6) land under cultivation which is not overgrown but is temporarily not used for agricultural purposes. ยง 4. Information and documents to be annexed to application for approval for operation in area of gathering of plants and mushrooms A person wishing to engage in gathering plants or mushrooms in an area not used for agricultural purposes shall annex the following data and documents to the application: 1) a land use map which can be a map of agricultural parcels, an ortophoto printout or another map on a scale of at least 1:10 000 which sets out the boundaries and area of the territories used for gathering plants and mushrooms as well as the areas and boundaries of the territories on which the gathering of plants or mushrooms is planned; 2) a list of species of plants and mushrooms to be gathered, and data on the quantities planned to be gathered, the time of gathering as well as initial processing; 3) in the case of a protected area, permission of the manager of the area for gathering plants or mushrooms from the protected area; 4) a certificate issued by a competent agency or person concerning the fertilisers and plant protection products used in the lands used for gathering mushrooms or plants; 5) other necessary information. ยง 5. Information and documents to be annexed to application for approval for operation in area of livestock production A person wishing to engage in organic livestock production shall annex the following information and documents to the application: 1) a description of livestock buildings and constructions, including a description of exercise areas and the manner of keeping the animals; 2) the number and area of the agricultural parcel or part thereof used for grazing, with an indication to such data in the plant production plan of the enterprise; 3) the number of animals kept at the enterprise by species and age groups; 4) other necessary information. ยง 6. Information and documents to be annexed to application for approval for operation in area of bee-keeping A person wishing to engage in organic bee-keeping shall annex the following information and documents to the application: 1) a description of the buildings and construction works needed for keeping the bee colonies; 2) a map of the enterprise's agricultural parcels describing the location of bee groups and gathering areas on a scale of at least 1:10 000 which can be an ortophoto printout or in the case of absence thereof, a copy of the map of agricultural parcels used by the local office of the regional Agricultural Registers and Information Board of the location of the enterprise; 3) number of colonies; 4) other necessary information. ยง 7. Information and documents to be annexed to application for approval for manufacture of labelled products or produce including feedingstuffs A person wishing to engage in the production of labelled products or produce, including feedingstuffs, shall annex the following data and documents to the application: 1) the name of the product or product group, information concerning the ingredients of the product, origin of the ingredients and their quantity in the product; 2) the technological layout of the handling process and information concerning the technical processes used; 3) information on the actual production capacity, product groups planned to be manufactured or produced and estimated production volume; 4) a description of the measures to be taken to ensure the conforming manufacture or production of the labelled produce or products; 5) other necessary information. § 8. Information and documents to be annexed to application for approval for marketing, including import of labelled products and produce A person wishing to engage in the marketing, including import, of labelled produce or products shall annex to the application a description of the activity which ensures that the labelled products or produce can be distinguished from other products upon their storage and transport. § 9. Processing of applications (1) If a person is applying for approval on the basis of subsection 1 (1) of this Regulation, the initial inspection shall be carried out within sixty working days as of the date of submission of the application, and the decision to approve the enterprise or a reasoned decision to refuse approval shall be made within thirty working days after the initial inspection. (2) If a person is applying for approval on the basis of subsection 1 (2) of this Regulation, the decision to approve the enterprise or a reasoned decision to refuse approval shall be made within thirty working days after the receipt of the application [RTL 2007, 45, 767 – entered into force 01.07.07] (3) The decision to refuse approval specified in subsections (1) and (2) shall be made if, based on assessment results, the enterprise is not conforming. § 10. Entry into force of Regulation This Regulation enters into force on 1 January 2007.
