Water Tariffs (Atkinson/Carib Territory) Regulations, 2003 (S. R.O. No. 31 of 2003)

WATER TARIFFS REGULATIONS MADE by the Minister in consultation with the Dominica Water and Sewerage Company Limited under section 68 of the Water and Sewerage Act (Chap. 43.40). WATER TARIFFS (ATKINSON/CARIB TERRITORY) REGULATIONS, 2003. 2. In these Regulations unless the context otherwise requires- Interpretation. Ch.43.40. "Company" means the Dominica Water and Sewerage Company Limited; (a) a person, other than a mortgagee not in possession, who for the time being is entitled to dispose of the right of owner ship of the building or land whether in possession of reversion; (b) a person holding or entitled to the rights and profits of the building or land under lease or agreement, the expected term whereof exceeds three years or the I\ppli<:abJe fees and tariffsfor services rendered. WATER TARIFFS REGULATIONS landlord or his agent if the landlord is absent or under any disability, or if there be no such agent, the occupier of the building. . (c) in the case of the Carib Territory, the occu pier of the land or building as the case may be for the time being. 3. (1) Subject to the provisions of these Regulations, an owner of a building or land in Atkinson or the Carib Territory shall pay to the\ Company the fees prescribed under the Water Regulations 1977 for services rendered. (2) The applicable tariffs in respect of the water services rendered to any building or land situate in Atkinson or Carib Territory shall be as specified in the Schedule to these Regulations for a period of one year from the date of issue of fIrst invoice after connection· to water supply to that building or land or until December 31,2004 whichever date occurs earlier. 4. (1) Regulation 4(4) of the Water Regulation 1997 does not apply to connections made to buildings and lands situate in Atkinson and the Carib Territory. (2) For the avoidance of doubt where a water connection is carried out to any building or land situate in Atkinson or the Carib Territory, the owner of that building or land as the case may be shall not lpe required to pay to the Company the minimum connection fee specifIed in Schedule 3 to the Water Regulations 1997. s. These Regulations shall be deemed to have come into operation on the 1st day of June, 2003.
