[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Act means The Agri-Food Act, Statutes of Saskatchewan, S.S. 1990-91, c. A-15.2. (Loi) Commission means the Saskatchewan Flax Develop ment Commission established pursuant to the Act. (Commission) flax means the seeds, straw, fibre, shives, or any part of the plant linum usitatissimum. (lin) Plan means The Saskatchewan Flax Development Plan, established pursuant to section 3 of The Saskatchewan Flax Development Plan Regulations, R.R.S. c. A-15.2 Reg 5, as amended from time to time, made pursuant to the Act. (Plan) Interprovincial and Export Trade Marchés interprovincial et international 2 The Commission is authorized to regulate the market ing of flax in interprovincial and export trade and for those purposes may, with respect to persons and proper ty situated in Saskatchewan, exercise all or any powers like the powers exercisable by the Commission under the Act and the Plan in relation to the marketing of flax local ly, within Saskatchewan. 2 Les pouvoirs conférés à la Commission par la Loi et le plan relativement à la commercialisation du lin dans la province de la Saskatchewan à l’égard des personnes et des biens qui s’y trouvent sont étendus aux marchés in terprovincial et international. Levies or Charges Taxes ou prélèvements 3 The Commission may, in relation to the powers grant ed to it by section 2, (a) fix, impose and collect levies or charges from per sons referred to in that section who are engaged in the production or marketing of flax and for those purpos es may classify those persons into groups and fix the levies or charges payable by the members of the differ ent groups in different amounts; and (b) use the levies or charges for the purposes of the Commission, including the creation of reserves. 3 En ce qui concerne les pouvoirs qui lui sont attribués aux termes de l’article 2, la Commission est habilitée : a) à instituer et à percevoir des taxes ou prélèvements payables par les personnes visées à cet article qui se livrent à la production ou à la commercialisation du lin et, à cette fin, à classer ces personnes en groupes et à fixer les divers montants des taxes ou prélèvements payables par les membres des différents groupes; b) à employer à son profit ces taxes ou prélèvements, notamment pour la création de réserves.
