and Development Act, the Lieutenant-Governor in Council makes the following Regulation: En vertu de l’article 20 de la Loi sur la protection et l’aménagement du territoire agricole, le lieutenant gouverneur en conseil établit le règlement suivant : 1 This Regulation may be cited as the Registry of Agri cultural Land Regulation - Agricultural Land Protection and Development Act. 1 Le présent registry of agricultural land in accordance with this Regulation. 2 Le Ministre crée et maintient un registre des terres agricoles conformément au présent règlement. 3 The following land may be agricole. 4(1) A person may make application to the Minister on a form provided by the Minister to register agricultural land owned by the person. 4(1) Une personne peut faire une demande au Ministre au moyen de la formule que ce dernier fournit pour faire inscrire au registre une terre agricole dont il est proprié taire. 4(2) A person making application under subsection (1) shall provide the Minister with information requested by the Minister. 4(2) La personne qui fait une demande en vertu du pa ragraphe (1) doit fournir au Ministre les renseignements demandés par ce dernier. 5 Where, after receipt of an application under section 4, the Minister is of the opinion that the land meets the re quirements under section 3, the Minister may register the land as agricultural land. 5 Si Where, after receipt of an application under section 4, the Minister is of the opinion that the land does not meet the requirements under section 3, the Minister shall, in writing, so notify the par écrit. 7 Land registered as agricultural land under section 5 in any year shall continue to be registered in subsequent years unless the land is deregistered under section 8. 7 Les terres agricole A-5.11 2 8(3) No land shall be deregistered under subsection (2) unless the owner of the land is given thirty consecutive days’ written notice of the deregistration. 8(3) Aucune radiation l’adresse qui figure dans les livres du Ministre. 9(1) There is hereby established the Agricultural Land Appeal Board consisting of five members appointed by the Minister, one member representing the Department of Agriculture, Aquaculture and Fisheries, one member rep resenting the Department of Environment and Local Gov ernment and three members who are agricultural land owners. 9(1) La Board by serving upon it not more than sixty days after the person has notice of the decision, written notice of the appeal stating that the person requests the matter in dispute to be determined by de trancher le litige. 10(2) Every notice of appeal under subsection (1) shall contain a statement of the matter being appealed and the name and address of the person making the appeal. 10(2) L’avis d’appel visé au paragraphe (1) doit contenir un exposé du litige faisant l’objet de l’appel et indiquer les nom et adresse de l’appelant. 10(3) Upon receipt of a notice of appeal under subsec tion (1), the Board shall forthwith notify the Minister and the Minister shall thereupon provide the Board with every document the Minister has pertaining to the matter. 10(3) Sur réception d’un avis d’appel visé au paragra phe (1), la Commission en avise sans délai le Ministre qui doit dès lors lui fournir tous les documents pertinents qu’il a en sa possession. 10(4) Upon receipt of a notice of appeal under subsec tion (1), the Board shall, not more than fourteen days after it receives the notice, serve upon the person making the appeal and upon the Minister written notice of the time and place the appeal is to be heard. 10(4) La Commission doit, dans les quatorze jours qui suivent la réception de l’avis d’appel visé au paragra phe (1), signifier à l’appelant et au Ministre un avis écrit indiquant l’heure, la date et le lieu de l’audition de l’appel. 10(5) The Board shall hear the appeal not more than forty-two days after it receives notice of appeal but it may, at the request of the person appealing, adjourn the appeal for such period of time as it considers appropriate. 10(5) La Commission doit entendre l’appel quarante deux jours au plus tard après avoir reçu l’avis A-5.11 Agricultural Land Protection and Development Act 97-83 3 10(6) The Board may, on an appeal under this section, dismiss the appeal or vary the decision of the Minister. 10(6) La Commission peut débouter l’appelant d’un ap pel interjeté en vertu du présent article ou modifier la dé cision du Ministre. 11 An appeal under this Regulation may be heard at the same time as an appeal under the Farm Land Identification Regulation - Real Property Tax Act. 11 Un appel en vertu du présent règlement peut être en tendu en même temps qu’un appel en vertu du Règlement sur l’identification des terres agricoles - Loi sur l’impôt foncier.
