[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Vegetable Information (Interprovincial and Export) Regulations. 1 Le présent règlement peut être cité sous le titre : Rè glement sur les renseignements relatifs aux légumes de l’Île-du-Prince-Édouard (marché interprovincial et com merce d’exportation). Interpretation Interprétation 2 In these Regulations, Commodity Board means the Prince Edward Island Vegetable Commodity Marketing Board; (Office de com mercialisation) person means any individual, firm, partnership, associa tion or corporation that grows or markets the vegetable and includes any servants or agents thereof; (personne) vegetable means any turnip produced in the Province of Prince Edward Island. (légumes) 2 Dans le présent règlement, légumes désigne les navets produits dans la province de l’Île-du-Prince-Édouard; (vegetable) Office de commercialisation désigne l’office dit Prince Edward Island Vegetable Commodity Marketing Board; (Commodity Board) personne désigne tout particulier, toute maison com merciale, société, association ou corporation qui cultive ou commercialise des légumes et comprend leurs em ployés ou agents. (person) Application Application 3 These Regulations apply only to vegetable when mar keted in interprovincial and export trade and to persons and property situated in the Province of Prince Edward Island. 3 Le présent règlement s’applique uniquement aux lé gumes qui sont commercialisés sur le marché interpro vincial et dans le commerce d’exportation, ainsi qu’aux personnes et aux biens situés dans la province de l’Île du-Prince-Édouard. Vegetable Information (Interprovincial and Export) Regulations Règlement sur les renseignements relatifs aux légumes de l’Île-du-Prince-Édouard (marché interprovincial et commerce d’exportation) Records Registres Sections 4-6 Articles 4-6 Current to November 21, 2016 2 À jour au 21 novembre 2016 Records Registres 4 (1) Every person engaged in the production or mar keting of vegetable shall keep complete and accurate records of all matters relating to such production or mar keting. 4 (1) Une personne qui s’occupe de la production ou de la commercialisation de légumes doit tenir des registres complets et exacts de tout ce qui se rapporte à ladite pro duction ou commercialisation. (2) Every person referred to in subsection (1) shall, upon the request of the Commodity Board or any member or authorized representative of the Commodity Board, pro duce to the Commodity Board, member or representative all records referred to in that subsection. (2) Une personne visée au paragraphe (1) doit, à la de mande de l’Office de commercialisation, d’un membre ou d’un représentant autorisé dudit Office de commerciali sation, produire à l’Office, ou audit membre ou audit re présentant, tous les registres visés audit paragraphe. Inspection and Information Inspection et renseignements 5 (1) Any member or authorized representative of the Commodity Board may at any reasonable time inspect any place or premises used for the production or market ing of vegetable. 5 (1) Un membre ou un représentant autorisé de l’Office de commercialisation peut inspecter, en tout temps jugé raisonnable, tout endroit ou tous lieux utilisés pour la production ou la commercialisation de légumes. (2) Every person in possession or control of any place or premises referred to in subsection (1) shall (a) permit any member or authorized representative of the Commodity Board to inspect the place or premises; and (b) furnish any member or authorized representative of the Commodity Board with such information in re spect of the production and marketing of vegetable as he may reasonably require. (2) Une personne qui est en possession d’un endroit ou de lieux visés au paragraphe (1) ou qui en a le contrôle, doit a) permettre à tout membre ou à tout représentant autorisé de l’Office de commercialisation d’inspecter ledit endroit ou lesdits lieux; et b) fournir à tout membre ou à tout représentant auto risé de l’Office de commercialisation les renseigne ments relatifs à la production et à la commercialisa tion de légumes, que ledit agent ou représentant peut raisonnablement lui réclamer. Appeal Appel 6 Any person aggrieved by any act or decision of any member or authorized representative of the Commodity Board may appeal to the Commodity Board and, if not satisfied with the decision of the Commodity Board, may appeal to the Prince Edward Island Marketing Board. 6 Une personne qui se sent lésée par une mesure ou par une décision d’un membre ou d’un représentant autorisé de l’Office de commercialisation peut interjeter appel de vant l’Office de commercialisation et, si la décision de ce dernier ne lui donne pas satisfaction, ladite personne peut interjeter appel devant l’organisme dit Prince Ed ward Island Marketing Board.
