[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Exceptions Exceptions 2 These Regulations do not apply to any polybrominated diphenyl ether referred to in section 1 that is contained in a pest control product within the meaning of subsec tion 2(1) of the Pest Control Products Act. 2 Le présent règlement ne s’applique pas aux polybro modiphényléthers visés à l’article 1 qui sont contenus dans tout produit antiparasitaire au sens du paragraphe 2(1) de la Loi sur les produits antiparasitaires. 3 These Regulations do not apply to any polybrominated diphenyl ether referred to in section 1, or to any resin, polymer or other mixture containing a polybrominated diphenyl ether set out in the schedule, that is for use (a) in a laboratory for analysis; (b) in scientific research; or (c) as a laboratory analytical standard. 3 Le présent règlement ne s’applique pas aux polybro modiphényléthers visés à l’article 1 ni aux résines, poly mères ou autres mélanges qui contiennent un polybro modiphényléther mentionné à l’annexe, s’ils sont destinés à être utilisés : a) pour des analyses en laboratoire; b) pour la recherche scientifique; c) en tant qu’étalon analytique de laboratoire. 4 These Regulations do not apply to a product that is formed into a specific physical shape or design during its manufacture and that has, for its final use, a function or functions dependent in whole or in part on its shape or design, if that product contains a polybrominated diphenyl ether referred to in section 1. 4 Le présent règlement ne s’applique pas aux produits dotés d’une forme ou de caractéristiques matérielles pré cises lors de leur fabrication qui ont, pour leur utilisation finale, une ou plusieurs fonctions en dépendant en tout ou en partie, et ce même s’ils contiennent un polybromo diphényléther visé à l’article 1. 5 These Regulations do not apply to any polybrominated diphenyl ether referred to in section 1 that is present as a contaminant in a chemical feedstock used in a process from which there are no releases of the polybrominated diphenyl ether, provided that the polybrominated diphenyl ether is destroyed or completely converted in that process to a substance that is not a polybrominated diphenyl ether. 5 Le présent règlement ne s’applique pas aux polybro modiphényléthers visés à l’article 1 qui sont présents comme contaminants dans une matière première chi mique utilisée au cours d’un procédé n’occasionnant pas le rejet de polybromodiphényléthers, pourvu qu’ils soient, au cours de ce procédé, détruits ou totalement convertis en toute substance autre qu’un polybromodi phényléther. (2) Subsection (1) does not apply to any polybrominated diphenyl ether or resin, polymer or other mixture that is to be (a) re-processed on-site in a process from which there are no releases of the substance; or (b) disposed of in accordance with the laws of the ju risdiction where the disposal is to take place.
