(1) For the purposes of these regulations a person makes a polar bear defence kill if the person kills a polar bear in order (a) to prevent the starvation of a person; (b) to preserve the life of a person; or (c) to protect property. 1. (2) The wildlife management polar bear areas referred to in these regulations are described in the Wildlife Management Polar Bear Areas Regulations made under the Act. R-027-99,s.2. (1) A person who makes a polar bear defence kill shall provide the following to an officer as soon as practicable after the bear is killed: (a) the person's name; (b) the date the bear was killed; (c) the location at which the bear was killed; (d) the lower jaw or undamaged post-canine tooth and, when present, lip tattoos and ear tags from the bear; (e) the baculum of the bear, if it is male, except where an officer has verified the sex of the bear; (f) the hide of the bear; (g) any other information required by an officer. (2) Where evidence of the sex of the polar bear killed is not provided to an officer in accordance with paragraph 2(1)(e) and where an officer has not verified the sex of the bear, the bear shall be deemed to have been female. (3.1) Where the Hunters' and Trappers' Association in the polar bear management area closest to the location at which the polar bear was killed does not have a tag to issue in respect of the bear, the officer shall ask another Hunters' and Trappers' Association in the same wildlife management polar bear area to issue a tag. (3.2) Where a Hunters' and Trappers' Association issues a tag under subsection (3.1), the Hunters' and Trappers' Association that was given the hide of the bear shall, at the beginning of the next polar bear hunting season, give a tag for a bear to the Hunters' and Trappers' Association that issued the tag. R-109-93, art. 4. (4) In subsection (3), "tag" means a wildlife tag that a person is required to obtain under the Big Game Hunting Regulations made under the Act to hunt or possess polar bear.
