The definitions in this section apply in these Regula tions. bioaccumulation factor means the ratio of the concen tration of a substance in an organism to the concentra tion in water, based on uptake from the surrounding medium and food. (facteur de bioaccumulation) bioconcentration factor means the ratio of the concen tration of a substance in an organism to the concentra tion in water, based only on uptake from the surrounding medium. (facteur de bioconcentration) half-life means the period it takes the concentration of a substance to be reduced by half, by transformation, in a medium. (demi-vie) octanol-water partition coefficient means the ratio of the concentration of a substance in an octanol phase to the concentration of the substance in the water phase of an octanol-water mixture. (bioconcentra tion factor) Application Champ d’application 2 These Regulations apply to any substance, other than a living organism within the meaning of Part 6 of the Canadian Environmental Protection Act, 1999. 2 Le présent règlement s’applique à toute substance autre qu’un organisme vivant au sens de la partie 6 de la Loi canadienne sur la protection de l’environnement (1999). Persistence and Bioaccumulation Determination Détermination de la persistance et de la bioaccumulation 3 A substance is persistent when it has at least one of the following characteristics: (a) in air, (i) its half-life is equal to or greater than 2 days, or (ii) it is subject to atmospheric transport from its source to a remote area; 3 Est persistante la substance qui présente au moins une des particularités suivantes : a) dans l’air, selon le cas : (i) sa demi-vie est égale ou supérieure à 2 jours, (ii) elle est susceptible d’être transportée dans l’at mosphère jusqu’à des régions éloignées de sa source; Persistence and Bioaccumulation Regulations Règlement sur la persistance et la bioaccumulation Persistence and Bioaccumulation Determination Détermination de la persistance et de la bioaccumulation Sections 3-6 Articles 3-6 Current to November 9, 2016 2 À jour au 9 novembre 2016 (b) in water, its half-life is equal to or greater than 182 days; (c) in sediments, its half-life is equal to or greater than 365 days; or (d) in soil, its half-life is equal to or greater than 182 days. b) dans l’eau, sa demi-vie est égale ou supérieure à 182 jours; c) dans les sédiments, sa demi-vie est égale ou supé rieure à 365 jours; d) dans le sol, sa demi-vie est égale ou supérieure à 182 jours. 4 A substance is bioaccumulative (a) when its bioaccumulation factor is equal to or greater than 5 000; (b) if its bioaccumulation factor cannot be determined in accordance with a method referred to in section 5, when its bioconcentration factor is equal to or greater than 5 000; and (c) if neither its bioaccumulation factor nor its bio concentration factor can be determined in accordance with a method referred to in section 5, when the loga rithm of its octanol-water partition coefficient is equal to or greater than 5. 4 Une substance est bioaccumulable dans les cas sui vants : a) son facteur de bioaccumulation est égal ou supé rieur à 5 000; b) si son facteur de bioaccumulation ne peut pas être déterminé selon une méthode visée à l’article 5, son facteur de bioconcentration est égal ou supérieur à 5 000; c) si son facteur de bioaccumulation et son facteur de bioconcentration ne peuvent être déterminés selon une méthode visée à l’article 5, le logarithme de son coefficient de partage octanol-eau est égal ou supé rieur à 5. 5 The determination of persistence and bioaccumulation with respect to a substance under sections 3 and 4 must be made in accordance with generally recognized meth ods of the Organisation for Economic Co-operation and Development (OECD) or of some other similar organisa tion or, if no such methods exist, in accordance with gen erally recognized methods within the scientific communi ty and taking into account the intrinsic properties of the substance, the ecosystem under consideration and the conditions in the environment. Coming into Force Entrée en vigueur 6 These Regulations come into force on March 31, 2000. 6 Le présent règlement entre en vigueur le 31 mars 2000.
