[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In these Regulations, Act means The Farm Products Marketing Act of On tario; (Loi) Commodity Board means The Ontario Flue-Cured To bacco Growers’ Marketing Board established pursuant to the Act and the Plan; (Office de commercialisation) Plan means The Ontario Flue-Cured Tobacco Growers’ Marketing Plan established pursuant to the Act and any regulations made thereunder to give effect to the Plan; (Plan) tobacco means unmanufactured flue-cured tobacco pro duced in Ontario. Ontario Flue-Cured Tobacco Licensing (Interprovincial and Export) Regulations Règlement sur les permis de tabac jaune de l’Ontario (marché interprovincial et com merce d’exportation) Licence to Buy Tobacco Permis d’achat Sections 4-5 Articles 4-5 Current to November 9, 2016 2 À jour au 9 novembre 2016 Licence to Buy Tobacco Permis d’achat 4 (1) No person shall act as a buyer of tobacco unless he holds a licence issued by the Commodity Board in the form set out in the schedule. 4 (1) Nul n’agit comme acheteur de tabac à moins de dé tenir un permis d’achat émis par l’Office de commerciali sation et rédigé selon la formule visée à l’annexe. (2) A licence referred to in subsection (1) shall expire on June 30th of the year next following the year in which the licence was issued. (2) Le permis visé au paragraphe (1) expire le 30 juin de l’année qui suit l’année subséquente à celle de sa déli vrance. 5 (1) A licence to buy tobacco may be refused where the applicant is not qualified by experience, financial respon sibility and equipment to engage in the business of buy ing tobacco. 5 (1) Un permis peut être refusé lorsque l’acheteur n’a pas les qualifications acquises par l’expérience, ne peut assumer les responsabilités financières et ne possède pas l’équipement lui permettant de s’adonner à l’achat de ta bac. (2) A licence to buy tobacco may be suspended, revoked or refused for failure to observe, perform or carry out the provisions of the Act, the regulations made pursuant to the Act or any order or direction of the Commodity Board. (2) Le permis peut être suspendu, annulé ou refusé si son détenteur n’observe, ne remplit ou n’exécute pas les dispositions de la Loi, des règlements établis selon la Loi ou une ordonnance ou une directive de l’Office de com mercialisation.
