Inconsistencies in Acts Incompatibilité — lois (2) In the event of an inconsistency between a consolidated statute published by the Minister under this Act and the origi nal statute or a subsequent amendment as certified by the Clerk of the Parliaments under the Publication of Statutes Act, the original statute or amendment prevails to the extent of the inconsistency. Interpretation Définitions Definitions Définitions 2 The definitions in this section apply in this Act. agreement means the agreement concluded between (a) Her Majesty in right of Canada, (b) Her Majesty in right of Manitoba, (c) the Manitoba Hydro-Electric Board, and (d) the Nelson House First Nation, pursuant to negotiations relating to the comprehensive implementation of the Flood Agreement. (Convention) Exemptions Exclusions Indian moneys Argent des Indiens 3 (1) Amounts paid to the Nelson House First Nation pursuant to the agreement, whether before or after the coming into force of this Act, are not Indian moneys within the meaning of subsection 2(1) of the Indian Act. 3 (1) Les sommes versées en vertu de l’accord à la pre mière nation de Nelson House, avant ou après l’entrée en vigueur de la présente loi, ne constituent pas de l’argent des Indiens au sens du paragraphe 2(1) de la Loi sur les Indiens. Transfer of amounts held Transfert (2) As soon as practicable after the coming into force of this Act, all amounts collected, received or held by Her Majesty in right of Canada for the use or benefit of the Nelson House First Nation pursuant to the agreement shall be transferred to the Nelson House First Nation in accordance with the agreement. Section 36 of the Indian Act Art. 36 de la Loi sur les Indiens 5 Where land is held or transferred pursuant to the agreement, section 36 of the Indian Act does not apply in respect of that land if the holder or transferee of the land, or any subsequent holder or transferee of the land, is not Her Majesty in right of Canada. 5 L’article 36 de la Loi sur les Indiens ne s’applique pas aux terres transférées ou détenues en vertu de l’accord lorsque le cessionnaire ou le détenteur — actuel ou futur — n’est pas Sa Majesté du chef du Canada. Arbitration Arbitrage Arbitration Arbitrage 7 Except as otherwise provided in the agreement, the legislation of Manitoba relating to arbitration applies in respect of any dispute between the parties to the agree ment that, under the terms of the agreement, is to be set tled by way of arbitration. 7 Sauf disposition contraire de l’accord, la législation manitobaine en matière d’arbitrage s’applique, en cas de conflit entre les parties, aux questions dont l’accord pré voit le règlement par arbitrage.
