Definitions Définitions 2 In this Regulation 2 Dans le présent règlement “enterprise” includes a body corporate, trade union, named trust, partnership, syndicate or joint venture, as‐ sociation or organization, but does not include an indi‐ vidual. Qualifiers to a name Précisions ajoutées au nom 4(1) Where a party to an instrument is an individual who is any of the following, the name of the party shall be followed by the qualifier “Estate”: 4(1) Le nom d’une partie à un instrument doit être sui‐ vi de la précision « Biens » lorsque la partie est un parti‐ culier qui est (a) a minor; (f) where the law of the jurisdiction where the indi‐ vidual habitually resides allows a person to use both the name adopted after marriage and the name that person had before marriage, and the individual uses both names, paragraphs (a) to (d) continue to apply and both the name of the individual determined in ac‐ cordance with those paragraphs and the name adopted after marriage shall be identified as separate names; (iii) une carte d’assurance médicale en cours de validité. 5(6) For the purposes of subsection (5), the name of an individual shall be determined as of the date of the exe‐ cution of the instrument to which that individual is a party. 5(6) Aux fins du paragraphe (5), le nom d’un particu‐ lier doit être déterminé à la date de la passation de l’ins‐ trument auquel il est une partie. 5(7) In addition to identifying a party to an instrument who is an individual in accordance with this section, the party may be separately identified by any other name by which that party is known. 2023-47 5(7) En plus d’identifier une partie à un instrument qui est un particulier conformément au présent article, la partie peut être identifiée séparément par tout autre nom par lequel cette partie est connue. 2023-47 CONVENTIONS FOR THE NAME OF AN ENTERPRISE CONVENTIONS RELATIVES AU NOM D’UNE ENTREPRISE Body corporate Corps constitué 6(1) Where a party to an instrument is an enterprise that is a body corporate, the party shall be identified by the name of the body corporate. 6(1) Lorsqu’une partie à un instrument est une entre‐ prise qui est un corps constitué, la partie doit être identi‐ fiée par le nom du corps constitué. 6(2) Where the name of a body corporate that is a party to an instrument is in more than one of the follow‐ ing forms, the party may be identified by any or all of them: 6(2) Lorsque le nom du corps constitué qui est une partie à un instrument s’exprime sous plus d’une des formes suivantes, la partie peut être identifiée par l’une ou l’ensemble de ces formes : (a) an English form; a) en anglais; (b) a French form; b) en français; (c) a combined English-French form. c) à la fois en anglais et en français. Registered partnership Société en nom collectif enregistrée 6(5) Where a party to an instrument is an enterprise that is a partnership that is registered under the Partner‐ ships and Business Names Registration Act, the party shall be identified by the firm name of the partnership as stated in the certificate registered under that Act. 6(5) Lorsqu’une partie à un instrument est une entre‐ prise qui est une société en nom collectif enregistrée en vertu de la Loi sur l’enregistrement des sociétés en nom collectif et des appellations commerciales, la partie doit être identifiée par la raison sociale de la société en nom collectif mentionnée dans le certificat enregistré en vertu de cette loi.
