[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Act means the International Boundary Waters Treaty Act. (Loi) non-commercial project means a project involving the removal of boundary waters in bulk in which no one is required to pay for the waters. (non-commercial project) 2 (1) In these Regulations, removal of boundary wa ters in bulk means the removal of water from boundary waters and taking the water, whether it has been treated or not, outside the water basin in which the boundary waters are located (a) by any means of diversion, including by pipeline, canal, tunnel, aqueduct or channel; or (b) by any other means by which more than 50,000 L of boundary waters are taken outside the water basin per day. 2 (1) Dans le présent règlement, captage massif d’eaux limitrophes s’entend du captage d’eaux limi trophes et de leur transfert — qu’elles aient été traitées ou non — à l’extérieur de leur bassin hydrographique par l’un ou l’autre des moyens suivants : a) par dérivation, notamment grâce à un pipeline, ca nal, tunnel, aqueduc ou chenal; b) par tout autre moyen permettant le transfert à l’ex térieur d’un bassin hydrographique de plus de 50 000 L d’eaux limitrophes par jour. (2) The removal of boundary waters in bulk does not in clude taking a manufactured product that contains water, including water and other beverages in bottles or pack ages, outside a water basin. Licences Licences 3 An application for a licence or for the renewal or amendment of a licence must be submitted to the Minis ter and contain the following information: (a) the name and address of the applicant; (b) a description of the intended project; (c) a description of the place where the project is to be located and the waters it will likely affect; (d) if the project involves the use, obstruction or di version of boundary waters and the project requires a licence under subsection 11(1) of the Act, a description of the increase or decrease in the natural flow or level of the boundary waters on the other side of the 3 Toute demande de délivrance, de renouvellement ou de modification d’une licence est présentée au ministre et comprend les renseignements suivants : a) les nom et adresse du demandeur; b) des précisions sur le projet envisagé; c) la mention du lieu où le projet doit être réalisé et des eaux qu’il modifiera vraisemblablement; d) si le projet consiste en l’utilisation, l’obstruction ou la dérivation d’eaux limitrophes et nécessite l’obten tion d’une licence aux termes du paragraphe 11(1) de la Loi, des précisions sur l’augmentation ou la diminu tion du débit ou du niveau naturels de ces eaux de International Boundary Waters Regulations Règlement sur les eaux limitrophes internationales Licences Licences Sections 3-6 Articles 3-6 Current to November 21, 2016 2 À jour au 21 novembre 2016 international boundary that would be caused by the project; (e) if the project consists of the construction or main tenance of any remedial or protective work, dam or other obstruction in waters flowing from boundary waters, or in downstream waters of rivers flowing across the international boundary and the project re quires a licence under subsection 12(1) of the Act, a description of the increase in the natural level of wa ters on the other side of the international boundary that would be caused by the project; (f) a concise economic analysis of the direct and indi rect benefits and costs of the project; (g) a concise environmental analysis of the project that includes a description of the measures to be taken to protect the integrity of the ecosystem in which the project is located; (h) a copy of any permit or other authorization issued in respect of the project; and (i) any other details concerning the project that indi cate how the project would be compatible with the management of the resources, environment and econ omy of Canada. l’autre côté de la frontière internationale qu’entraîne rait le projet; e) si le projet consiste en l’établissement ou le main tien, dans des eaux qui sortent des eaux limitrophes ou dans des eaux en aval de la frontière internationale des rivières transfrontalières, d’ouvrages de protection ou de réfection, ou de barrages — ou autres obstacles faisant obstruction —, et nécessite l’obtention d’une li cence aux termes du paragraphe 12(1) de la Loi, des précisions sur l’exhaussement du niveau naturel des eaux de l’autre côté de la frontière internationale qu’entraînerait le projet; f) une brève analyse économique des avantages et des coûts directs et indirects que comporte le projet; g) une brève analyse environnementale du projet, no tamment les mesures à prendre pour la protection de l’intégrité de l’écosystème où le projet sera réalisé; h) une copie de tout permis ou autre autorisation déli vré à l’égard du projet; i) toutes autres précisions à l’égard du projet indi quant en quoi il serait compatible avec la gestion des ressources, de l’environnement et de l’économie du Canada. 4 The licence must include the conditions to which the licence is subject. 4 Les conditions applicables à la licence figurent dans celle-ci. Water Removal Captage d’eau 5 Subsection 13(1) of the Act applies only in respect of the Canadian portion of the following water basins: (a) Great Lakes — St. Lawrence Basin, which is the area of land from which water drains into the Great Lakes or the St. Lawrence River; (b) Hudson Bay Basin, which is the area of land from which water drains into Hudson Bay; and (c) Saint John — St. Croix Basin, which is the area of land from which water drains into the St. John River or the St. Croix River. 5 Le paragraphe 13(1) de la Loi ne s’applique qu’à la par tie canadienne des bassins hydrographiques suivants : a) le bassin des Grands Lacs et du Saint-Laurent, soit l’étendue du territoire d’où proviennent les eaux des Grands Lacs et du Saint-Laurent; b) le bassin de la baie d’Hudson, soit l’étendue du ter ritoire d’où proviennent les eaux de la baie d’Hudson; c) le bassin Saint-Jean — Ste Croix, soit à la fois l’é tendue du territoire d’où proviennent les eaux du fleuve Saint-Jean et celle d’où proviennent les eaux de la rivière Ste Croix. 6 (1) Subsection 13(1) of the Act does not apply to the removal of boundary waters other than the removal of boundary waters in bulk. 6 (1) Le paragraphe 13(1) de la Loi ne s’applique pas au captage d’eaux limitrophes qui n’est pas massif.
