Definitions Définitions 2 The following definitions apply in this Regulation. 2 Les définitions qui suivent s’appliquent au présent règlement. “Act” means the Agriculture Appeal Board Act. (Loi) “appellant” means a person who serves a notice of ap‐ peal under subsection 3(1). (appelant) « appelant » Quiconque signifie un avis d’appel en vertu du paragraphe 3(1). Panels of the Board Comités de la Commission 4(1) For the purposes of subsection 7(1) of the Act, a panel of the Board shall consist of 4(1) Aux fins d’application du paragraphe 7(1) de la Loi, tout comité de la Commission se compose : (a) the chair or the vice-chair, and a) du président ou du vice-président; (b) subject to subsections (2) and (3), at least two other members assigned by the chair from among the members appointed under subsection 2(2) of the Act. b) sous réserve des paragraphes (2) et (3), d’au moins deux autres membres que désigne le président parmi ceux qui sont nommés en vertu du paragra‐ phe 2(2) de la Loi. 4(2) When a panel of the Board is established to hear an appeal of a decision of the Minister under the Agri‐ cultural Land Protection and Development Act or a deci‐ sion of the Registrar under the Farm Land Identification Regulation – Real Property Tax Act, not less than half of the members referred to in paragraph (1)(b) shall be cur‐ rent or former agricultural producers. 4(2) Sont des producteurs agricoles actuels ou anciens au moins la moitié des membres mentionnés à l’ali‐ néa (1)b) qui sont convoqués en comité pour connaître de l’appel de la décision qu’a prise le ministre sous le ré‐ gime de la Loi sur la protection et l’aménagement du territoire agricole ou qu’a prise le registraire sous le ré‐ gime du Règlement sur l’identification des terres agri‐ coles –Loi sur l’impôt foncier. 4(3) When a panel of the Board is established to hear an appeal of a decision of the Registrar under the Live‐ stock Operations Act, the part of the panel composed of members referred to in paragraph (1)(b) shall consist of a minimum of three current or former agricultural produc‐ ers, at least two of whom shall be current or former live‐ stock producers. 4(3) Au nombre des membres de la Commission men‐ tionnés à l’alinéa (1)b) dont se compose le comité cons‐ titué pour connaître de l’appel de la décision qu’a prise le registraire sous le régime de la Loi sur l’élevage du bétail, au moins trois sont des producteurs agricoles ac‐ tuels ou anciens, dont au moins deux éleveurs de bétail actuels ou anciens. Appeal not a stay of decision Non-suspension de la décision 7 The commencement of an appeal of a decision under the Livestock Operations Act shall not operate as a stay of the decision being appealed and the decision being ap‐ pealed has the same force and effect as it would have had if no appeal had been commenced. 7 L’interjection de l’appel d’une décision prise sous le régime de la Loi sur l’élevage du bétail n’a pas pour ef‐ fet de suspendre l’application de la décision frappée d’appel, laquelle conserve tous ses effets, comme si elle n’avait pas fait l’objet d’un appel.
