"authority" means the Evergreen Environmental Technologies Corporation established as an authority in section 2. (« office ») "board" means the board of the authority. Appointments to board and length of term 4(1) Each member municipality is to appoint, by resolution, one member of its council as a member of the board and one member of its council as an alternate member of the board. Waste site location 5 The authority is to operate a waste site on land with the legal description as follows: N ½ 11-14-17 WPM on Certificates of Title 1961088 and 1961090. Service area 6 The authority's service area is the area of each member municipality and any other area designated by the board. Fees for each classification of waste 7 The board may establish classifications of waste. At the end of each calendar year, the board must set a fee schedule for the following year for each classification of waste. OFFICES RÉGIONAUX DE GESTION DES DÉCHETS R38 — R.M. 92/2004 06/04 3 Deficit and deficit reduction payments 8(1) At the end of the calendar year, the authority must review its revenues and expenses to determine if it is in a surplus or a deficit position. Déficit et paiements visant la réduction du déficit 8(1) À la fin de l'année civile, l'office examine ses revenus et ses dépenses afin de déterminer s'il y a eu bénéfice ou déficit. 8(2) If the authority is in a deficit position the board must (a) assess a deficit reduction payment against each of the member municipalities; and (b) give written notice to each member municipality of the amount of the deficit reduction payment that it is required to pay. 8(2) Si l'office est en déficit, le conseil d'administration : a) impose à chacune des municipalités participantes un paiement visant la réduction du déficit; b) avise par écrit chaque municipalité participante du montant qu'elle est tenue de payer aux fins de la réduction du déficit. 8(3) In respect of a deficit reduction payment under subsection (2), (a) the amount of the payment is to be calculated on a per capita basis in respect of the total population of all member municipalities; (b) the written notice must be given on or before the following March 1; and (c) the amount of the deficit reduction payment assessed must be paid by the member municipality on or before the following April 30. 8(3) Les règles suivantes s'appliquent au paiement visant la réduction du déficit : a) le montant du paiement est calculé par habitant à l'égard de l'ensemble de la population de toutes les municipalités participantes; b) l'avis écrit est donné au plus tard le 1er mars de l'année suivante; c) les municipalités participantes versent au plus tard le 30 avril de l'année suivante le montant qu'elles sont tenues de payer aux fins de la réduction du déficit. 8(4) The authority may impose a penalty on a member municipality for an overdue deficit reduction payment. The penalty must not exceed 1.25% per month. 8(4) L'office peut imposer à une municipalité participante une pénalité en raison du retard dans le paiement visant la réduction du déficit.
