Definitions Définitions 2 In this Regulation 2 Dans le présent règlement “Act” means the Natural Products Act; (Loi) “Area” means an area described in subsection 3(2); (région) “Board” means the Egg Farmers of New Brunswick; (Office) “designated representative” means an individual ap pointed under section 5; (représentant désigné) “licensed producer” means a producer who is the holder of a valid and subsisting licence issued by the Board; (producteur agréé) “member” means a member of the Board; (membre) “person” means an individual, corporation, partner ship, cooperative or unincorporated group; (personne) “Plan” means the Plan as defined in the Egg Plan and Levies Regulation - Natural Products Act; (Plan) “producer” means a person engaged in the production and marketing of the regulated product within the regu lated area; (producteur) “regulated area” means the regulated area as defined in the Egg Plan and Levies Regulation - Natural Prod ucts Act; (zone réglementée) “regulated product” means the regulated product as defined in the Egg Plan and Levies Regulation - Natural Products Act. (produit réglementé) 2015-50 « Loi » désigne la Loi sur les produits naturels; (Act) « membre » désigne un membre de l’Office; (mem ber) « Office » désigne Les producteurs d’oeufs du Nouveau-Brunswick; (Board) « personne » désigne un particulier, une corporation, une société en nom collectif, une coopérative ou un groupe non constitué en corporation; (person) « Plan » désigne le Plan défini dans le Règlement con cernant le Plan et les redevances relatifs aux oeufs - Loi sur les produits naturels; (Plan) « producteur » désigne une personne qui se livre à la production et à la commercialisation du produit régle menté dans la zone réglementée; (producer) « producteur agréé » désigne un producteur titulaire d’un permis valide et non périmé délivré par l’Office; (licensed producer) « produit réglementé » désigne le produit réglementé défini au Règlement concernant le Plan et les rede vances relatifs aux oeufs - Loi sur les produits naturels; (regulated product) « région » désigne une région décrite au paragra phe 3(2); (Area) « représentant désigné » désigne un particulier nom mé en vertu de l’article 5; (designated representative) « zone réglementée » désigne la zone réglementée dé finie dans le Règlement concernant le Plan et les rede 2003-71 Loi sur les produits naturels N-1.2 2 vances relatifs aux oeufs - Loi sur les produits naturels. Designated representative Représentant désigné 5(1) Subject to subsection (2), every producer who wishes to vote at an election or be a member shall ap point an individual as a designated representative to act on behalf of the producer and shall file the designation with the Board. 5(1) Sous réserve du paragraphe (2), chaque produc teur qui désire voter à une élection ou devenir membre nomme un particulier comme représentant désigné pour représenter le producteur et dépose la désignation auprès de l’Office. 5(2) A producer shall appoint only one designated rep resentative to act on behalf of the producer for any par ticular period of time. 5(2) Un producteur ne peut nommer qu’un seul repré sentant désigné pour le représenter pour toute période particulière. 5(3) Where a producer is an individual, the producer may appoint himself or herself as a designated represen tative. 5(3) Lorsqu’un producteur est un particulier, il peut se nommer lui-même comme représentant désigné. (ii) dans le cas d’une personne votant pour un membre général, dans la zone réglementée. 2003-71 Loi sur les produits naturels N-1.2 4 Election of members Élection des membres 8(1) Before December 15 in each year, the secretary manager of the Board shall send a notice to all persons who, according to the records of the Board, are qualified to hold office under section 6, asking whether they wish to have their names balloted as a candidate for election as an Area member. 8(1) Le secrétaire-directeur de l’Office doit, avant le 15 décembre de chaque année, envoyer à toutes les per sonnes qui, conformément aux registres de l’Office, pos sèdent les qualités requises pour occuper un poste en vertu de l’article 6, un avis leur demandant s’ils désirent se porter candidat à l’élection à titre de membre repré sentant la région. 8(2) Where the term of an Area member is to expire in any given year, the secretary-manager of the Board shall, before December 31 in the preceding year, send to all persons in that Area who, according to the records of the Board, are qualified to vote under section 7, a ballot list ing all candidates for that Area, with a footnote that all ballots must be returned to the Board before Janu ary 15 in that year. 8(2) Lorsque le mandat d’un membre représentant une région doit prendre fin dans une année donnée, le secrétaire-directeur de l’Office doit, avant le 31 décem bre de l’année précédente, envoyer à toutes les personnes dans cette région qui, conformément aux registres de l’Office, possèdent les qualités requises pour voter en vertu de l’article 7, un bulletin de vote sur lequel figure le nom de tous les candidats pour cette région ainsi qu’une note en bas de page indiquant que tous les bulle tins de vote doivent être remis à l’Office avant le 15 jan vier de l’année en question. 8(3) Before January 31 in each year, the secretary manager of the Board shall send another notice to all persons who, according to the records of the Board, are qualified to hold office under section 6 and who are not Area members asking whether they wish to have their names balloted as a candidate for election as a member at large. 8(3) Le secrétaire-directeur de l’Office doit, avant le 31 janvier de chaque année, envoyer un second avis à toutes les personnes qui, conformément aux registres de l’Office, possèdent les qualités requises pour occuper un poste en vertu de l’article 6 et qui ne sont pas membres représentant la région, leur demandant s’il désirent se porter candidat au poste de membre élu au scrutin géné ral. 8(4) Before February 15 in each year, the secretary manager of the Board shall send to all persons who, ac cording to the records of the Board, are qualified to vote under section 7, a ballot listing all candidates for the member at large with a footnote that all ballots must be returned to the Board before February 28 in that year. 8(4) Le secrétaire-directeur de l’Office doit, avant le 15 février de chaque année, envoyer à toutes les per sonnes qui, conformément aux registres de l’Office, pos sèdent les qualités requises pour voter en vertu de l’arti cle 7, un bulletin de vote sur lequel figure le nom de tous les candidats au scrutin général de l’Office ainsi qu’une note en bas de page indiquant que tous les bulletins de vote doivent être remis à l’Office avant le 28 février de l’année en question. 8(5) A ballot is valid only if it is appropriately marked and received at the head office of the Board on or before the deadline voting date. 8(5) Ne sont valides que les bulletins de vote correcte ment remplis et reçus au siège social au plus tard à la date limite fixée pour le scrutin. 8(6) An individual voting in an election is entitled to vote only once in the election. 8(6) Un particulier qui vote à une élection n’a droit de voter qu’une seule fois à l’élection. 8(7) The winner of an election shall be the candidate with the highest number of valid ballots in his or her fa vour. 8(7) Le gagnant à l’élection est le candidat qui a le plus grand nombre de bulletins de votes valides en sa fa veur. N-1.2 Natural Products Act 2003-71 5 8(8) The ballots shall be opened and counted in the presence of the secretary-manager of the Board and a representative of the Commission and the results of the election shall be reported to the annual meeting of the Board. 8(8) Le dépouillement du scrutin est effectué en pré sence du secrétaire-directeur de l’Office et d’un repré sentant de la Commission et il doit être fait état des ré sultats à l’assemblée annuelle de l’Office.
