ANIMAL PROTECTION ACT Pursuant to the provisions of the Animal Protection Act, the Commissioner of the Yukon Territory is pleased to and doth hereby order as follows: 1. The annexed Animal Protection Regulations are hereby made and established. Dated at Whitehorse, in the Yukon Territory, this 10th day of August, A.D., 1978. These Regulations may be cited as the Animal Protection Regulations. 2. In these regulations: “Act” means the Animal Protection Act. 3.(1) An organization desiring approval as a humane society under the Act shall apply therefor in writing to the Commissioner. (2) An application under subsection (1) shall contain the following particulars: (a) whether or not the humane society is incorporated; (b) the date and place of incorporation; (c) the location of the principal headquarters of the society and the general geographical area within which its activities are carried on; and (d) a statement of such other information as the Commissioner may require, including details concerning the operation and management of the organization. 4.(1) Where the Commissioner is satisfied as to the suitability of an applicant under section 3 he may approve it as a humane society and shall thereupon issue a certificate of approval to the applicant. (2) Subject to these regulations, an approval under subsection (1) remains in effect until an organization disbands or ceases to operate. 5. Where the Commissioner decides to suspend or revoke the approval of an organization as a humane society, he shall (a) provide the humane society with at least 10 days notice in writing which notice shall briefly refer to the reason for his proposed course of action, and (b) if the humane society, within the time RÈGLEMENT 1. («Act») 3.(1) Toute organisation qui désire être agréée à titre de société protectrice en vertu de la Loi doit en faire la demande par écrit au Commissaire. (2) Dans la demande faite conformément au paragraphe (1), il faut indiquer : a) si l’organisation est constituée en société ou nom; b) le cas échéant, la date et le lieu de sa constitution en société; c) le lieu où se trouve le siège de la société et la région géographique dans laquelle elle mène ses activités; d) tout autre renseignement que peut exiger le Commissaire, y compris des détails sur les activités et la gestion de l’organisation. 4.(1) Lorsqu’il est convaincu que l’organisation qui a présenté une demande conformément à l’article 3 répond aux critères établis, le Commissaire peut la reconnaître à titre de société protectrice et lui délivrer un certificat à cette fin. (2) Sous réserve du présent règlement, le certificat délivré en vertu du paragraphe (1) demeure en vigueur jusqu’à ce que l’organisation soit dissoute ou cesse de mener ses activités. 5. Si le Commissaire décide de suspendre ou de révoquer le certificat d’une organisation à titre de société protectrice : a) il donne à la société un préavis écrit d’au moins dix jours énonçant brièvement les motifs de la suspension ou de la révocation; b) si la société, dans le délai mentionné à l’alinéa a), exprime le désir de formuler des observations C.O. 1978/162 ANIMAL PROTECTION ACT O.C. 1978/162 LOI SUR LA PROTECTION DES ANIMAUX 2YUKON REGULATIONS RÈGLEMENTS DU YUKON referred to in paragraph (a) signifies a desire to be heard with respect to the question of suspension or revocation, as the case may be, the Commissioner shall give at least another 10 days for the applicant to show cause why such suspension or revocation should not be effected. 6.(1) A humane society may, in respect of a horse, cow, sheep, pig or other large animal taken into custody under the Act, charge the owner thereof any actual expenses incurred by the society for the transportation, food, shelter, medical treatment and other care of the animal. (2) A humane society may charge the owner of any other animal taken into custody under the Act (a) for the reasonably necessary transportation of the animal (i) if by hired vehicle, the actual cost thereof to the society, or (ii) if by vehicle of the society, at the rate of 12 cents per kilometre or, where the transportation is entirely within a city, town, or village, the sum of $5.00 regardless of the distance travelled therein, (b) for the food, care and shelter of the animal (i) if provided in a shelter operated by the society, at the rate of $5.00 per day, or (ii) if provided elsewhere, the actual cost thereof to the society, and (c) for medical treatment of the animal (i) if provided by an employee of the society, the actual cost thereof to the society if that cost exceeds $1.00, or (ii) if otherwise provided, the actual cost thereof to the society. 7.(1) The Commissioner or his designate may grant special authority to a peace officer who may exercise the powers given by section 10 of the Act. relativement à la suspension ou à la révocation il lui accorde un autre délai d’au moins dix jours où elle pourra expliquer pourquoi il n’y a pas lieu de procéder à la suspension ou à la révocation. 6.(1) La société protectrice peut, dans le cas d’un cheval, d’une vache, d’un mouton, d’un porc ou d’un autre gros animal qu’elle a pris en charge en vertu de la Loi, demander au propriétaire de la rembourser des dépenses qu’elle a effectivement engagées pour le transport, l’alimentation et l’hébergement de l’animal, ainsi que pour les soins médicaux et autres soins qui lui ont été prodigués. (2) La société protectrice peut demander au propriétaire de tout autre animal qu’elle a pris en charge en vertu de la Loi de la rembourser des dépenses suivantes : a) dépenses raisonnables et nécessaires engagées pour le transport de l’animal, soit : (i) dans le cas du transport au moyen d’un véhicule loué, le coût réel pour la société, (ii) dans le cas du transport au moyen d’un véhicule de la société, à raison de 12 cents le kilomètre ou, s’il n’y a pas lieu de sortir de la ville ou du village, la somme de 5 $, quelle que soit la distance parcourue; b) dépenses engagées pour l’alimentation, les soins et l’hébergement de l’animal, soit : (i) s’ils sont fournis dans un abri exploité par la société, 5 $ par jour, (ii) s’ils sont fournis ailleurs, leur coût réel pour la société; c) dépenses engagées pour les soins médicaux prodigués à l’animal, soit : (i) s’ils sont prodigués par un employé de la société, leur coût réel pour la société, s’il dépasse un dollar, (ii) s’ils sont prodigués ailleurs, leur coût réel pour la société. 7.(1) Le Commissaire ou la personne désignée par lui peut accorder à un agent de la paix l’autorisation spéciale d’exercer les pouvoirs conférés par l’article 10 de la Loi. C.O. 1978/162 ANIMAL PROTECTION ACT O.C. 1978/162 LOI SUR LA PROTECTION DES ANIMAUX 3YUKON REGULATIONS RÈGLEMENTS DU YUKON (2) A peace officer acting under subsection (1) shall, when reasonably possible, inform any person in actual or apparent control of the premises or building in question that he is acting under authority of the Act and these regulations. 8.(1) A society desiring to have an agent appointed as a special constable with authority to exercise the powers of the peace officer for the purposes of the Act shall, in writing, recommend the person to the Commissioner for such appointment. (2) Where any person appointed under subsection (1) resigns, dies or otherwise ceases to act as an agent of the humane society that he worked for at the time of his appointment, the society shall notify the Commissioner in writing of that fact. 9. The Certificate of Approval in respect of a humane society shall be in the form as set out in Schedule I of these Regulations. (2) Lorsque la personne nommée en application du paragraphe (1) démissionne, décède ou cesse d’agir à titre de représentant de la société protectrice par laquelle elle était employée au moment de sa nomination, la société en informe le Commissaire par écrit. 9. Le certificat de reconnaissance de la société protectrice est rédigé en la forme prescrite à l’annexe 1 du présent règlement.
