« entente » “Settlement Land” has the same meaning as in the Agreement or in a Subsequent Agreement; « terre visée par le règlement » or « terre visée par un règlement » “Subsequent Agreement” means a Yukon Land Claim Final Agreement entered into between the Government of Canada, the Government of the Yukon, and a Yukon First Nation and ratified by the Yukon First Nation after September 15, 1992 and includes any amendment to the Subsequent Agreement; « entente ultérieure » “Yukon First Nation” means one of the following: (a) Carcross/Tagish First Nation, (b) Champagne and Aishihik First Nations, (c) Dawson First Nation, (d) Kluane Tribal Council, (e) Kwanlin Dun First Nation, (f) Liard First Nation, (g) Little Salmon/Carmacks First Nation, (h) First Nation of Na-Cho Ny’ak Dun, « entente » L’Entente définitive sur les revendications territoriales au Yukon, ensemble ses modifications, intervenue entre le gouvernement du Canada, le gouvernement du Yukon et les premières nations Champagne et Aishihik, ratifiée par ces premières nations le 15 septembre 1992 et déposée devant l’Assemblée législative le 14 décembre 1992. “Agreement” « entente ultérieure » Entente définitive sur les revendications territoriales au Yukon, ensemble ses modifications, intervenue entre le gouvernement du Canada, le gouvernement du Yukon et une première nation du Yukon et ratifiée par la première nation après le 15 septembre 1992. “Subsequent Agreement” « Indien du Yukon » Personne inscrite aux termes de l’entente ou d’une entente ultérieure. “Yukon Indian Person” « première nation du Yukon » Selon le cas : a) la première nation de Carcross/Tagish; [S.Y. 2002, c. 240, s. 2] [L.Y. 2002, ch. 240, art. 2] 3 Subsequent Agreements (Ententes ultérieures) 3 Subsequent Agreements 3 Ententes ultérieures (1) The Commissioner in Executive Council may by order approve a Subsequent Agreement as a land claims agreement referred to in section 35 of the Constitution Act, 1982 and the Subsequent Agreement has the force of law. (2) An order under subsection (1), together with the Subsequent Agreement to which the order relates, shall be tabled and recorded before the Legislative Assembly not later than 15 days after its issue or, if the Legislative Assembly is not then sitting, within the first 15 days next thereafter that the Legislative Assembly is sitting. [S.Y. 2002, c. 240, s. 3] [L.Y. 2002, ch. 240, art. 3] 4 Effect of Agreement (Portée de l ’entent e) 4 Effect of Agreement 4 Portée de l’entente For greater certainty, if the Agreement or Subsequent Agreement confers on any person or body a right, privilege, benefit, or power, requires any person or body to perform a duty, or subjects any person or body to a liability, that person or body may exercise the right, privilege, benefit, or power, shall perform the duty, or is subject to the liability to the extent provided for by the Agreement or in a Subsequent Agreement. (1) Sous réserve des paragraphes (2) à (5), tous les textes et arrêtés municipaux s’appliquent à tous les Indiens du Yukon, à toutes les premières nations du Yukon et à toutes les terres visées par un règlement. (2) If there is any inconsistency or conflict between an enactment or municipal bylaw and the Agreement or a Subsequent Agreement, the Agreement or Subsequent Agreement shall prevail to the extent of the inconsistency or conflict. (2) L’entente ou une entente ultérieure l’emporte sur toute texte ou arrêté municipal incompatible. (3) If there is any inconsistency or conflict between this Act and any other enactment including the Human Rights Act, this Act shall prevail to the extent of the inconsistency or conflict. (4) If there is any inconsistency or conflict between the Inuvialuit Final Agreement in effect on December 7, 1991 and the Agreement or a Subsequent Agreement, the Inuvialuit Final Agreement shall prevail to the extent of the inconsistency or conflict.
