[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In this Order, Act means The Marketing of Agricultural Products Act of Alberta; (Loi) Commodity Board means the Alberta Egg and Fowl Marketing Board established pursuant to the Act; (Office de commercialisation) egg means the egg of a hen produced in Alberta and in cludes the egg product of a hen produced and prepared in Alberta; (œuf) hen means the hen of any class of the domestic chicken belonging to the species Gallus Domesticus; (poule) Plan means any plan for the marketing of eggs estab lished and amended from time to time pursuant to the Act; (Plan) processor means any person who grades, packs, trans forms and who markets, stores and transports eggs; (transformateur) producer means any person engaged in the production of eggs in Alberta; (producteur) producer grader means any producer who grades, packs and markets his own eggs. (producteur-classeur) 2 Dans la présente ordonnance, Loi désigne la loi intitulée The Marketing of Agricultural Products Act de l’Alberta; (Act) œuf désigne l’œuf de poule produit en Alberta et com prend tout sous-produit d’œuf de poule produit et prépa ré en Alberta; (egg) Office de commercialisation désigne l’office dit Alberta Egg and Fowl Marketing Board établi en vertu de la Loi; (Commodity Board) Plan désigne tout plan de commercialisation des œufs adopté et, à l’occasion, modifié en vertu de la Loi; (Plan) poule désigne la poule de toute classe de volaille domes tique de l’espèce Gallus Domesticus; (hen) producteur désigne une personne qui s’adonne à la pro duction des œufs en Alberta; (producer) producteur-classeur désigne un producteur qui classe, emballe et commercialise ses propres œufs; (producer grader) transformateur désigne une personne qui classe, em balle, transforme, commercialise, emmagasine et trans porte des œufs. (processor) Alberta Egg Marketing Levies Order Ordonnance sur les contributions à payer pour la commercialisation des oeufs de l’Al berta Levies Contributions Sections 3-5 Articles 3-5 Current to November 21, 2016 2 À jour au 21 novembre 2016 Levies Contributions 3 Every producer or producer grader shall pay to the Commodity Board, in addition to the service charges set out under the Plan, levies at the rate of $0.005 per dozen eggs sold by him. 3 Un producteur ou un producteur-classeur doit payer à l’Office de commercialisation, en plus des frais de service établis en vertu du Plan, une contribution de 0,005 $ la douzaine d’œufs qu’il vend. 4 (1) Every processor who buys eggs from a producer shall deduct from the moneys payable to the producer for the eggs, the levies payable under section 3, and shall pay and account to the Commodity Board for the said levies not later than Wednesday of the week following the week within which the eggs were bought. 4 (1) Un transformateur qui achète les œufs d’un pro ducteur doit déduire des sommes payables pour les œufs au producteur, les contributions à verser par ce dernier en vertu de l’article 3 et doit payer et rendre compte à l’Office de commercialisation de ces contributions au plus tard le mercredi de la semaine qui suit la semaine au cours de laquelle les œufs ont été achetés. (2) Where a producer or a producer grader sells eggs to any person other than a processor, he shall pay to the Commodity Board the levies payable under section 3 not later than Wednesday of the week following the week in which the eggs were sold. (2) Lorsqu’un producteur ou un producteur-classeur vend des œufs à une personne autre qu’un transforma teur, il doit payer à l’Office de commercialisation les contributions payables en vertu de l’article 3, au plus tard le mercredi de la semaine qui suit la semaine au cours de laquelle les œufs ont été vendus. 5 (1) The accounting by the processor to the Commodity Board required by subsection 4(1) shall be in a form de termined by the Commodity Board from time to time. 5 (1) La reddition de compte, du transformateur à l’Of fice de commercialisation, que prescrit le paragraphe 4(1) doit se faire de la manière déterminée par l’Office de commercialisation de temps à autre. (2) The levies, from the time of their deduction to the time of accounting and payment to the Commodity Board, shall be segregated as funds held in trust for the Commodity Board.
