1. This Act shall: a) Be called the Local Government (Amendment) Act of Bhutan 2014; b) Come into force on the 8th Day of the 1st Month of the Wood Female sheep Year of the Bhutanese Calendar corresponding to the 26th Day of February 2015; and c) Extend to the whole of Bhutan.

2. In the Local Government Act of Bhutan 2009, hereinafter referred to as the Act, Section 13 is amended as: The Parliament shall declare a certain geographical or administrative or economic area of the country as Thromde based on the recommendation of the government. The demarcation of Thromde boundary shall be carried out in consultation with the National Land Commission Secretariat, concerned local authority and land owners.

3. In the Act, Section 15 is amended as: Thromde shall be of two types: 1) Dzongkhag Thromde; and 2) Dzongkhag Yenlag Thromde. 4. In the Act, Section 16 is repealed.

5. In the Act, Section 17 is amended as: Establishment of Thromde The Government shall establish Dzongkhag Thromde Tshogde and Dzongkhag Yenlag Thromde in all the twenty Dzongkhags.

6. In the Act, Section 18 is amended as: Dzongkhag Yenlag Thromdes shall function either under Dzongkhag Administration or the Gewog Administration as decided by the Government.

7. In the Act, Section 31 is amended as: A member of a Local Government shall be removed upon incurring any of the following disqualifications and in accordance with the procedures as provided for in the rules and regulations, if he or she:

10. In the Act, Section 49 (f) is amended as: Preserve and promote culture, protect environment and monuments and sites of cultural and historical interests;

11. In the Act, Section 62 (d) is amended as: Regulate and enforce land use and building activity in the Dzongkhag Thromde in accordance with the approved plans;

12. In the Act, Section 62 (e) is amended as: Formulate guidelines for entertainment and recreational activities and venues in consultation with relevant agencies;

13. In the Act, Section 64 is amended as: Thromde Tshogde may levy the following in a manner and at such rates as may be approved by Parliament: (a) Land tax; (b) Property tax; (c) Property transfer tax; (d) Vacant land and underdevelopment tax; and (e) Such other taxes as may be approved by Parliament from time to time.

In the Act, New section after section 64 is inserted as: Thromde Tshogde may levy and vary rates of fees and charges as provided for in the rules and regulations and at such rates as may be approved by the Government. 15. In the Act, Section 65 is amended as: Thromde Tshogde shall in exercise of its power under section 64(1) of this Act, ensure that the fees and charges are:

In the Act, Section 69 is amended as: Dzongkhag Tshogdu shall also elect a Deputy Chairperson through secret ballot for which nominations shall be made from among the members by any member and seconded accordingly. The Dzongdag shall preside over the election of the Deputy Chairperson of the Dzongkhag Tshogdu. 17. In the Act, New Sub-section after Sub-section 83 (e) is inserted as: (ee) Inform Dzongkhag administration prior to per forming official travels within and outside the Dzongkhag: (ef) Approve official travels outside the gewog and leave of absence from duty for the Gewog Tshogde Chairpersons.

18. In the Act, New Sub-section under Section 84 is in serted as: (n) Approve official travels and leave of absence from duty for Gewog Tshogde members; (o) Approve official travels within the Gewog and leave of absence from duty for civil servants placed directly under the Gewog administration.

The Local Government (Amendment) Act of Bhutan 2014 4 ༢༠. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༩༡ པ་ ཕྱིར་དབྱུངས་མཛད་གྲུབ། ༢༡. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༡༡༨ པའི་ཤུལ་ལུ་ དོན་ཚན་གསརཔ་ བཙུགས་ ཡོདཔ་ དེ་ཡང་། སྤྱི་ཚོགས་ཀྱི་འཐུས་མི་གིས་ རྫོང་ཁག་ཚོགས་འདུ་དང་ རྒེད་འོག་ཚོགས་སྡེ་ ཁྲོམ་སྡེ་ ཚོགས་སྡེའི་ཚོགས་བཞུགས་ཚུ་ནང་ ལྟ་རྟོག་པ་སྦེ་བཅའ་མར་གཏོགས་ཆོག། ༢༢. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༢༠༥ པར་ འཕྲི་སྣོན་མཛད་ཡོདཔ་ དེ་ཡང་། རྒེད་འོག་བདག་སྐྱོང་དང་ རྫོང་ཁག་ཁྲོམ་སྡེའི་བདག་སྐྱོང་ རྫོང་ཁག་བདག་སྐྱོང་གིས་ རྫོང་ཁག་ཚོགས་འདུ་ལུ་ དུས་ཐོག་གི་སྙན་ཞུ་ཕུལ་དགོཔ་དང་ རྫོང་ཁག་ཚོགས་འདུ་ གིས་ གཞུང་དང་འབྲེལ་ཡོད་ལྷན་ཁག་ ལས་སྡེ་ འབྲེལ་ཡོད་སྤྱི་ཚོགས་ཀྱི་འཐུས་མི་ ཚུ་ལུ་གཏང་དགོ། ༢༣. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༢༠༨ པའི་ཤུལ་ལུ་ དོན་ཚན་གསརཔ་ བཙུགས་ ཡོདཔ་ དེ་ཡང་། ནང་སྲིད་དང་སྲོལ་འཛིན་ལྷན་ཁག་གིས་ ས་གནས་གཞུང་གི་འཐུས་མི་ཚུ་གིས་ བཅའ་ ཁྲིམས་འདི་དང་ འདིར་འོག་བཟོ་བའི་བཅའ་ཡིག་དང་ སྒྲིག་གཞི་ཚུ་གི་དགོངས་དོན་ཚུ་ ལུ་ ཆ་གནས་འབད་དགོཔ་ ངེས་བརྟན་བཟོ་དགོ། ༢༤. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༢༢༧ པར་ འཕྲི་སྣོན་མཛད་ཡོདཔ་ དེ་ཡང་། རྒེད་འོག་བདག་སྐྱོང་དང་ རྫོང་ཁག་བདག་སྐྱོང་ རྫོང་ཁག་ཁྲོམ་སྡེ་བདག་སྐྱོང་ཚུ་གིས་ ཟླ་རིམ་གྱི་རྩིས་ཁྲ་ཚུ་ དངུལ་འབྲེལ་གྱི་བཅའ་ཡིག་དང་ སྒྲིགས་གཞི་ལྟར་དུ་ གྲ་སྒྲིག་ བཟོ་སྟེ་ཕུལ་དགོ། ༢༥. བཅའ་ཁྲིམས་འདི་གི་ དོན་ཚན་ ༢༤༩ (ཏ) པར་ འཕྲི་སྣོན་མཛད་ཡོདཔ་ དེ་ཡང་། རྫོང་ཁག་དང་ རྒྱལ་ཡོངས་ལས་སྡེ་ ལུང་ཕྱོགས་ཡིག་ཚང་ཚུ་ དེ་ལས་རྫོང་ཁག་ཚོགས་ འདུ་དང་ རྒེད་འོག་ཚོགས་སྡེ་ ཁྲོམ་སྡེ་ཚོགས་སྡེ་ཚུའི་བར་ན་ འབྲེལ་མཐུན་འབད་ནི། འབྲུག་གི་ས་གནས་གཞུང་གི་(འཕྲི་སྣོན) བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། 5

20. In the Act, Section 91 is repealed.

21. In the Act, New Section after Section 118 is inserted as: The Members of Parliament may participate in the Dzongkhag Tshogdu, Gweog Tshogde and Thromde Tshogde sittings as observers.

22. In the Act, Section 205 is amended as: The Gewog Administration, Dzongkhag Thromde Administration and Dzongkhang Administration shall submit timely report to Dzongkhag Tshogdu and the Dzongkhag Tshogdu in turn shall submit to the Government, concerned Ministries, Agencies and concerned Members of Parliament.

23. In the Act, New Section after Section 208 is inserted as: The Ministry of Home and Cultural Affairs shall ensure that the members of the Local Governments comply with the provisions of this Act and rules and regulations made thereunder.

24. In the Act, Section 227 is amended as: Gewog Administration, Dzongkhag administration and Dzongkhag Thromde Administration shall prepare and submit accounts as per the financial rules and regulations.

25. In the Act, Section 249(i) is amended as: Coordinate between Dzongkhag, national agencies, regional offices, Dzongkhag Tshogdu, Gewog Tshogde, and Thromde Tshogde. 26. In the Act, Section 256 (a) is amended as: Be responsible for maintaining law and order in the Dzongkhag including the Thromde.

27. In the Act, Section 258 is amended as: The Dzongda shall attend in the sessions of the Dzongkhag Tshogdu and may also attend the Gewog and Thromde Tshogde sessions as an observer.

28. In the Act, Section 265 is amended as: There shall be a gewog administration which shall be staffed by but not limited to the following civil servants: a) Administrative officer; b) Accounts personnel; and c) Engineer.

29. In the Act, Section 270 is amended as: Gewog Administrative Officer shall be the joint-signatory with the Gup and Accounts personnel for the operation of Gewog accounts;

30. In the Act, New Sub-section under Section 273 is inserted as: Organize relief measures for natural disasters and emergencies in coordination with relevant agencies within Thromde. The Local Government (Amendment) Act of Bhutan 2014 6
