Short title and commencement. 1 his Act which amends the oat Re istration Act Ch. 277 ma e cited as the oat Re istration Amendment Act 2 24. 2 his Act shall come into operation on 1st arch 2 24. 2. Amendment of section 6 of the principal Act. Section 6 of the principal Act is amended the deletion of su section 1 and the su stitution of the followin 1 Su ect to su section 3 e er oat efore ein re istered under this Act shall to ether with the machiner sail ear fi tures e uipment apparel and appurtenances used therewith e su mitted for the inspection of the ew Pro idence Port Authorit and that Authorit shall decide whether such oat is fit and proper to e re istered. 1A hen a oat is ein su mitted for inspection under su section 1 e er owner of a oat shall pro ide to the ew Pro idence Port Authorit the followin a record of alid crew trainin sur e s conducted in the last twel e months c histor of dr doc in and d oat maintenance records. 1 After the initial re istration an inspection in accordance with su sections 1 and 1A of the oat shall ta e place annuall . . 2 No. 5 of 2024 [Date of Assent - 7th May, 2024] . nsertion of ne section A into the principal Act. he principal Act is amended the insertion immediatel after section 8 of a new section 8A as follows A. ns rance. er owner or operator of a oat re istered under this Act that is used to pl offer or let for hire in the waters of he ahamas shall procure and maintain a comprehensi e insurance polic from a compan licensed under the Insurance Act to carr on insurance usiness in he ahamas. . . nsertion of ne section 1 A into the principal Act. he principal Act is amended the insertion immediatel after section 13 of a new section 13A as follows 1 A. ertificate of eletion. 1 he owner of a oat ma re uest in writin the cancellation of the re istration of a oat and the re uest shall e accompanied a the certificate of re istration of the oat a document confirmin the identit of the owner and c an other documents re uired the ew Pro idence Port Authorit . 2 he Authorit upon ein satisfied that the owner of the oat has complied with su section 1 shall cancel the re istration of the oat in the special re ister and shall issue a ertificate of eletion on pa ment of the prescri ed fee. 3 he ertificate of eletion shall e deemed conclusi e e idence of the cancellation of the oat s re istration. . epeal and replacement of section 16 of the principal Act. Section 16 of the principal Act is repealed and replaced as follows 16. ffences. 1 er person ein the owner of a oat a re uired this Act to e re istered who shall omit to ha e such oat re istered where re istration or renewal of the re istration whereof has een cancelled or has e pired c which is not su mitted for inspection pursuant to section 6 or section 11 of this Act or 3 d which shall fail to su mit a alid insurance polic pursuant to section 8A of this Act who shall pl offer or let the same for or to hire shall e uilt of an offence and shall e lia le on con iction to a penalt not less than fi e thousand dollars and not e ceedin ten thousand dollars. 2 An person who acts as master of a oat for hire or emplo s an other person so to do without first o tainin a licence under this Act shall e uilt of an offence and shall e lia le on con iction to a penalt not less than one thousand dollars and not e ceedin fi e thousand dollars. 3 er owner or master of a oat who himself or a ser ant shall refuse or fail to admit on his oat an person or persons authori ed under section 1 to oard and enter and remain on such oat shall e uilt of an offence and shall on con iction e lia le to a penalt not less than one thousand dollars and not e ceedin fi e thousand dollars. 4 er person who fails to compl with the pro isions of this Act for which no specific penalt has een pro ided shall e lia le on con iction to a penalt not less than one thousand dollars and not e ceedin ten thousand dollars. 6. epeal and eplacement of the irst Sched le to the rincipal Act. he First Schedule to the principal Act is repealed and replaced as follows IRST SC ED E (section (4)) oat Re istration Fees A.
