Order No. 2 establishing authorization requirements for extraction of federal public waters for industrial or hygienic purposes

Order No. 2 of 9 February 1979 The Secretary for the Environment, by the authority vested in him by Article 4 (C) of Decree No. 73.030, of 30 October 1973, taking account of Order No. 1832, of 17 November 1978, of the State Minister of Mines and Energy, hereby lays down the following rules: I. The concession or authorization requests, for extraction of federal public waters for industrial or hygienic purposes, that are directed toward the Special Secretariat of the Environment SEMA, shall be reviewed, by way of priority, by the Assistant Secretary of Science and Technology, for approval by the Environment Secretary. II. SEMA may certify regional environmental agencies or entities to approve the applications referred to in the present Order. In which case, a copy of the application and final decision shall be transmitted to SEMA, for communication to the National Department of Water and Electrical Energy, of the Ministry of Mines and Energy. III. The decision issued regarding the award or denial the authorization requested shall be based on applicable federal and state legislation, also taking into consideration the self-purification capacity of watercourses.
