Note— Under section 9(3) of the Act, this notice remains in force until whichever of the following first happens— (a) the commencement of a regulation under section 9(1) of the Act in relation to the same matter; (b) the end of 3 months. 2 Definitions In this notice— vegetable leafminer means the pest Liriomyza sativae Blanchard. vegetable leafminer pest area means the part of Queensland north of latitude 13º45' south. Note— Latitude 13º45' south passes near Coen. 3 Restriction on moving vegetable leafminer and infested plant (1) A person must not, without an inspector’s approval, move vegetable leafminer or an infested plant— (a) out of the vegetable leafminer pest area; or (b) from a parcel of land in the vegetable leafminer pest area to another parcel of land in the area. Reprint 0A effective 3 September 2008 Page 3 [s 4] Plant Protection (Vegetable Leafminer—Movement Prohibition) Notice 2008 (2) An inspector may give an approval, with or without conditions, only if the inspector is satisfied the movement of the vegetable leafminer or infested plant will not pose a significant risk of spreading vegetable leafminer in Queensland. (3) In this section— infested plant means a plant infested with vegetable leafminer. 4 Attachment (1) The attachment to this notice shows the approximate location of the vegetable leafminer pest area. (2) The attachment does not form part of this notice.
