Law on the Fund for the Protection of Natural Medicinal, Ether-oil and Tannin Plants

REPU'BLIC OP ALBANIA PARLAMENT LAW ON PROTECTION OF NATIJRAL MEDICINAL, ETHER-OIL, TANNIN PLANJ:S' FJJND Oaaed on section 16 of the law no.7491, da.t:e 7-9.4.1qg1 "For main constitutional provisions", with proposal of the Council of Ministers, THB PARUMENT O'I' REPOBLIC OF ALBANIA DECIDED: Sec:tion 1 The fund of natural medicinal, ether-oil and tannin plants which are grown and cultivated within territory of Republic of Albania is national property. Their ownwershlp and management is eetimatcd according the land area where they are grown and cultivated. Section .2 General Forestry Directorate and its subordinate organs are charged. to take measures for protecting, multiplying ~nd well growing of natural medicinal, ether-oil and tannin plants. In state owned areas this directorate determine zones, tenns, kinds, contingents as well ae give the pcrmiccion for their harvesting and collecting. Section 3 Physical and juridical entities, who are going to harvest natural medicinal, ether-oil and tannin plants, are obliged to be provided with a permission by the ctireccorace ot torescry service of the jurisdiction where they are being grown. Section 4 Natural medicinal, ether-oi\ and tannin plants which are being decreased and endangered to .be dissappeared, are determined in a special list by the Minister of Agriculturale and Food, on October of eve:ry yaar. He proclaims desisting of harvesting, collecting, and exporting these planes fur a cert4in time, up to their multiplying and regeneration. This desisting includes plants of all ownership's forms. Section 5 The narvesc of natural medicinal, ethe:i:- oil and tanrtin plants is performed according the techical criteria which are defined in a particular regolation, by the Minister of hgriculture and Food, despite of ownership on these plants. It is forbiden to be carried out in the fund of these plants every kind of activities that lead in their destruction, damage, and reduce of their production and regeneration as well, except the cases determined by the Minister at Agriculture and Food. Section 6 The right of control! for applying this law, have the forestry service organs. The submi::u:d.un of administrative contraventions is performed by a commission of no more than three persons, atached to the directorate of forestry service, composition of which is defined by its director. Contravention of the law's provisions, provided in sections 3, 4, and 5, when the value of plant material collected is over 1000 lek, is considered administrative contravention and is condemned with a peualy r.com 250 to 10 ooo lek and sequestrating the plant material or its counterparty in case it {plant material) is not available. Section 8 The claim against condemnincr the administrative contravention and the execution of decisions is performed according the procedure provided in law no 7. 4 1993 " On administrative contraventions". Section 9 The Minister ot Agriculcure and Food ls responaible to issue the relevant orders (sub-legal acts) for applying this law.
